REGULAR MEETING 0F THE
TUSTIN CITY COUNCIL
January 7, 1963
Meeting called to order at 7:30 P.M. by Mayor Doney.
Present: Doney, Klingelhofer, Mack, Sheridan, Humeston

Moved by Councilman Mack, seconded by Councilman Sheridan that
theMinures of beeember 17, 1962, ~be approved as mailed. '~arried.
Moved by Vouncilman Mack, seconded by Councilman Klingelhofer
Ord. 195 that Ordinance No. 195, ~"An Ordinance of the City of Tustin,
Zoning ~alifornia, modifying and amending the Zoni~ Map of the City
of Tustin, be rezoning the property of Santa Ana Development
~ Company to the P.D. Zone, have second reading by title only.
~ Motion carried unan~imously.
Moved by Counc'.n~man ~Mack, Seconded by ~Councilman Klingelhofer
th~ Ordinance No. 195 be passed an~d adopted. Carried by
roll call, all Councilmen voting Aye..
Res. 631 Moved by Councilman Mack, seconded by Councilman Sheridan that
J.L. McBride Resolution No. 631, a 'Resolution expressing the gratitude of
. the City ~or the ~ervices of City E~gineer, J. L. McBride, be
read in its entirety .for adoption. Motion carried u~animously
by roll call.
Moved by Councilman Sheridan, seconded by Councilm~n Humeston
--- that Resolution No. 631 be adopted. Motion carried by roll
call.
Reports of Departments:
Mr. Doney reported successful action of having contractors
finish work on time for Sewer District.
Report fror~ Committee on Animal Hospital, Appeal Hearing UP62-126
Animal given by Dr. K~ngol~i~', ~g~d.~.~ ~ _~ ~ntario ~o study
Hospital existing conditions in similar hospital operated by a Mr. Beck .
Investigation showed no complaints having been issued against
the type of operation in question. Committee comorised of
Dr. Klingelhofer, Gerald Mack and Benjamin Wheelo~k, submitted
their recom'~endations.
Moved b Councilman Klingelhofer, seconded by Councilman Mack
that findings of Cor~dt~ee be accepted and official decision by
Planning Commission on Conditional Use Pemit be upheld, with
the following additional recommendations being added.
1. The complete enclosure of all businessoperations
within an enclosed b~ilding.
2. The building being adequately soundproofed and
air conditioned so that there will be no emission
of odor or noise that would be detrimental ~o
"' adjacent property.
3- The operation of said facility to be restricted to
household pets.
4. The exclusion of ordinanry kennel operations consisting
of boarding, training, breeding or grooming, provided
~owever, that breeding and grooming may ~e permitted
on~y wheh incidental to the principal use.
Councilmen voting by roll call: Nee: Humeston, Sheridan,
Ayes: Klingelhofer, Mack, Doney disqualified due to
absence ~t previous meeting. , ,
Due to a deadloqk in voting, it was suggested that a meeting
between committee members and other .interested parties be held .
Moved by Counc43man Humeston, seconded by
Councilman Mack, that all interested parties and
Committee meet in joint session, Tuesday, the 15th
of January, and that decision of Council be delayed
until next meeting of Ja'nuary 21st at which time
recommendations will be given to Council. Motion
carried unanimously by roll call.
Motion by Councilman Mack, seconded by Councilman
Sheridan that due to illness, ISmyth Bros. Zone
Smyth Bros Change Hearing be postponed to January 21st. Motion
postponed carried by roll call, all councilman voting Aye.
Res. 632 Moved by Councilman Mack, seconded by Councilman
appointing Humeston that Resolution No. 632, a Resolution
Carlsen appointing and designating Jack Carlsen as City
City Eng. Engineer, be read in its entirety. Motion carried
Moved by CouncLlman Humeston, seconded by Councilman
Mack that Resolmtion No. 632 be adopted. Motion
carried by roll call, all councilmen voting Aye.
Correspondence:
Letter from Mr. Allan K. Jonas, to Colonel Williamson,
Correspondence requesting permission to use City of Tustin Ordinance
on Continuity of Government. Mr. Doney gave per-
mission to Mr. Jonas and instrueted letter so stating
be mailed,
Clarification given to ~r~-qStafford on Business
License covering vending machines.- Mr. Doney
explained that misunderstandin~ was probably due
to proff-error in printing.
Moved by Mr. Sheridan, seconded by Mr. Humeston that
a Resolution be adopted authorizing the Transfer of
$3,700.00 fro~ Reserve to Civil Defense Capital
Outlay. Motion carried by roll call all Councilmen
voting Aye.
Moved by Councilman Mack, seconded by Councilman
Humeston that letter recommending appointment of
Morgan Hi~tton as Fire Chief be filed, as Mr. Hilton
was already serving in that capacity. Motion
carried~ uranlmously.
Moved by Councilman Sheridan, seconded by Councilman
Humeston that recommendations appointing H. Louis
Hanson and Harold Fertig as Assistant Fire Chiefs
be ratified and recommendation Tiled. Motion
carried unanimously.
Moved by Councilman Mack, seconded bv Councilman
Crecion Sheridan that Dance Permit for John Crecion, owner
dance permit of Gunner' s Ranch House, 155 S. "D" Street,
Tustin, be approved, subject to clearance by Fire
Chief and Police Chief. Motion carried' unanimously.
Moved by Councilman Sheridan, seconded b,
refund Councilman Mack that reques~ of Richard Sokel for
Sokol refund on Business License due to error in issuing
be refunded, providing it be paid to St. Cecilia's
Church and be so indicated and stipulated on check.
Motion carried by roll' call, all councilmen voting

Moved by Councilman Sheridan, seconded by Councilman
Mack that letter from Vincent Meek, owner of Meek
Trailer Park and Petition of Protest on raise of
Business License fee, which was signed by some 27
business owners, read by Acting City Clerk and ordered
received andpassed to ~usti~ss License Committee
for study session on -January 9th, Motion carried
by roll call, all councilmen voting Aye.

Klingelhofer that Resolution No, 633, be adopted, Motion

Moved by Councilman Sheridan, seconded by Councilman Mack
R.R. Crossing that recom!rAendation from City Engineer be accepted and that
Gwyneth Dr, City Clerk and City Attorney be authorized to petition
Public Utilities Commission for crossing a~IGwyneth Drive ,
Motion carried by roll call, all Councilmen voting Aye,
Miss Onalee Elliott of 13631 ~orba Street spoke before the
Council regarding conditions of streets by her residence
and was assured by Mayor Doney that conditions would
improve by the time construction was completed,
Moved by Councilman Sheridan, sec ~nded by Councilman Mack
Bills that bills totaling the sum of $13,186,65 be paid, Motion
carried unanimously,
