HomeMy WebLinkAboutCC 9 VACATE SAN JUAN 09-19-88TO: FROM: WILLIAM HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: RESOLUTION OF INTENTION TO VACATE AND ABANDON A PORTION OF SAN JUAN STREET BETWEEN ORANGE STREET AND CHARLOMA DRIVE RECOMMENDATION: That the City Council adopt a resolution of intention to vacate a portion of San Juan street between Orange Street and Charloma Drive and set the public hearing for October 17, 1988. BACKGROUND: Caltrans is negotiating with the Tustin Unified School District to acquire land for the relocation of E1 Camino Real farther into the Tustin High School site. This is required because of the proposed widening of the I-5 Freeway. The school site would lose about three acres of land which would reduce the school site to approximately 24 cres. School officials countered Caltrans' proposalwith a suggestion ~hat the possibility of closing a portion of San Juan Street be pursued. This would allow the high.school site to be"physicallY joined with the Lambert School site which is about 10 acres in size. Caltrans provided the City with funds for preparation of a San Juan Street closure traffic analysis which was prepared by the consulting firm of Austin-Foust Associates, Inc. The traffic study shows the impacts of the closure and will be a part of the negative declaration to be prepared for this proposal. Details of this study have been provided to City Council in previous staff reports. Caltrans and the School District have requested that proceedings be initiated for the street vacation. The Planning Commission at their meeting of September 12, 1988 adopted a resolution finding that the proposed vacation is in conformance with the adopted General Plan. This finding was based on San Juan Street being classified as a local street and not part of the circulation element of the General Plan. ANALYSIS: The resolution of intention sets the public hearing on the matter for October 17. Notice of the hearing will be published and posted along the street in conformance with legal requirements. In addition, staff intends to mail notices to residents in a rather large area so that persons affected by the proposal will be aware of it. . summary of the traffic report and staff recommendations for cul-de-sacs at the ends of San Juan Street will be provided for the October 17th hearing. The traffic consultant who prepared the traffic report will also be requested to attend the hearing. RESOLUTION OF INTENTION TO VACATE September 14, 1988 Page 2. The City Council can attach certain conditions to the vacation, if they decide to approve it, and the City Attorney will'be able to advise in this area. Staff has included in the resolution of intention a clause reserving the entire street width for public utility purposes. Engineering S~ice.s Manager 1 2 3 4 5 6 7 8 9 10 11 12 13 li 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 88-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING ITS INTENTION TO VACATE AND ABANDON A PORTION OF SAN JUAN STREET BETWEEN ORANGE STREET AND CHARLOMA DRIVE WHEREAS, the California Department of Transportation is negotiating to acquire land from the Tustin High School site for widening the I-5 Freeway and relocating E1 Camino Real; and WHEREAS, the Tustin Unified School District has requested the City of Tustin to vacate a portion of San Juan Street in order to connect the former Lambert School site to the Tustin High School site, thus providing better site utilization; and WHEREAS, the City of Tustin Planning Commission adopted Resolution No. 2526 on September 12, 1988 finding that the proposed vacation is in ~onformance with the adopted general plan. NOW, THEREFORE, the City Council of the city of Tustin does hereby resolve as follows: 1. Declares its intention to vacate a portion of San Juan Street between Orange Street and Charloma Drive as shown on a map entitled EXHIBIT "A" attached hereto and by reference made a part hereof. 2. That the entire area to be vacated shall be retained as an easement for public utility facilities per Section 8340 of the California Streets and Highways Code. 3. That a public hearing is hereby set for Monday, October 17, 1988 at 7:00 P.M. in the Council Chambers of City Hall, 300 Centennial Way, Tustin, California 92680, for hearing all persons interested in the proposed vacation. 4. This resolution shall be published in the Tustin News, a newspaper of general circulation in the City of Tustin, for two successive weeks prior to the hearing. 5. That notice of vacation shall be posted along the street proposed to be vacated. The notices shall be not more than 300 feet apart, but at least three notices shall be posted. The notices shall state the day, hour and place of the hearing and shall refer to the adoption of this resolution of intention. ! $ 5 $ ? $ 10 17 20 27 6. That these proceedings are being conducted under C~apter 3, Pa~t 3, Division 9 (Section 8320, et.seq.) of the California Streets and Highways Code.
