CALL ~ ORDER The meeting was called to order by Chairman Hoesterey at 9:07. p.m, in the City Council Chambers, 300 Centennial Way, Tustin, California. 2. ROLL CALL Agency Members Present' Ronald B. APPROVAL OF MINUTES - AUGUST 15, 1988, REGULA. R MEETING 0 It was moved b), Kenned),, seconded by Ed~.lar, to approve the minutes of- August 15, 1988. The motion carrqed 5-0. APPROVAL OF DENANDS IN THE ANOUNT OF $13,515.62 -. · · It was moved bjF ..KennedjF.i, second,id by Edg~r, to approve subject demands in the amount of $13,515.62. The motion carried 5-0. MINUTES OF CLOSED SESSIONS Councilman Prescott wanted to have an Ordinance for the Redevelopment Agency on this matter. James Rourke, City Attorney, clarified that the Redevelopment Agency does not have ordinance adopting power, only resolution adopting power. It was moved bi/ Kennedy., seconded by Prescott, to adopt the following- RESOLUTION NO. RDA 88-12- A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN RELATIVE TO MINUTES OF CLOSED SESSIONS OF THE AGENCY . The motion carried 5-0. EXCLUSIVE AGREEMENT TO NEGOTIATE WITH OtA~MPION DEVELOPMENT COMPANY, SOUTHEAST CORNER OF MAIN STREET AND NEWPORT AVENUE It was moved bi/ Edgar, seconded bi/ Kennedj/, to approve the Exclusive Agreement to Negotiate with Champion Development Company. Councilman Kelly asked if anyone from the Council had met with Champion Development Company. The response was a unanimous no. Councilman Prescott encouraged the Champion Development Company to work closely with the city staff and the property owners in question to arrive at an amenable conclusion. He did not want his "yes" vote to mean he would vote to condemn the properties of those who did not want to sell. The motion carried 5-0. Councilman Prescott stated that his comments made regarding Item No. 6 would also stand for Item No. 7. The motion carried 5-0. 8. OTHER BUSINESS- None 9. CLOSED SESS ION Chairman Hoesterey announced the Redevelopment Agency would recess to the fol 1 Dwi ng: Closed Session of the Redevelopment Agency pursuant to Government Code Section 54956.9(a) to confer with the City Manager and City Attorney regarding pending litigation which has been initiated formally and to which the City is a party. The title of the litigation is Tustin Community Redevelopment Agency v. Little Caesar Enterprises, et al. Case No. 46-02-70, Orange County Superior Court. 10.
