S UBJ ECT:
The City Council has indicated that it wants to do all it
legally can do to provide an election of the residents of the.
territory of Annexation No. 142 in which the residents can decide
whether they want to be annexed to the City.
It has been suggested that the City commit that an election
would be held even if fewer ti{an 25% of the registered voter
residents file protests. However, State law does not provide for
an election if fewer than 25% ¢:f the registered voter residents
file protests.
The City could provide protest forms that clearly specified
that the filing of the protest was solely for the purpose of
insuring an election and that if 50% or more of the reqistered
voter residents filed protests tha-% all protests on this form
would only be counted to establish a 25% protest but would not be
counted toward establishing a 50% protest and would be deemed
withdrawn to the extent necessary so as not to establish a 50%
protest.

PURPOSE OF INSURING AN ANNEXATION ELECTION AND NOT
TO CAUSE TERMINATION OF TIlE ANNEXATION WITIIOUT AN ELECTION
I am a registered voter residing wi thin the territory
proposed to be annexed to t~he City of Tustin pursuant to
Annexation No. 142, La Colina-Beverly Glen, to the City of
Tustin. I hereby protest 'the annexation in accordance with the
provisions of Government Code Section 57051.
I protest this annexation for the sole purpose of having an
election on this proposed annexation in which the registered
voters residing within this territory can decide whether to annex
to the City of Tustin.
I understand that under State law if 25% or more of the
registered voter residents fi].e protests, an election will be
held, but if 50% or more of ~l~e registered voter residents file
protests then there will be no election and the annexation will
be terminated. I want an election, so I do not want my protest
%o be counted toward arriving at a total percentage of protests
of 50% or more, but only coun'ted to establish a protest of 25% or
more, but less than 50%, and for my protest to be automatically
withdrawn, if necessary so as not to be counted toward
establishing a protest of 50% or more.
