HUSTON, CIT/ MANAGER C(It~NITY DEVELOPMENT DEPARTMENT POLICY ON TEMPORARY USE PERHITS FOR COLO-AIR BALLOONS RECOI~ENDATION Pleasure of the City Council. BACKGROUND Councilman Prescott at the City Council's meeting on November 9th requested a report on the City's policy in reviewing and approving cold-air ball0ons for advertising and grand opening events. Banners, bunting, advertising or decoratiVe flags, balloons and similar devices generally require a Temporary Use Permit and Sign Permit pursuant to Section 9480 of the Tustin City Code. Master Sign Plans for individual Specific Plan or Planned Unit Development Districts in the City, in some cases, preclude temporary banners and cold-air balloons (i.e., Auto Center). Deviations from Master Sign Programs require Planning Commission approval. Where authorized by the code, or a Master Sign Program, the Community Development Department may' approve a ten~orary use permit limited to 30 days per quarter. In the event the Community Development Department denies a balloon request, the applicant has the right to submit an appeal to the City Council for their review and approval. Since the Planning Commission and City Council have gone on record as previously opposing the approval of cold-air balloons, Community Development Department staff have consistently denied requests for cold-air balloons with two recent exceptions: 1) a balloon permitted in 1988 for grand opening of Market Place (not restricted to one-tenant), and 2) a balloon permitted tn 1988 for groundbreaking/grand opening of the Auto Center {not restricted to one-tenant). It has not been practice to approve a grand opening balloon for each and every new tenant in a major new project. Special circumstances or waivers of this policy would obviously be something that the City Council could review through waiver and appeal procedures contained in the Tusttn Sign Code. Ctty Counctl Report Policy on Temporary Use for Cold Air Balloons November 21, 1988 Page two In currently preparing amendments to the Sign Code, the Planning Commission has also requested cold-air balloons be prohibited, unless a variance is specifically granted by the City Council. In the event the City Council is dissatisfied with current policy implementation on this matter, staff would suggest that the issue be referred to the Planning Commission for a review and recommendation since the Sign and Zoning Codes are impacted.
