ANNEXATION f141 PROSPECT/YANDENBERG SPECIAL ELECTION RESULTS

RECOIqMENDATION:
Adopt Resolution No. 87-134 which orders the territory known as "Annexation No.
141 Prospect/Vandeberg" annexed to the City of Tustin.
BACKGROUND:
,
Annexation No. 141 was initiated by the Tustin City Council on March 16, 1987
(Resolution No. 87-136) in response to residents living in the area. On June 3,
1987, the 'Local Agency Formation Commission approved the annexation subject to
terms and conditions of LAFCO Resolution No. 87-27. On July 20, a protest
hearing was conducted and August 3, 1987 the City Council adopted Resolution
No. 87-90 which called for a Special Election to be held on November 3, 1987 as
required by the provisions of the laws of the State of California.
The results.of the November 3, 1987 election are as follows-
Yes 184 (70.5%)
No 77 (29.5%)
Staff recommends that the City Council adopt Resolution No. 87-134 which will be
transmitted by LAFCO to the Secretary of State. Acceptance by the Secretary of
State of the Resolution will then formalize the annexation.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, DECLARING
THE VOTE ON PROSPECT-VANDENBERG
ANNEXATION NO. 141, AND CONFIRMING THE
ORDER ANNEXING SAID TERRITORY TO THE
CITY OF TUSTIN
WHEREAS, on August 3, 1987, the City Council of the
City of Tustin, by Resolution No. 87-90 ordered that all of
the territory described as the Prospect-Vandenberg
Annexation No. 141 to the City of Tustin, as described in
Exhibit "A" attached hereto, be annexed to the City of
Tustin subject to confirmation by a majority of the duly
registered voters residing in said territory; and
WHEREAS, the Orange County Registrar conducted such
election on November 3, 1987, on behalf of the City of
Tustin pursuant to Resolution No. 87-91; and
WHEREAS, said Registrar of Voters has canvassed the
ballots from such election pursuant to Elections Code
Sections 17080 to 17089 and has presented his certified
statement of results which is attached hereto as Exhibit
"'C"; and
WHEREAS, the City Council is now required to declare
the total number of votes cast for and against such
Annexation pursuant to Government Code Section 57175, and to
confirm the order annexing said territory if a majority of
votes cast upon the question are in favor pursuant to
Government Code Section 57176.
N(~, THEREFORE, the City Council of the City of Tustin,
California, does hereby resolve, declare and determine as
follows:
Section 1: These annexation proceedings are being
conducted, and this Resolution is being adopted, pursuant to
the provisions of Part IV of Title 5, Division 3, commencing
with Section 56000 of the Government Code of the State of
California, known as the Cortese-Knox Local Government
Reorganization Act of 1985.
Section 2: Pursuant to Government Code Section
57175, the City Council of the City of Tustin hereby
determines that a total of 262 votes were cast in said
annexation election and that 184 votes were cast for
annexation, and 77 votes were cast against annexation.
Section 3: It appearing to the City Council that a
majority of the votes cast upon the question are in favor of
said Annexation, the order annexing the Prospect-Vandenberg

Annexation No. 141 to the City of Tustin, as described in
Exhibit "A" attached hereto, is hereby confirmed pursuant to
the provisions of Government Code Section 57176.
S~ctio/~_~: This Annexation is ma de for the
following reasons and is subject to the following terms and
con di ti ons:
A. The reason for this Annexation is to provide
economy and efficiency of government services by
incorporating developed territory within the jurisdiction of
the City of Tustin.
B. The regular County Assessment Roll shall be
utilized by the City of Tustin in the annexed area.
C. The affected territory shall not be .taxed for
existing general bonded indebtedness of the City.
D. The City of-Tustin shall be liable for and pay all
proper expenses incurred in conducting the annexation
pr oceedi ngs.
Section 5: Pursuant to Government Code Section
57200, the City Clerk shall transmit a certified copy of
this Resolution to the Executive Officer of the Local Agency
Formation Commission along with a remittance to cover the
fees required by Government Code Section 54902.5.
PASSSED AND ADOPTED at a regular meeting of the City
Council'of 'the City 'of Tustin, California, held on the
16t5 day of November, 1987.

the County of Orange, State of California, which Decree was

District in and for Los Angeles County, California,
