RESOLUTION NO. 88-91 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FIXING AND DETERMINING THE AMOUNT OF REVENUE REQUIRED FROM PROPERTY TAXES OF THE CITY OF TUSTIN AND FIXING THE RATE OF TAXES ON THE TAXABLE PROPERTY WITHIN THE CITY OF TUSTIN TO SERVICE THE DEBT OF THE GENERAL OBLIGATION BONDS OF THE CITY FOR THE FISCAL YEAR 1988-89 Adopt Resolution No. 88-91 fixing the tax rate to be levied on the full value of secured property within the City of Tustin at .00401 percent to provide adequate resources to service the debt obligation on outstanding 1973 Civic Center General Obligation Bonds for fiscal year 1988-89 as recommended by the Finance Department. 13. RAILROAD CASES Agree, by Minute Order, to the following proposed action of the County Counsel: (1) The plaintiffs shall not be required to serve any further Pleadings on Orange County defendants, and service on the Attorney General is sufficient; (2) The Orange County defendants shall not be required to make any further appearances or submit any further Pleadings in the action; and (3) The Orange County defendants agree to be bound by any final judgment ordered and approved by the court including, if applicable, the payment of refunds in proportion to the taxes allocated to the County; as recommended by the City Attorney. RESOLUTION NO. 88-93 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REVERSING THE DECISION OF THE PLANNING COMMISSION AND APPROVING THE USE OF EXPOSED NEON TUBING AT 174 E. MAIN STREET Adopt Resolution No. 88-93 approving Design Review 88-13 to allow the use of exposed neon tubing for Daddy-O's Restaurant recommended by the Community Development Department. 15. CITY OF TUSTIN ASSESSMENT DISTRICT NO. 86-2, SOUTHERN CALIFORNIA EDISON COMPANY UTILITY AGREEMENT Approve the Southern California Edison Company agreement for electrical improvement and authorize the Mayor to execute said agreement as recommended by the Public Works Department/ Engineering Division. 16. TUSTIN RAJ(CH ROAD INTERCHANGE PROJECT AT SANTA ANA (I-5) FREEWAY AGREEMENT Approve the freeway agreement and authorize the Mayor to execute subject to the final approval of the City Attorney as recommended by the Public Works Department/Engineering Division. 17. REVISION OF MINUTES REGARDING AUDIT CO~ITTEE APPOINTMENTS Approve the addition to the Minutes of May 2, 1988, regarding the City Council votes for the Audit Committee appointments as recommended by the City Clerk. 18. AGREEMENT WITH THE ORANGE COUNTY FLOOD CONTROL DISTRICT AND ll(E IRVINE COMPANY FOR CONSTRUCTION AND MAINTENANCE OF LOWER PETERS CANYON RETARDING BASIN AND APPURTENANT FACILITIES Approve the above-referenced agreement and authorize the Mayor and City Clerk to execute as recommended by the Public Works Department/Engineering Di vision. ORDINANCES FOR ADOPTION ADOPTION OF ORDINANCE NO. 1011 RELATIVE TO MINUTES OF CLOSED SESSIONS The following Ordinance No. 1011 had first reading and introduction at the August 1, 1988, Council meeting. OLD BUSINESS __ I. STATUS RE, ..r - JWA/CRAS/ASC Update on the John Wayne Airport Noise Monitoring Program, Coalition for a Responsible Airport Solution (CRAS) and Airport Site Coalition (ASC). Recommendation:.- Receive and file as recommended by the Community Development Department. 2. EMERGENCY SERVICES PLAN In November, 1987, the City Council decided to develop a Multi- Hazard Functional Plan (MHFP) with in-house staff assisted by the State Office of Emergency Services (OES) utilizing a method of exercise planning desktop seminars. Recommendation: Adopt the "Exercise Planning Program" as the City's program for writing the initial draft of a Multi-Hazard Functional Plan and staff training for disaster response as recommended by the Public Works Department/Engineering Division. IX. NEW BUSINESS 1. TENANT IMPROVEMENTS AT 650 EL CAIqINO REAL The City Council, at their regular meeting on August 1, 1988, requested the possible waiver of building permit penalty fees for the tenant improvement work for SAX of Tustin at 650 E1 Camino Real be agendized for Council discussion. Recommendation: Pleasure of the City Council. 2. PARKS AND RECREATION COI~qISSION A.~POINTHENTS The City Council interviewed Commission candidates on August 2, 1988. At that n~eting, Councilmembers indicated appointments would be made at the Council meeting of August 15, 1988. Recommendation: Pleasure of the City Council. 3. SB 821 BICYCLE/PEDESTRIAN FACILITIES, PROJECT A. DpLICATION FOR FISCAL YEAR 1988-89 An allocation of $14,580 will be available to the City in FY 88-89 under the SB 821 Program for bicycle or pedestrian facilities. Recommendation: That the City Council adopt the following Resolution No. 88-95 as recommended by the Public Works Depart- ment/Engineering Division: RESOLUTION NO. 843-95 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, ORANGE COUNTY, CALIFORNIA, APPROVING THE APPLICATION FOR BICYCLE AND/OR PEDESTRIAN FUNDS UNDER SB 821 CITY COUNCIL AGENDA PAGE 4 AUGUST 15, 1988 DENSITY BONUS POLICY~ Staff haS~ .en contacted by a developer whu. proposes to construct an apartment project in the City for which he intends to request a 25% density bonus, with 25% of the normally allowed units being set aside for low or moderate income residents. RESOLUTION NO. 88-92 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING A DENSITY BONUS POLICY FOR THE CITY TO COMPLY WITH CHAPTER 4.3, SECTIONS 65915-65918, OF THE STATE PLANNING AND ZONING LAW 5. AW~U) OF BIO FOR JAMBOREE ROAD BETWEEN TUSTIN R~UtCH ROAD AND CHAPMAN AVENUE (RELOCATED) On July 5, 1988, the City Council authorized the advertisement of bids for the grading and storm drain installation for Jamboree Road between Tustin Ranch Road and Chapman Avenue (relocated). Recommendation: Will be made in the supplemental staff report to be delivered to City Council on August 12, 1988, after the bid project opening. 6. CULTURAL RESOURCES ABVISORY CO~ITTEE In conjunction with the recent adoption of the Cultural Resources District, a Cultural Resources Advisory Committee was created by the City Council and staff was appropriately asked to advertise for future appointments to the Committee. Recommendation: Pleasure of the City Council. 7. PLANNING CO~ISSION VACANCY Mr. Charles Puckett has resigned from the Planning Commission as required by City ordinance since he has filed as a candidate for the 1988 City Council election. Recommendation: Pleasure of the City Council. 8. TELEVISED CITY COUNCIL ~ETINGS ON CABLEVISION Councilman Kelly requested agendizing this item. Recommendation: Pleasure of the City Council. 9. PLANNXNG l...,ISSION ACTION AGENDA- AUGUST ~, 1988 All actions of the Planning Commission become final unless appeal ed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Act'ion Agenda of August 8, 1988. 2. BINGO GAMES AT TUSTIN AREA SENIOR CENTER Councilman Kelly asked staff to research the Tustin City Code regarding bingo games in order to determine whether the Senior Center would be eligible to apply for a license to conduct same. Recommendation: Receive and file subject report as recommended by the Administrative Services Department. 3. GRAFFITI REMOVAL Councilman Prescott has requested that the City Council discuss the City's graffiti removal program. Recommendation: Pleasure of the City Council. i i i XI. OTHER BUSINESS 1.
