'~'~"-'-- I I=FI~.M: StJ.BJECT: WILLIAM HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/~GZNEERZNG DIVISION AUTHORIZATION TO ADVERTISE FOR BIDS FOR MANUFACTURE AND DELIVERY OF REINFORCED CONCRETE PIPE FOR TUSTIN RANCH PROJECT, A.D. NO. 85-1 RECOMMENDATION: For the City Council meeting of May 4, 1987. It is recommended that the City Council adopt a resolution approving plans and specifications and authorizing advertisement for bids. BACKGROUND: Plans will soon be completed for the following street projects in East Tustin to be constructed under Assessment District No. 85-1: Bryan Avenue, Browning to Jamboree Jamboree Road, I-5 Freeway to Irvine Boulevard Browning Avenue (E/S), Bryan to Irvine Boulevard · Irvine Boulevard (S/S), Browning to Jamboree Tustin Ranch Road, Bryan to Irvine Boulevard Myford Road, Bryan to Irvine Boulevard As there is a 10-12 week wait for delivery of storm drain pipe from time of order, it is proposed to bid the manufacture and delivery of the pipe for these street projects ahead of the bidding for the street and storm drain construction. This will accelerate the street construction schedule so that the overlap into the next rainy season will be shortened. The pipe ranges in size from 18" to 87" in diameter wi.th a total length of over 14,000 feet. The estimated cost for this contract is about $645,000 and will be paid out of assessment district bond financing. NO. 85-1, AND AUTHORIZING ADVERTISEMENT FOR BIDS WHEREAS, it is the intention of the City Council of the City of Tustin, California to contract for manufacture and delivery of reinforced concrete pipe for East Tustin Project, A.D. No. 85-1; and WHEREAS, the City Engineer has presented plans and specifications for accomplishing said work; NOW THEREFORE, BE IT RESOLVED that: 1. The plans and specifications presented by the City Engineer are hereby approved for manufacture and delivery of reinforced concrete pipe to Tustin Ranch Project, A.D. No. 85-1. 2. The City Clerk is hereby authorized and directed to advertise as required by law for the receipt of sealed bids or proposals for the doing of the work specified in the aforesaid specifications which said advertisement shall be substantially in the form as the attached NOTICE INVITING BIDS, entitled Exhibit "A" and made a part hereof. 3. In the event the pipe supplier does not complete the work within the time limit specified in the contract documents, liquidated damages shall be assessed in the amount of five hundred dollars ($500) for each calendar day beyond the time limit. 4. It is hereby found that the public interest will not be served by allowing the property owner to take the contract for performance of this work and therefore the property owner may not elect to take such a contract pursuant to Section 20485 of the Public Contracts Code. Plans, specifications and proposal forms to be used for bidding on this project can only be obtained by prospective bidders at the office of the City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California 92680, upon payment of $10.00 per set, or will be mailed out upon payment of $15.00 per set, which amounts are not refundable. All bids shall be presented under sealed cover on the proposal form provided and accompanied by bidder's security in the form of cash, cashier's check, certified check or bid bond executed by an accredited surety. The security shall be in an amount equal to at least ten percent (10%) of the amount of the bid. A bid shall not be considered unless one of the forms of bidder's security is enclosed therewith. A Security Bond for payment of labor and materials will be required in the amount of fifty percent (50%) of the estimated total contract price and a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total contract price in the form attached to the contract documents. Said bonds shall be issued by a surety company rated grade A or better and Class IV or better by the latest edition of Best's Key Rating Gui de. A-2 The City of Tustin reserves the right to reject any or all bids, and/or to waive any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. Prior to bid opening, bidder may withdraw his bid.
