HomeMy WebLinkAboutRPT 4 CITIZEN COMPLNT 11-16-87TO: FROM: SUBJECT: WILLIAIM HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION CITIZEN COMPLAINT - CARFAX AVENUE CUL-DE-SAC RE C0 MME NDAT I 0H: That the Tustin City Council authorize either the permanent closure of the pedestrian gate on Carfax Avenue, or order the complete removal of said gate and the replacement of the perimeter wall. BACKGROUND: At the October 19, 1987 City Council meeting, Councilman Kelly forwarded a copy of a petition (copy attached) from the residents of Carfax Avenue and Drayton Way to Staff for review and response. The residents' concerns were as follows: 1. Utilization of Carfax Avenue by tenants and guests of the California Apartments. 2. Utilization of Carfax Avenue by users of the tennis courts. 3. Noise generated by guests/tenants of the California Apartments in the late evening and early morning hours that utilize Carfax Avenue for parking. 4. Litter and debris left by guests/tenants of the California Apartments. 5. Grafitti on walls and sidewalks. 6. Animal waste from apartment dwellers' pets. 7. The use of the small pedestrian gate to provide access to Carfax Avenue. DISCUSSION: Staff has reviewed these areas of concern and concurs in many instances with the petitioners. A recap of Staff's findings is as follows: 1. The grafitti had been removed prior to the receipt of the petition along with the City-wide removals in September. 2. A review of the Community Development Department records/plans indicates that a pedestrian gate was not on the original apartment plans, nor on the proposed condominium conversion plans. The only authorized gate was the fire gate on the Carfax Avenue cul-de-sac that was to be locked at all times and used only for emergency purposes. This was-to minimize impacts to the residential neighborhood to the North. .- Citizen Complaint - Carfax Avenue Cul-de-Sac November 10, 1987 Page 2 3. That the California Apartment complex charges for some of the tenant parking spaces which may be one of the causes of apartment tenant parking on Carfax Avenue/Drayton Way. It appears that the permanent closure or removal of the pedestrian gate from the California Apartment complex to the Carfax Avenue would minimize or eliminate the petitioners' concerns 1, 3, 4, 6 and 7 listed above. It would not eliminate the use for tennis court parking or the potential for additional grafitti. Contact was also made with the Police Department regarding the late evening noise and racing down the street and they indicated they would certainly respond when called, but it would have to be at the time of the occurrence and not after the fact. It is suggested that the California Apartment complex management be contacted and directed to permanently close/lock said pedestrian gate, or that the pedestrian gate be entirely removed and the wall replaced. Bob Ledendecker Director of Public Works/City Engineer BL/mv We the undersigned, who live on Carfax.and Drayton in the City of Tustin, are sick and tired of supplying the parking lot for the California Apartment renters and quest. Along with the tennis court parking, we are left With no room for parking our vehicles and those of quests, in front of, or beside our own homes. On any given night,, there are 'from ten to forty cars parked on the Carfax Cul-de-sac, Carfax Drive and Drayton Streets, the weekends being the worst. There are parties on Friday and Saturday nights that last til foUr. and five in the morning. The people going to and leaving these parties do not do it in a qui~t manner. They stand out in the street and talk loudly, car radios blaring, car engines running and then they race down the street, honking their horns. The noise and traffic is unbearable. Besides the heavy traffi~ and party goers, we have to put up with broken glass, beer bottles and cans, fights, car damage and the latest - foul grafitti spray painted all over the wall and sidewalk. There has been several instances of them .parking across driveways, blocking us in or out. The Cul'-de-sac has turned into a toilet for animal waste from thc apartment dwellers who continue to allow their animals to defecate here. We have been told by the managers no animals are allowed in the apartments. · . We, as taxpayers and residents of Tustin are petitioning the city to have the small walk thru gate that gives them access to our homes and parking, be -cemented up so that we no longer have to put up with the above problems. When the apartments were first built, there was no gate for pedestrians to ~t through and there were no traffic and noise problems what so ever. To our knowledge, a walk through gate was not in the original plans for the California A~artment complex.. This gate was added to the Complex after a sale of the property. Therefore, this walk through is a major concern to the residents of this housing trac. t-. as voting, taxpayers. The residents in this area were told that they would not be bothered by the people in' the apartments. The only gate on the cul-de-sac was locked and was a fire gate only. Now, we no longer feel safe: On behalf of'all the residents in this tract of homes, we are asking that immediate action be taken. ~J ,.u.,..t 14,
