· 3. On November 24, 1986, DONALD L. FIFE, II, while a
pedestrian on the Santa Clara Avenue overpass over State Route 55
(~Newport/Costa MeSa Freeway"), was struck by an automobile driven
by Lynda Elizabeth Woelke, received personal injuries, suffered
for a period of time, and died; and a further proximate cause of
the said injuries and death was the neEli§ent desiEn, construction

and maintenance of the bridge~ overpa~s, roadway, sidewalk,
street-lighting, signs, speed-limit determination, speed-limit
enforcement, area and location of the accident, as above-stated,
which said design, construction, maintenance, determinations and
enforcement were the sole or joint responsibility of the CITY OF
TUSTIN its a~ents, and others.
4. The Deceased, DONALD L. FIFE, II, was the son of claimant
DONALD L. FIFE: the Deceased, DONALD L. FIFE, II, was the natural
brother of claimant JILL KATHERINE FIFE; the Deceased, DONALD L.
FIFE, II, was the half-brother of claimant EDWARD WHITE; the
Deceased, DONALD L. FIFE, II, was the half-brother of claimant
LOKI THIBODEAU: the Deceased, DONALD L. FIFE, II, was the Erandson
of claimant ESTHER E. FIFE; and the Deceased DONALD L. FIFE, II
was the 8randson of claimants LLOYD and VERA BARNETT.-

5. So far as is now known to claimants or to claimants'
attorney 'Robert A. Sanregret at the date of filin~ this claim, ~s
hereinafter stated, claimants have incurred damaEes in :he amount

6. Claimants are ignorant of those agents, employees, or
representatives' and of their names and capacities, which may be
also involved with re~ard to t~ese claims, and therefore claimants
include the same in these claims as DOES 1 through 50, inclusive,
and claimants will amend these claims to provide for the true
names and capacities when the same have been finally determined.
7. Claimants each claim punitive and exemplary damages
against said public entity for the outrageous conduct and neglect,
and for the gross and wanton disregard for public safety in the
intentional and in the grossly and wantonly negligent failure and
refusal of said public entity to design, construct and maintain
the bridge, overpass, roadway, sidewalk, street-lighting, signs,
speed-limit enforcement area location determination, area and
location of the accident, as above-stated; and, therefore, each
claimant claims S500,000 punitive damages from said public entity.

said public entity should be assessed punitive or exemplary
damages paid to each claimant in the amount of S500,000 for the
'reasons set out herein, for the intentional, wanton and grossly
neglectful nature of their acts and omissions, and for their
outrageous disregard for public safety,...as set out herein.
