TUSTIN CITY COUNCIL
October 2, 1962
Meeting called to order ate7:30 P.M. by Mayor Doney.
Present: Doney, Humeaton, Sheridan, Mack
Absent: Klingelhofer
City Attorney Rourke, present
City Engineer McBride, present
Hearing on Resolution of Intention No. 615
inthe matter of Tustin City Sewer Assessment
District No. 1, opened at 7:30 P.M.
"MINUTES FOR HEARING ON RESOLUTION OF
INTENTION NO. 615 - IN THE MATTER OF
TUSTIN CITY SEWER ASSESSMENT DISTRICT
NO.1
October 2, 1962
7:30 o'clock p.m.
The Clerk reported that this was the time
and place fixed for the hearing of protests or
objections against the work or the District, as
described in Resolution of Intention No. 615,
in the matter of the construction of sanitary
sewers and appurtenant work in "TUSTIN CITY
SEWER ASSESSMENT DISTRICT NO. 1" as described
in said resolution.
The City Clerk also reported that affidavits
in support of the publication of the Resolution
of intention, the mailing of printed notices of
the adoption of said resolution, and the posting
of the Notice of Improvement, as required by law,
had been made and are on file in the office of
the City Clerk. The Mayor then inquired of the
Clerk if any written protests or objections
against the work or the District had been filed
w~th her in said matter. The Clerk reported that
six (6) written protests had been filed with her
prior to the time set for the hearing by the
following:
1. W.L. Tadlock, 135 Myrtle Ave.
2. County of Orange
3. Donald L. and Donnetta M. Martenson,
465 West Second Street
4. L. Bohen by Sid~Bohen, 135 South A St.
5. Charles Walker 14142 Del Amo Ave.
6. Mrs. Clifford ~cKinley, 145 Pasadena Ave.
Mrs. Clifford McKinley filed a withdrawal
'letter covering her protest before the time of
hearing. All of said written protests were then
read in full.
The Mayor then announced that this was the
time and place set for the hearing of protests
or objections against the work or the District,
each as set forth in the Resolution of intention
hereinbefore mentioned, and asked if anyone
present desired to be heard in said matter.
Certain of the parties who had filed
.written protests werein the audience and
they spoke orally, and.~her persons in the
audience also spoke making inquiries con-
cerning various matters in connection with
the proposed work, which questions were
answered by the Council, the attorneys for
the City and the Engineer.

ASter all p~otests and objections had
been made, it was moved by Councilman Mack -
and seconded by Councilman Sheridan and un-
animously carried by the rollscall vote of
all Councilmen present, that all protests
be referred to the City Engineer for check-
ing and report as to the percentage of the
area represented thereby. The Mayor, with
the consent of the Council, declared the
Council meeting recesSedto await the report

of ~he ity Engineer.
The Cit Engineer, together with the
Engineer of ~ork, thereafter reappeared in
the Council Chambers and the Council decIared
the recess ended and the meeting back in
session. The City EnEineer s~d the Engineer
of Work then advised the Council that they
had.checked all of the written objections and
one per cent of the total area of the
assessment district.
All protestants having been heard and
an opportunity having been given to all
persons desiring to be heard, and a full,
fair and impartial hearing having been
granted, and the City Council having before
it~a diagram of the Assessment District and
being familiar with the assessment district
and also having considered all protests filed,
and having considered the matter as to the area
· of the property represented by all protestants,
Councilman Humeston presented the following re-
solution and moved its adoption:
WHEREAS, certain protests have been filed
by W. L. Tadlock°and others, protesting against
the doing of the work and improvement described
in Resolution of Intention No. 615, or against
the assessment distri. ct therein described; and
WHEREAS, the Cit~ Councilhas carefully
considered all protests or objections and having
considered the area.o~ the district represented
by said protests;
NOW, THEREFORE, BE ZT RESOLVED by this City
Council, that it does hereby find and determine
that the said protest~ or objections have been
made by ~he owners of legs than one-half of the
~rea of the propert~ to ~e assessed for said
work and improvement, as set forth in said
Resolution of IntentioH No. 615; and
BE IT FURTHER RESOLVED that each and all
of the said protests or objections be and they
hereby are overruled and denied.
Said motion was seconded by Councilman
Mack and carried by the following roll call

Mack;
NOES; Councilmen - None;
ABSENT: Councilmen - Klingelhofer. ·
Hearing declared closed a~ 8:30 P.M.
Moved by Mr. Sheridan, seconded by Mr. Humeston
that the City Engineer and Engineer of Work be
ordered to prepare modifications for relocating
of certain sewers and Attorneys to prepare pro-
ceedings. Motion carried unanimously.
Moved by Mr. Sheridan, seconded by Mr. Mack that
meeting be adjourned. Motion carried.
