SUSPECT: REQUEST FOR NO "LITTERING SIGNS" ON PROSPECT AVENUE

Pleasure of the City Council.
BACKGROUND:
At their meeting of October 6, 1988, the City Council requested the
placement of "No Littering" signs on Prospect Avenue southerly of First
Street. It was indicated that litter has been accumulating from
individuals that eat lunch in their vehicles and discard the litter
into the street.
Section 4421 of the Tustin City Code entitled "Litter" states the
following:
No person shall throw, throw out, drop, deposit, place or
leave any litter, garbage, refuse or rubbish in, on, or upon
any public street, sidewalk, parkway, park or other public
place, any vacant lot, or any private property other than
in a receptacle maintained for trash.
California Vehicle Code (CVC) Section No. 23112 also prohibits the
littering of any highway and additionally provides for mandatory fines
up to $1000.00 under CVC Section 42001.7.
DISCUSSION:
Staff is requesting a clarification as to what type of sign the City
Council desires to have posted along Prospect Avenue. One type would
merely state "No Littering" with black letters on a white background.
This could imply that the City would not enforce Section 42001.7 of the
CVC pertaining to fines. The second type of signing would state "$1000
Fine for Littering" with black letters on a white background.
In the event any of the above-mentioned signs are posted, it is
suggested that they be posted for the entire length of Prospect Avenue
on both sides, between First and Main streets.
