Except as otherwise provided by law,. no action shall be taken on any item not appearing in the following agenda. ZONING ORDINANCE AMENDMENT 88-06; ADDITION OF CODE SECTION 9273 (E) EXEMPTING LEGAL CONFORMING PROPERTIES FROM BECOMING NON- CONFORMING DUE TO PUBLIC RIGHT-OF-WAY ACQUISITION BY THE CITY ORDINANCE NO. 1013 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING ZONING ORDINANCE AMENDMENT 88- 06, EXEMPTING LEGAL CONFORMING PROPERTIES FROM BECOMING NON- CONFORMING DUE TO PUBLIC RIGHT-OF-WAY ACQUISITION BY THE CITY Recommendation: M.O. - Ordinance No. 1013 have first reading by title only. M.O. - Ordinance No. 1013 be introduced. Z. 19S9-90 PROPOSED USE OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS (15TH YEAR APPLICATION) The County of Orange has solicited funding applications for participation in the Urban County's Community Development Block Grant (CDBG) program for fiscal year 1989-90 (Program Year XV). Recommendation: Adopt the following Resolution No. 88-131 approving the 1989-90 application for the proposed use of Community Development Block Grant (CDBG) funds as recommended by the Community Development Department: RESOLUTION NO. 88-131 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE CITY'S 1989-90 APPLICATION FOR HOUSING AND COMMUNITY DEVELOPMENT FUNDS AND AUTHORIZING SUBMISSION OF SUCH APPLICATION TO THE COUNTY OF ORANGE CITY COUNCIL AGENDA PAGE 1 DECEMBER 19, 1988 IV. APPROVAL OF MINUTES - DECEMBER 5, 1988, REGULAR MEETING APPROVAL OF DEMANDS IN THE AMOUNT OF $983,993.00 RATIFICATION OF PAYROLL IN THE AMOUNT OF $191,045.45 HOLD HARMLESS AGREEMENT FOR USE OF ANAHEIM STATIUM PARKING LOT Execute the Hold Harmless Agreement with the City of Anaheim for use of Anaheim Stadium parking lot in connection with driver training for police motorcycles as recommended by the Police Department. 4. AGREEMENT FOR PROFESSIONAL SERVICES FOR CONSTRUCTION OF JAMBOREE ROAD BETWEEN IRVINE BOULEVARD AND CHAPMAN AVENUE, AD 86-2 Approve an agreement for professional services with Hunsaker and Associates Irvine, Inc. and authorize the Mayor and City Clerk to execute as recommended by the Public Works Department/Engineering Division. 5. POLICY ON TEMPORARY USE PERMITS FOR COLD-AIR BALLOONS Receive and file as recommended by the Community Development Department. ANNUAL REPORT, 1987-88 Receive and file the Annual Report for 1987-89 and direct that - a copy of this report be filed with the State Controller and the State Department of Housing and Community Development as recommended by the Community Development Department. 7. RESOLUTION NO. 88-132 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING THAT PUBLIC INTEREST AND NECESSITY DEMANDS IMMEDIATE EXPENDITURE OF PUBLIC MONEY TO SAFEGUARD LIFE AND HEALTH (FOOTHILL RESERVOIR REPAIRS) Adopt Resolution No. 88-132 declaring that public interest and necessity demands immediate expenditure of public money to safeguard life and health as recommended by the Public Works '.Department/Engineering Division. KE$OLUTION J. 88-133 - A RESOLUTION Oi 3HE CITY COUNCIL OF TH~ CITY OF TUSTIN, CALIFORNIA, REQUESTING THE COUNTY OF ORANGE TO INCLUDE WITHIN THE ARTERIAL HIGHWAY FINANCING PROGRAM THE IMPROVEMENT OF VARIOUS STREETS Adopt Resolution No. 88-133 requesting the County of Orange to include the improvement of certain streets in the 1989-90 FY AHFP as recommended by the Public Works Department/Engineering Division. 9. AGREEMENT FOR PROFESSIONAL SERVICES FOR CONSTRUCTION OF TUSTIN RANCH ROAD, PORTOLA PARKWAY, LA COLINA DRIVE AND IRVINE BOULEV/%RD, AD 86-2 Approve an agreement for professional services with GeoSoils, Inc. for soils engineering and testing and authorize the Mayor and City Clerk to execute as recommended by the Public Works Department/Engineering Division. 10. RIGHT-OF-WAY CERTIFICATION FOR NORTHEAST CORNER OF RED HILL AVENUE AND WALNUT AVENUE, AHFP NO. 1199 Approve the right-of-way certification for this project and authorize the Mayor to execute as recommended by the Public Works Department/Engineering Division. 11. ACCEPTANCE OF PUBLIC IMPROVEMENTS AND RELEASE OF BONDS FOR TRACT NO. 12759 Accept all public improvements related to Tract No. 12759 and authorize the release of the following bonds: Faithful Performance 95241 0357, $444,900; Labor and Material #5241 0357, $222,450; and Monumentation #5241 0358, $10,500 as recommended by the Public Works Department/Engineering Division. 12. RESOLUTION NO. 88-134 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR SIDEWALK AND CURB AND GUTTER REPAIR PROJECT, 1987-88 FY Adopt Resolution No. 88-134 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/Engineering Division. 13. POLICE CANINE ,,GUNDO" Retire Police Canine Gundo from City service and execute sales agreement between Officer Ron Frazier and the City selling Canine Gundo as surplus as recommended by the Police Department. 14. RESOLUTION NO. 88-135 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING THAT PUBLIC INTEREST AND NECESSITY DEMANDS IMMEDIATE EXPENDITURE OF PUBLIC MONEY TO SAFEGUARD LIFE AND HEALTH (RAWLINGS RESERVOIR REPAIRS) Adopt Resolution No. 88-135 declaring that public interest and necessity demands immediate expenditure of public money to safeguard life and health as recommended by the Public Works Department/Engineering Division. ORDINANCES FOR ADOPTION - None VIII. OLD BUSINESS 1. STATUS REPORT - JWA/CRAS/ASC Update on the John Wayne Airport Noise Monitoring Program, Coalition for a Responsible Airport Solution (CRAS) and Airport Site Coalition (ASC). Recommendation: (1) Select a representative to serve on the Board of Directors of the Coalition for a Responsible Airport Solution and (2) Receive and file subject report as recommended by the Community Development Department. TRAFFIC STUDY AT IRVINE BOULEVARD BETWEEN YORBA STREET AND COSTA MESA (RTE. 55) FREEWAY At the November 7, 1988 City Council meeting, a staff report was presented to the Council concerning the potential closure of the median island on Irvine Boulevard between Yorba Street and the Costa Mesa Freeway. Recommendation: No action to be taken at this time as recommended by the Public Works Department/Engineering Division. IX. NEW BUSINESS 1. AUTHORIZE PURCHASE OF VEHICLES On December 5, 1988, Council authorized the purchase Of four (4) small pick-up trucks with extended cabs from Fuller Ford. The 1988-89 budget provided for the purchase of a full-size 3/4 ton pick-up for the Street Division. Recommendation: Authorize the purchase of an additional small pick-up with extended cab from Fuller Ford, Chula Vista, California, in the amount of $11,247.55 as recommended by the Public Works Department/Field Services Division. EQUIPMENT PURCHASE REQUEST The 1988-89 budget authorized the purchase of new and replacement equipment for departments city-wide. Recommendation: Authorize staff to solicit bids for the purchase o~'replaCement and new equipment authorized in the 1988-89 Fiscal Budget as recommended by the Public Works Department/Field Services Division. CITY COUNCIL AGENDA PAGE 4 DECEMBER 19, 1988 AWARD OF CO~,.'RACT FOR THE RECONSTRUCTIO~ dF INTERLOCKING CONCRETE PAVER SIDEWALK ON EL CAMINO REAL AND MAIN STREET One bid was submitted and opened on November 22, 1988. The sole bidder was Neff Contracting Corporation of Anaheim with a bid of $46,277. Recommendation: Award a contract for subject pr6ject to Neff Contracting Corporation in the amount of $46,277 and authorize a supplemental 1988-89 budget appropriation in the amount of $47,300 from the Beautification Fund as recommended by the Public Works Department/Engineering Division. 4. AMBULANCE SERVICE AGREEMENT The current emergency ambulance service agreement expires at 11:59 P.M. on December 31, 1988. Recommendation: Pleasure of the City Council. 5. RENEWAL OF SOLID WASTE COLLECTION FRANCHISE WITH GREAT WESTERN RECLAMATION, INC. The existing exclusive franchise for solid waste collection with Great Western Reclamation, Inc. is due to expire. Recommendation: Ratify the agreement for collection and transportation of solid waste refuse produced or accumulated in the City of Tustin as recommended by the Public Works Department/Engineering Division. 6. BIOMEDICAL ANIMALRESEARCHLABORATORIES, AMENDMENTS TO CITY CODE On October 14, 1988, the Community Development Department received a request from Bedford Properties requesting an amendment to the Tustin City Code to allow the keeping of animals for the purpose of biomedical research. Recommendation: That the City Council take the following actions as recommended by the Community Development Department: (1) (2) Refer to the Planning Commission a request to amend the Zoning Code to allow biomedical research in the PM & M Industrial Zones. Direct the Community Development Department staff to prepare an amendment to the Animal Code to allow an exemption from the numerical animal limits currently in the Code for biomedical research, provided a conditional use permit is-approved. X. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - DECEMBER 12, 1988 Ail actions of the Planning Commission become final unless appealed by the City Council or member of the public.
