December 17, 1962

Meeting called to order a~ 7:30 P,M.
, Moved by Councilman Mack, seconded by Councilman Humeaton
that Minutes of December ll, 19.62 ~ be approved as presented
with corrections made as per city attorney, to read:

there being no protest received and no further correspondence
or comments, the Protest Hearing on "Newport Avenue
Annexation to the City~ of Tastin" be continued to February
ll, 1963 at 7:00 P,M, in the Council Chambers, 145 West
Third Street, Tustin, Calif. Motion carried by roll call
all Councilmen voting Aye,
Moved by C'o~ncilman Klingelhofer, seconded by Councilman
Mack, that the City Attorney draft a Resolution of Merit,
Res. of commending City Engineer, J. L. McBride, for his long
Merit years of service, and said Resolution be adopted and
McBride presented to his wife, Mrs. Ella McBride. Motion carried.
Moved by Councilman Humeaton, seconded by Councilman
Klingelhofer tha~t Me~ Jack Carlse~ be appointed City
Carlson Engineer for a probationary period of six months, subject
Contract to contract being drawn up with Mr. Ca~lson,I per recom-
mendations of Committee. Motion carried by roll call,
all councilmen present voting Aye.
Appeal Hearing opened at 7:42 P.M. on Royal Tow Service~
Variance Variance No. 62-120 to consider the appeal of the Pacific
62-120 Eheaters Devel.opment .regarding the decision of the
appeal Tustin Planning Commission granting permission of auto
storage lot, Review on previous variance information read
by acting City Clerk.
Speaking in favor of Planning Commission decision were:

There being no further comments, hearing declared closed
at 8:02 P.M.
Moved by Mr. Humeston, seconded by Mr. Mack that decision
of Tustin Planning Commission regarding Variance No. 62-120
Var. 62-120 Royal Tow Service be reversed. Motion carried by roll call

Appeal Hearing opened at 8:19 P.M. on Hornbeak Variance No .

There being no further correspondence or remarks, appeal

Moved by Councilman Mack, seconded by Councilman
Klingelhofer that the Council modify decision of
Planning Comm. ission ruling reEarding Variance No.
Var. 62-123 62-123 ~o the effect that they would delete ao
portion of =6' wall as specified by applicant, to eliminate
requirement of a fence or wall alo~ S,W. line of
proper~y, within 136' of .C/L Newport Avenue.

Appeal Hearing opened at 8:40 P.M. on George A. Williams,
Appeal Hearing Application No. 62-126, to permit an animal hospital
UP62-126 with stipulations as in Resolution No. 609. Review on
previous Use Permit Application read by Acting City Clerk.
Correspondence received from Jess N. Stafford, John A.
Seigel, opposing No. 62-126, and petition of 20 signatures
opposing, read by Deputy City Clerk.
Speaking in favor were: John Cochran, attorney
representing Mr. Willjams a~d Mr. Tubbs.
Letter from Mr. Morris, member of Plarmi~ Commission,
clarifying ~is position, received and read by Deputy
.City ~lerk. :
There being no further comments or correspondence, Appeal
Hearing declared closed at 9:35 P.M.
Moved by Councilman Klingelhofer, seconded by Councilman
Mack that action on the-Appeal Hearing of UP62-126, be
deferred until next regular Council Meeting of January
7, 1983, and that a, committee he appointed comprised
of Dr. Klingelhofer, Mr. Mack and Mr. Wheelock, with
the request that ..they study the soundproofing, sanitation
air.conditioning and any other problem involved, and
report back to' the Council at the meeting of January
7,. 1963. Motion carrie~ by roll call, all councilmen
present voting Aye.
Mayor pro tern Sheridan ordered a 5 minute recess at

Hearing .on Zone Change 62-108 application of Stuts~an-
ZC 62-108 Housley to permit a zone' change-from "U" zone to R-3,
for property Northerly of. Walnut A~enue and Easterly
Stutsman of Newport Avenue, Tustin, opened at 10:12 P.M.
Acting City Clerk read recom~endations from Planning
Commission.
Letter from Allen W. Stutsman and Ruth E. S. Housley
read by Acting City Clerk.
Mr. Lev, attorney for Stutsman-Housley spoke in favor
of zone change.
Mr. E, ivsay of 1257 Newport Ave, registered a protest on
zone change a; ;ication No. 62~108 to R-3.
Moved by Councilman Humeston, seconded ~ CounciLman
Klingelhofer that there being no further protests or
comments anch no objections to a withdrawal that'
Stutsman-Hous~ey be granted permission to withdraw
their application No. 62-108 for a zone change to R-3.
Motion carried unanimously by roll call, all councilmen
present voting Aye. Hearing declared closed at 10: 55.

th~ the recommendations of Fire Chief and Engineering
Driveways De~ar~f~mt subject to driveways be referred to Tustin
Manning Commission at January 14, 1963 meeti~ for study

Moved b~ Councilman MaC~, seconded by Councilman Klingelhofer
Dec. 24th that the Proclamation by the Mayor be ratified - proclamation
Holiday declaring December 24th a Holiday and that only emergency
facilities for the City be in operation. Motion carried
by roll call, all councilmen present voting Aye.
Moved by Councilman Mack, seconded by Councilman Klingelhofer
that the emergency personnel, required ~o work on December
24th,. which was declared a Holiday by the Mayor, be given a
compensating day cr ~time off, at the discretion of their
respective department heads..

that correspondence be filed, Motion carried.

Signal requesting the County of Orange to include within the
Laguna Rd. arterial Highway Financing Program the Signalization of

that Resolution No. 629, be passed and adopted. Motion

Mack that Tract Map No. 4854 ~e approved subjec~ to clarif-
Tract 4854 ication of water lines and fire hydrants for meintenance and
continuity thereof, to the satisfaction of the City Engineer
City Attorney and Fire Department. Motion carried by
roll call, all councilmen prese~ voting Aye.
Moved by Councilman Klingelhofer, seconded by Councilman Mack
Res. 630 that Resolution No. 630, "A Resolution authorizing and
directi~ the execution Of a declaration of Covenants,
Res. 630 Conditions and Restrictions upon Tract No. 4854" be read
Tract 4854 by title only. Motion carried unanLmously~
Moved by Councilman Mack, seconded by Councilman Klingelhofer
that Resolution No. ~630 be passed and adopted. Motion
carried by roll call, all councilmen present voting
unanimously.

carried unanimously.
