AUTHORIZATION TO ADVERTISE FOR BIDS FOR THE RECONSTRUCTION OF MAIN ST.
FROM 'C' ST. TO PACIFIC (OCU'I-I' PROJECT PHASE I AND II)
RECOMMENDATION:

It is recommended that the City Council, at their meeting of May 4, 1987, approve
the following:
1. Resolution approving the plans and specifications and authorizing
advertisement for bids.
2. Appropriation of $44,919 from General Fund Reserve to provide needed
project funding for increased scope of work.
BACKGROUND:
This project includes the replacement of deteriorated pavement, new curb a~d
gutter, wheelchair ramps and drive aprons on Main St. from "C" St. to Pacific, as
well as new sidewalk and catch basin improvements on the northerly side of Main
St. between Myrtle Ave. and the Costa Mesa Freeway. Funding has been previously
allocated.
In addition, it is recommended that the City Council authorize additional funds to
provide for the construction of new sidewalks on Main St. from "B" St. to Pacific.
It will also be necessary to construct approximately 280 feet of new storm drain
between "A" and "B" Street to accommodate the change in grade for new curb and
gutter that is required to alleviate the poor drainage condition that currently
exists.
In conjunction with this Project, street light conduit will be installed for the
new decorative type lighting fixtures which have been requested for Main St. This
contract will include only the installation of the conduit. The street lights
themselves will be installed by the Edison Co. once the specific type of fixture
is decided upon. Since the cost will depend on the type of fixture chosen,
funding for. the lights will have to be budgeted at a later time (estimated at an
additional $12,000 to $15,000).
The engineer's estimate for this project is $374,971. A breakdown of amounts
currently budgeted and requirement for additional funds i's as follows:

This estimate is as accurate as possible based on our past experience with similar
types of projects. The actual contract award price may vary somewhat depending on
the cost of the individual bid items, materials availability, and the general
economic climate in the construction industry.

CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR
RECONSTRUCTION OF MAIN ST. FROM "C" ST. TO PACIFIC
AND AUTHORIZING ADVERTISEMENT FOR BIDS

WHEREAS, it is the intention of the City Council of the City of Tustin,

WHEREAS, the City Engineer has presented plans and specifications for
the construction of said work;
NOW THEREFORE, BE IT RESOLVED that the plans and specifications
by the City Engineer be and are hereby approved as the plans and
speci ficatidns for:
Reconstruction of Main Street from "C" Street to Pacific
(OCUTT Project Phase I and II)
17 BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and
directed to advertise as required by law for the receipt of sealed bids or
18 proposals for the doing of the work specified in the aforesaid plans and
specifications which said advertisement shall be substantially in the
19: form as the attached NOTICE TO CONTRACTORS, entitled Exhibit "A" and made a
part hereof.
PASSED AND ADOPTED at a regular meeting of the City Council of the City

The foregoing quantities are approximate only being given as a basis for
the comparison of bids, and the City of Tustin does not, expressly or by
implication, agree that the actual amount of work will correspond therewith, but
reserves the right to increase or decrease the amount of any class or portion of
the work or to omit portions of the work as may be deemed necessary or advisable
by the Engineer.
Plans, specifications and proposal forms to be used for bidding on this
project can only be obtained by prospective bidders at the office of the City
Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California 92680, upon
payment of $10.00 per set, or will be mailed out upon payment of $15.00 per set,
which amounts are not refundable.

In conformance with Section 37931 of the Government Code, all bids shall be
presented under sealed cover on the proposal form provided and accompanied by
bidder's security in the form of cash, cashier's check, certified check or bid
bond execu'ted by an accredited surety.
The security shall be for an amount no less than 1~)% of the amount of the
bid. A bid shall not be considered unless one of 'the forms of bidder's
security is enclosed therewith.
A Security Bond for payment of labor and materials will be required in the
amount of (50%) of the estimated total contract price and a Faithful Performance
Bond in the amount of one hundred percent (100%) of the estimated total contract
p. rice in the form attached to the contract documents. Said bonds shall be
issued by a surety company rated Grade A or better and Class IV or better by the
latest edition of Best's Key Rating Guide.
City of Tustin reserves the right to reject any or all bids, and/or to
waive any informality on a bid. No bidder may withdraw his bid for a period
of thirty (30) days after the date set for the opening thereof. Prior to bid
opening, bidder may withdraw his bid. Bids received after the bid opening time
and date herein will be returned to bidder unopened.
Pursuant to California Government Code Section 4590, the contractor will be
entitled to post approved securities with the City or an approved financial
institution in order to have the City release funds retained by the City to
insure performance of the contract.
Prior to contract award, the successful bidder shall possess a valid State
of California Contractor's License in the classification of either A or C12.
The City Council of the City of Tustin has obtained from the Director of
Industrial Relations the general prevailing rate of per diem wages and the
general prevailing rate for legal holiday and overtime work in the locality in
which the work is to be performed for each craft or type of work needed and a
copy of the same is on file in the office of the City Clerk
Not less than said prevailing rates shall be paid to workers emloyed on
this public works contract as required by Labor Code Sections 1771 and 1774 of
the State of California.
