FIFE, II, while a pedestrian on the Santa Clara Avenue overpass over State Route 55 (~Newport/Costa MeSa Freeway"), was struck by an automobile driven by Lynda Elizabeth Woelke, received personal injuries, suffered for a period of time, and died; and a further proximate cause of the said injuries and death was the neEli§ent desiEn, construction 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20~ 21 22 23 24 25 26 27 28 and maintenance of the bridge~ overpa~s, roadway, sidewalk, street-lighting, signs, speed-limit determination, speed-limit enforcement, area and location of the accident, as above-stated, which said design, construction, maintenance, determinations and enforcement were the sole or joint responsibility of the CITY OF TUSTIN its a~ents, and others. 4.
