PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: SAN DIEGO PIPELINE FRANCHISE AGREEMENT RECOMMENDATION ~, That the Tustin City Council at their meeting of December 1987 adopt the attached resolution declaring its intention to grant a non-exclusive franchise to the San Diego Pipeline Company to construct, maintain, and operate pipelines within certain public roads, streets, and ways of the City of Tustin. BACKGROUND In February 1987 the San Diego Pipeline Company (SDPC) requested the City grant them a franchise ' to install, operate, and maintain two pipelines within certain public roadways within the City of Tustin. SDPC has an existing 10-inch pipeline facility currently located within an easement which was previously a part of the recently abandoned Atchison Topeka and Santa Fe Railroad right-of-way. In April 1987, the City Council reviewed this request and directed Staff to initiate the franchise agreement process inclusive of the preparation of an Environmental Impact Report to identify any potential environmental impacts associated with the pipeline project as proposed by SDPC. The Draft EIR has been completed and a public hearing has been held by the Tustin Planning Commission on October 26, 1987 to receive public input. The closing date for written comments/input from various agencies and the general public was November 20, 1987. The remaining actions to complete both the environmental certification process and the franchise agreement process includes the following: * City Council adoption of a Resolution of Intention to Grant the Franchise Agreement and set a date for public hearing. * City Council certification of Final EIR. * City Council introduction of ordinance granting franchise by first reading. * City Council holds public hearing for granting of franchise. San Diego Pipeline Franchise Agreement November 23, 1987 Page 2 * If deemed appropriate after said hearing, City Council adopts the ordinance granting franchise by second reading. * After adoption of ordinance and after a 30-day period, said ordinance becomes effective. DISCUSSION The attached resolution provides for the Tustin City Council to declare its intention to grant a non-exclusive franchise to San Diego Pipeline Company to construct, maintain, and operate pipelines within certain public roads, streets, and ways of the City of Tustin. Additionally, the attached resolution sets Monday January 4, 1988, at 7:00 p.m. in the Council Chambers of the City of Tustin, 300 Centennial Way, as the time and place for a hearing to be held on the proposed granting of a franchise. This resolution will also be published in the Tustin News on Thursday, December ~, 1987. An application for a franchise to construct, maintain and pipelines within the public roads, streets and ways of the 10 City of Tustin has been received from San Diego Pipeline Company, a Delaware corporation, ("SDPC") pursuant to California Public 11 .lities Code Sections 6'201, et seq. 2. The City Council intends, pursuant to the provisions of Chapter 2, Division 3 of the California Public Utilities Code 13 (Sections 6201, et seq.), to grant a franchise to SDPC on the Is and conditions set forth in the application for a franchise 14 and the proposed franchise on file in the office of the City Clerk, ahd the California Public Utilities Code. 3. SDPC proposes to lay, construct, maintain, inspect, 16 operate, repair and replace a pipeline or pipelines, control facilities and other appurtenances, including any facilities 17 necessary for cathodic protection thereof, for the transportation of refined petroleum products and other liquid substances in 18 conformance with the requirements of the appropriate regulatory agencies, in, under, along and across public streets, roads, ,s, alleys and other public ways of the City of Tustin. The )ipeline route shall be as described in Exhibit "A", attached 90 ~ereto and incorporated by this reference. 4. The term of the proposed franchise is for thirty (30) 5. Copies of the proposed franchise may be obtained at the 23 office of the City Clerk of the City of Tustin. 6. January 4, 1987, at 7:00 o'clock, p.m., in the Council Chambers of the City of Tustin, 300 Centennial Way, is hereby 25 fixed as the time and place for a hearing to be held on the granting of a franchise. The City Clerk is directed to publish this Resolution [thin fifteen (15) days of its passage, in the Tustin News.
