SUBJECT: NEWPORT BAY SEDIMENT CONTROL PLAN
RECOMMENDATION '·
Pleasure of the City Council.
BACKGROUND. ·
In September 1984, the City entered into an agreement with the:
* Orange County Flood Control District
* City of Irvine
* City of Newport Beach
* Irvine Company
for the construction and maintenance of certain in-channel sedimentation
facilities.within San Diego Creek. The City's original participation
for basin construction was 6%, and 10% was estimated for. maintenance and
operation. Prior to the current 1988-89 budget year, it was estimated
that maintenance cost for '88-'89 would be approximately $220,000.
Consequently, the City budgeted $22,000 in 1988-89 for its share of the
maintenance program.
At subsequent Technical Advisory Committee (TAC) meetings, it was
established that the revised estimated cost for maintenance would be
$395,000, and it was further discussed that the participating
percentages should change. After much discussion, the TAC suggested the
following maintenance percentages be implemented:
County of Orange ................ 26%

Irvine Company .......... · ........ 26%
City of Irvine .................. 16%
City of Newport Beach ........... 16%
City of Tustin .................. 16%
Prior to this meeting, City staff indicated that Tustin did not concur
with these percentages. On July 15, 1988, the Executive Committee of
the Newport Bay Sedimentation Control Program approved the
above-mentioned percentages.
The increase in Tustin's obligation has risen from 10% based upon the
original $220,000 estimate to 16% of the revised estimate of $395,000,
or from $22~0-00 to. $63,200 which is a $41,200 shortfall.

DISCUSSION:
The action of the Executive Committee indicated that acceptance of the
revised funding formula is a commitment for this maintenance project
only and is not a commitment for future basin maintenance.
Additionally, the funding formula approved by the Executive Committee on
July J15, 1988 dues not impose a'mandatory funding requirement on any of
the parties. However, a shortfall will occur if any of .the parties
contribute less than the recommended amount. This shortfall would have
to be distributed to the other parties, or a lesser amount of work done.
This silt removal operation is the first of what could be many on-going
maintenance projects. The frequency of these projects would depend upon
weather conditions and the rate of siltation of the basins.
The current plan is to award a contract for the cleaning of the basin so
that work can be accomplished in the Spring of 1989. The Executive
Committee is requesting that each participating agency confirm as to
- whether their agency will be funding the amount recommended by the
Committee. In Tustin's case, this amount would be $63,200 in lieu of

$22,000. Any commitment would require a supplemental budget
appropriation in the amount of $41,200.
With the current and expedited development within the East Tustin area,
the City may want to consider exercising its option of withdrawal from
the 1984 Agreement per Section 15 of that agreement. This withdrawal
could be based upon the elimination of undeveloped acreage and the
installation of ultimate storm facilities in lieu of the earthen and
natural drainage courses. Tustin is fast approaching the build-out
conditions of lands within the watershed as were Santa Ana and Orange
which were excluded in the original formation of the agreement.
