APPEAL OF PLANNING COMMISSION DENIAL OF VARIANCE NO. 88-7 The Planning Commission, at their regular meeting on October 26, 1988, denied Variance 88-7, a request by Dr.' Sosin for authorization to install a 24 square foot, double-faced business identification pole sign approximately 12 feet in height for the the Headache Treatment Center, located at the northwest corner of Newport and Mitchell Avenues. Recommendation: Deny Variance 88-7 by adoption of the following Resolution No. 88-119 as recommended by the Community Development Department: RESOLUTION NO. 88-119 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DENYING THE APPEAL FOR VARIANCE NO. 88-7 FOR THEHEADACHE TREATMENT CENTER OF ORANGE COUNTY (DAVID E. RESOLUTION NO. 88-120 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING SURPLUS AND TRANSFERRING SURPLUS RADIO EQUIPMENT TO THE ORANGE COUNTY CHAPTER OF THE AMERICAN RED CROSS FOR USE IN CONNECTION WITH EMERGENCY SERVICES Adopt Resolution No. 88-120 declaring surplus radio equipment be transferred to the Orange County Chapter of the American Red · Cross for use in connection with emergency services as recommended by the Police Department. 7. DO)rATION OF ~UTOMOBILES TO THE TUSTIN ARE~ SENIOR CENTER FUND, INCORPORATED Accept two automobiles from Mr. Robert Voorhies as gifts on behalf of the Tustin Area Senior Center Fund; and to authorize staff to sell the automobiles at auction with the proceeds to be given to the Tustin Area Senior Center Fund, Inc. as recommended by the Community Services Department. TUSTIN RANCH ROAD/SJLNTA AB-A FREEWAY (I-$) INTERCHANGE COOPERATIVE RESOLUTION NO. 88-122 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR CONSTRUCTION OF IMPROVEMENTS FOR THE TUSTIN RANCH ROAD/SANTA ANA (I-5) FREEWAY INTERCHANGE AND AUTHORIZING ADVERTISEMENT OF BIDS Adopt Resolution No. 88-122 approving plans and specifications for the construction of improvements for the Tustin Ranch Road/SantaAna (I-5) Freeway interchange project as recommended '' by the Public Works Department/Engineering Division; and Approve the Tustin Ranch Road interchange cooperative agreement and authorize the Mayor to execute the said agreement as recommended by Public Works Department/Engineering Division. · CITY COUNCIL AGENDA PAGE 2 . -NOVEMBER 21, 1988 VI. 9. RESOLUTION ,,~. 88-123 - A RESOLUTION O5 £~.~ CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR ASSESSMENT DISTRICT 85-1 IMPROVEMENTS ON JAMBOREE ROAD FROM I-5 FREEWAY TO IRVINE BOULEVARD Adopt Resolution No. 88-123 accepting said wOrk and authorize the recordation of thenotice of completion as recommended by the ~ublic'Works Department/Engineering Division. 10. AGREEMENT WITH HUNSAKER & ASSOCIATES IRVINE FOR PROFESSIONAL SERVICES FOR CONSTRUCTION OF TUSTIN RANCH ROAD, PORTOLA PARKWAY, LA COLINA DRIVE AND IRVINE BOULEVI%RD, AD NO. 86-2 Approve an agreement with Hunsaker & Associates Irvine, Inc. for construction surveying in the amount of $102,621.00 as recommended by the Public Works Department/Engineering Division. 11. AGREEMENT WITH THE KEITH COMPANIES FOR PROFESSIONAL SERVICES FOR IMPROVEMENT OF TUSTIN RANCH ROAD BETWEEN EDINGER AVENUE AND WALNUT Approve an agreement with the Keith Companies for preparation of preliminary design and project report, for improvement of Tustin Ranch Road between Edinger Avenue and Walnut Avenue in the amount of $25,029.00 as recommended by the Public Works Department/Engineering Division. ORDINANCES FOR INTRODUCTION - None VII. ORDINANCES FOR ADOPTION - None VIII. OLD BUSINESS 1. STATUS REPORT - JWA/CRAH/ASC Update on the John Wayne Airport Noise Monitoring Program, Coalition for a Responsible Airport Solution (CRAS) and Airport Site Coalition (ASC). Recommendation: Receive and file subject report as recommended by the community Development Department. 2. SANTA ANA (I-5)/COSTAMESA (RTE 55) TRANSI~AY STATUS REPORT At the past several meetings, residents of the Tustin Village Condominiums at 15500 Tustin Village Way expressed concerns about the proposed elevated transitway on the I-5 and Rte 55 freeways within their complex due to the interchange improvements. Recommendation: Authorize staff to meet and discuss with the Caltrans' staff on the following items: (1) potential mitigation measures for the elevated transitway with respect to sound and visual impacts, (2) physical mitigation measures for loss of parking spaces (covered and open) and (3) definition of actual required right-of-way needs as they relate to 'the existing c~dominium development as recommended by the Public Works D~Partment/Engineering Division. POLICY ON TEMPORARY USE PERMITS FOR COLD-AIR BALLOONS Councilman Prescott, at the City Council meeting on November 9, 1988, requested a report on the City's policy in reviewing and approving cold-air balloons for advertising' and grand opening events. Recommendation: Pleasure of the City Council. AME~MENT OF TUSTIN CITY CODE TO ALLOW KEEPING o'F ANIMALS FOR BIOMEDICAL RESEARCH Staff recently received correspondence from Bedford Properties requesting that the City amend the Tustin City Code.pertaining to animals to allow the keeping of animals for purposes of biomedical research. Recommendation: Pleasure of the City Council. NEWPORT BAY SEDIMENT CONTROL PLAN In September 1984, the City entered into an agreement with the Orange County Flood Control .District, City of Irvine, City of Newport Beach and The Irvine Company for the construction and maintenance of certain in-channel sedimentation facilities within San Diego Creek. Re6ommendation: Pleasure of the City Council. 4. AW]tltDOF CONTRACT FOR CONSTRUCTION OF JAMBOREE ROAD BETWEEN IRVINE BOULEVARD ~ TUSTIN RANCH RO~D Bids were opened November 10, 1988, for the above-referenced project and six bids were received. The low bid by Sully Miller is 30% below the engineer's estimate of $6,177,077. Recommendation: Award a contract to Sully Miller Contracting Company in the amount of $4,309,315.55 for the above-referenced project as recommended by the Public Works Department/Engineering Division. 5. AWARD OF CONTRACT FOR CONSTRUCTION OF TUSTINRANCH ROAD, PORTOLA PARKWAY, LA COLINA DRIVE AND IRVINE BOULEVARD Bids were opened November 15, 1988, for the above-referenced project and three bids were received. The low bid by Sully Miller is 25% below the engineer's estimate of $6,885,159. Recommendation: Award a contract to Sully Miller Contracting Company in the amount of $5,157,062.90 for construction of the aboverreferenced project as recommended by the Public Works D.eDartment/Engineering Division. DRIVE AND AT AN~LIN DRIVE AND MALENA DRIVE In response to a request from a resident, two intersections were investigated with respect to the placement of stop signs. Recommendation: Adopt the following Resolution No. 88-124 designating the placement of certain-stop signs as.recommended by the Public Works Department/Engineering Division: -. RESOLUTION NO. 8S-lZ4 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING PLACEMENT OF CERTAIN STOP SIGNS (LAURIE LANE AND ANGLIN DRIVE AT MALENA DRIVE) EL CAMINO REAL BETWEEN BROWNING AVENUE AND 300+ FEET EASTERLY OF TUBTIN EAST DRIVE At the City Council meeting on November 7, 1988, a resident, Ms. Patricia Agosta, raised the following concerns regarding that portion of E1 Camino Real between Browning Avenue and 300+ feet easterly of Tustin East Drive: (1) lack of street lighting, (2) lack of sidewalks along the northerly side of E1 camino Real and (3) soundwalls along the freeway side of E1 Camino Real, Recommendation: Authorize the installation of the following improvements along the northerly side of E1 Camino Real between Browning Avenue and 300+ feet easterly of Tustin East Drive as recommended by the Public Works Department/Engineering Division. .. REPORTS '1. PLANNING COMMISSION ACTION AGENDA - NOVEMBER 14, 1988 Ail actions of the Planning Commission become final unless appealed by the City Council or member of the public. ReCommendation: Ratify the Planning Commission Action Agenda of November 14, 1988. 2. MAIN STREET AND EL CAMINO REAL INTERSECTION TRAFFIC STUDY As a result of several complaints from motorists and concerns raised by members of the City Council, staff has completed a study of the intersection of Main Street and E1 Camino Real. · ~ecommendation: Pieasure of the .City Council. RECEIPTS AND EXPENDITURES FOR RECREATION CAPITAL IMPROVEMENTS The staff has been asked to review City records and advise the Council as to expenditures the City has made for recreation programs and what obligations the City may have regarding the expenditure of monies for recreational and other related activities.
