PRESENT: Doney, Humeston, Mack, Klingelhofer ABSENT: Sheridan City Attorney ~ourke, present City Engineer Carlsen, present City Planner Remland, present Moved by Klingelhofe~, seconded by Mack that minutes of April 1st, 1963 be approved as mailed and received. Carried. It appearing that the hour of ?:30 o'clock P. M. had arrived, the City Clerki&dvised RESOLUTIQN the City Council that this was.now the time, N0.649 date and place for the public hearing called TUSTIN CITY for by Resolution No. 649 of this City Council SEWER ASSESS- adopted April 1, 1963 being a resolution MENT DIST. proposing to change, modify and amend the plans, as amended, and the specifications heretofore approved for sanitary sewer improvements in "Tustin City Sewer ASsessment District No. 1." as said plans as amended, and as said specifi- cations are referred to and incorporated in Resolution of Intention No. 615, as amended by Resolution No. 621, and the work to be done as described and shown on said plans and specifications. The City Clerk advised the Council that said AFFIDAVIT ON Resolution No. 649 had been published on April PUBLICATION 4, 1963, in the Tustin News, in accordance with the order of the City Council and that the affidavit of publication had been received and was on file in the office of the City Clerk. Upon inquiry by the Mayor, the City Clerk advised the City Council that no written NO PROTESTS objections of an]r kind or character whatsoever ON AMENDMENTS had been filed with her or the Council 0R CHANGES concerning the proposed changes, modifications and amendments. The Mayor then inquired if there were any persons present who wiShed~tO object to the proposed changes, modifications and/or amendments. There were no such objections from any of the persons present. The City Council was further advised by 6he City Clerk that the contractor, Edmond J. VADNAIS Vadnais, General Contractor, had consented CONTRACTOR in writing to the making of the said changes, CONSENTS modifications and amendments described in said TO CHANGES ~esolution No. 649 and that said w~itten consent was on file in the office of the City Clerk. I!55 The City Council then indicated that it was~eady to act, whereupon the City Clerk presented to the Council for its consideration a resolution to be numbered Resolution No. 651. MOved by Ktingelhofer, seconded by Mack and duly carried unanimously. Resolution entitled as follows: ADOPTION OF RESOLUTION "A RESOLUTION OF THE CITY COUNCIL OF THE N0. 651 CITY.OF TUSTIN, CALIFORNIA, CHANGING, MODIFYING AND AMENDING THE PLANS, AS AMENDED, AND THE SPECIFICATIONS HERETO- FORE APPROVED FOR AND PERTAINING T0 TUSTIN CITY SEWER ASSESSMENT DISTRICT N0. 1.' AS SAID PLANS, AS AMENDED, AND SAID SPECIFICATIONS ARE REFERRED TO AND INCORP- ORATED IN RESOLUTION OF INTENTION N0. 615 AS AMENDED BY RESOLUTION N0. 621, AND MODIFYING THE WORK TO BE DONE AS DESCRIBED AND SHOWN ON SAID PLANS, AS AMENDED, AND SAID SPECI!FICATIONS," it was thereupon moved by Councilman Mack, seconded by Councilman Humeaton that said Resolution No. 651 be adopted, and the same was thereupon adopted by the following roll call vote: AYES: QOUNCILMEN Done~, Humeston, Mack, Klingelho~er NOES: COUNCILMEN None ABSENT: COUNCILMEN Sheridan HEARING ON Rearingon "~EWPORT AVENUE ANNEXATION TO THE CITY NEWPORT OF TUS~IN" opened at ?:36 P. CONTINUANCE FROM IRVINE CO & Moved by Mack, seconded by Klingelhofer that SANTA FE LAND "RED HILL ANNEXATION" hearing be continued to May 20th, 1963 at 7:30 P. M., in the Council Chambers, 145 W. Third St., Tustin. Carried. HEARING ON Hearing on Zone Change application No. 63-116 EC, 63-116 of Harry Ga~es opened at 7:~lP. M. OPENED ApDlication, Planning Commission findings and recommendations and correspondence and petitions presented by the Clerk. Mr. Harry Gates spoke in his own behalf. Those present objecting to this zone change: A. Charleton, 460 W. Second St. D. Hefner, 525 W. Third St. i. 5:6: There being no further objections or comments the hearing was declared closed at 7:57 P. M. Mr. Hemland, Planning Dept., explained situation of spot zoning and that in his opinion this change ~his change would not be in the interest of good planning. DENIAL ON Moved by Klingelhofer, seconded by Humeston ZC No. 63-116 that the Council accept the recommendations of the Planning Commission and that the Zone Change application No. 63-116 of Harry Gates be denied. Carried by roll call. Ayes: Doney, Humeaton, Mack, Klingelhofer. Absent: Sheridan. AUTHORIZATION Moved by Klingelhofer, seconded by Humeaton TO SIGN that either the City Engineer or his PERMIT assistant be authorized to sign permit to 0R. C0. FLOOD Orange County Flood Control District for CONTROL RE: off site sewer construction for tract a97a. Tract 4974 Moved by Humeaton, seconded by Mack that Mr. Eldon Hemland be authorized to attend REMLAND- Condominium meeting on May 6th, expenses CONDOMINIUM to be covered by the City. Carried. MEETING Moved by Mac~, seconded by Humeaton, that PERMISSION Mr. Hemland be authorized to attend monthly TO ATTEND meetings of the Orange County Planners at MONTHLY the expense of the City. Carried.
