HomeMy WebLinkAboutCC 7 FOOTHILL RES RPRS 12-19-88TO: .WILLIAM HUSTON, CITY MANAGER FROM' PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: FOOTHILL RESERVOIR REPAIRS · RECOMMENDATION'. It is recommended that the City Council adopt a resolution declaring that public interest and necessity demands immediate expenditure of public money to safeguard life and health. BACKGROUND: The City Council at their meeting of November 7, 1988, authorized staff .to select a consultant and solicit bids for the required repairs for the Foothill Reservoir. During the cool weather winter months when water demands are low, the reservoir can be completely drained so that the leak can be located and proper repairs made. As the time frame for this favorable weather is short, the work will need to be done by contracting through informal quotations rather than through the formal advertising and bidding procedures. Council authorized this work previously, but it is felt that approval of the resolution is needed for compliance with the California Public Contract Code. Adoption of the resolution makes the proper findings that will authorize the informal bidding procedure. At their November 7th meeting, the City Council appropriated $32,500 for these repairs. (FOOTHILL RESERVOIR REPAIRS)' WHEREAS, the Foothill Reservoir has developed a leak causing infiltration of water into garage walls of a nearby residence; and, WHEREAS, it has been determined that the leak must be repaired during the cool weather period when water demands allow the temporary draining of the reservoir. NOW, THEREFORE, the City Council does resolve as follows: SECTION ~. There is an immediate need to drain the reservoir, locate the leak, and make the necessary repairs as quickly as possible. SECTION ~. That the public interest and necessity demands the immediate expenditure of public money to safeguard life and health. SECTION ~. The Director of Public Works/City Engineer is 'directed to take steps to immediately eliminate said conditions in this emergency without complying with the formal bidding procedures for public contracts. SECTION 4. This action is taken pursuant to Section 20168 of the Public Contract Code of the State of California. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 19th day of December, 1988. ATTEST: Mayor City Clerk
