It is recommended that the Redevelopment Agency receive and file.
BACKGROUND
The Planning Commission at their regular meeting on November 28, 1988 adopted
Resolution No. 2545 recommending to the City Council and Redevelopment Agency
approval of the proposed Second Amendment to the Town Center Area Redevelopment
Project.
Section 33358 of the California Community Redevelopment Faw provides that the
Planning Commission must review any proposed Redevelopment Plan amendment and
make its report and recommendations to the Agency and Council including a
determtna.tion that the Amendment conforms to the General Plan. Resolution No.
2545 is the report and recommendations of the Planning Commission concerning the
proposed Second Amendment to the Amended Redevelopment Plan for the Town Center
Area Redevelopment Project and contemplated public projects and activities
thereunder, as required by applicable provisions of law.
The resolution is attached and officially transmitted to the Agency for
consideration as part of the Agency's Report to City Council pursuant to Section
33352 of California Community Redevelopment Law.
Future Council and Agency action on the proposed Amendment is scheduled in
February.'

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, RECOMMENDING ADOPTION OF THE 'SECOND AMENDMENT
TO THE AMENDED REDEVELOPMENT PLAN FOR THE TOWN CENTER
AREA REDEVELOPMENT PROJECT.
WHEREAS, the Tustln Redevelopment Agency has prepared and submitted to
the Planning Commission a proposed Second Amendment to the Amended
Redevelopment Plan for the Town Center Area Redevelopment Project; and
WHEREAS, Section 33358 of the Community Redevelopment Law (Health and
Safety Code, Section 33000 et s.e..q.) provides that the Planning Commission
is to review the proposed Second Amendment and make its report and
recommendations thereon to the Redevelopment Agency and the City Council,
including a determination that the proposed Second Amendment conform to
the General Plan of the City of Tustin; and
WHEREAS, Section 65402 of the Government Code provides in part:
"(a) If a general plan or part thereof has been adopted, no real
property shall be acquired by dedication or otherwise for street,
square, park or other public purposes, and no real property shall
be disposed of, no street shall be vacated or abandoned, and no
public building or structure shall be constructed or authorized,
if the adopted general plan or part thereof applies thereto,
until the location, purpose and extent of such-acquisition or
disposition, such street vacation or abandonment, or such public
building or structure have been submitted to and reported upon by
the planning agency as to conformity with said adopted general
plan or part thereof..."
"(c) A local agency shall not acquire real property for any of the
purposes specified in paragraph" (a) nor dispose of any real
property, nor construct or authorize a public building or
structure, in any county or city, if such county or city has
adopted a general plan, or part thereof, until the location;
purpose and extent of such acquisition, disposition, or such
public building or structure have been submitted to and reported
upon by the planning agency havi.ng jurisdiction, as to conformity
with said adopted general plan or part thereof..."; and
WHEREAS, the above required reports and recommendations, including
matters referred to in Section 33458 of the Health and Safety Code and
Section 65402 of the Government Code, are to be made to the Redevelopment
Agency and the City Council for their consideration in acting on the
adoption of the Second Amendment to the Redevelopment Plan; and
WHEREAS, the Planning Commission has considered the proposed Amended
Redevelopment Plan, including the Draft Environmental Impact Report, and
the~General Plan of the City and other pertinent reports and documents.

NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF' TUSTIN,
CALIFORNIA, DOES RESOLVE AS.FOLLOWS:
. Section 1. Findings. The Planning Agency hereby finds and determines
that:
(a) Pursuant to Section 33453 of the Community Redevelopment Law, the
proposed Second A.mendment to the Amended Redevelopment Plan for the Town
Center Area Redevelopment Project (attached hereto as Attachment No. 1)
conforms to the General Plan of the City of Tustln.
(b) Pursuant to Section 65402 of the Government Code, with respect to
publlc activities which may be undertaken withln the Project Area pursuant
to the Amended Redevelopment P]an, as amended by the Second Amendment, and
that are referred to tn satd section, such actJvttles and undertaklngs
conform to the General Plan of the City of TustJn.
Sectton 2. Report and Recommendations. The Planning Commission
hereby reports to th~'Tus'tt~"Redevelopment Agency and the City Council of
the City of Tusttn the ftndtngs referred to In Section ! hereof, and
recommends the approval and adoptton of said Second Amendment as submitted
by the Tustln Redevelopment Agency. In the event that prtor to
adoptton of the Amended Redevelopment Plan, the City Councll desires to
make any mtnor, technical, or clarifying changes to the Redevelopment Plan,
the Planning Commission hereby finds and determines that any such minor,
technical, or clarifying changes need not be referred to it for further
report and recommendatlon, and hereby watves 1ts report and recommendation
under Sectton 33453 of the Community Redevelopment Law concerning any such
change.
Section 3. Transmittal. The Planning Commission's Secretary shall
transmit a copy of this 'Resolution to the Tustin Redevelopment Agency and
the Ctty Council of the City of Tustln for consideration as part of the
Agency's Report to the City Counc11 pursuant to Section 33352 of the
Community Redevelopment Law, and this Resolution shall be deemed the report
and recommendations of the Planntng Commission concerning the proposed
Second Amendment and contemplated public projects and activities
thereunder[ as required by applicable provisions of law.
