SUBJECT: NEWPORT/McFADDEN AVENUE UNDERGROUND UTILITY DISTRICT NO. 10
RECOMMENDATION
That the Tustin City Council, at their meeting of December 7, 1987 pass
and adopt the attached resolution which sets the time and place of a
public hearing to consider the designation and adoption of the Newport/
McFadden Avenue Utility District No. 10.

BACKGROUND
The proposed Underground Utility District No. 10 provides for the
conversion of all overhead distribution utilities to underground
utilities along Newport Avenue between Walnut Avenue and the Santa Ana
freeway, and along McFadden Avenue between Newport Avenue and Walnut
Avenue. Also included within the district boundaries is the only
existing utility distribution pole located on Walnut Avenue between
Newport and McFadden.
DISCUSSION
City of Tustin Ordinance No. 411 authorizes the City Council from time
to time to call public hearings to ascertain whether the public
necessity, health, safety or welfare require the removal of poles,
overhead wires, etc. within certain designated areas of the City and to
consider the underground installation of the above-mentioned
appurtenances for supplying electric, communication or other similar
services.
Ordinance No. 411 also requires the City to notify all affected property
owners and all concerned utilities by mail of the time and place of said
hearings at least ten (10) days prior to the date of said hearing to
determine whether to form an Underground Utility District.
The attached resolution sets the date of public hearing for Underground
Utility District No. 10 on Monday, January 18, 1988 at 7:00 p.m. in the
City Council Chambers, 300 Centennial Way.
Underground Utility District No. 10 is proposed to be administered by
Edison Company Rule 20A funding except for the installation of eight (8)
additional street lights. A complete cost breakdown of this proposed
project will be included within the City Engineer's report for said
District No. 10 which will be available at least ten days prior to the
public hearing date of January 18, 1988.

The formation of this underground utility district will require the
conversion of utility services for three property owners within the
District. Being as said underground district is within, the boundaries
of the South Central Redevelopment Agency, it is proposed that
redevelopment agency funds be utilized to cover these conversion costs.

RESOLUTION NO.' 87-148
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN DECLARING ITS INTENTION TO
ORDER THE FORMATION OF UNDERGROUND DISTRICT
NO. 10 ON NEWPORT AVENUE BETWEEN WALNUT AVENUE
AND THE SANTA ANA FREEWAY, AND ON MCFADDEN
AVENUE BETWEEN NEWPORT AND WALNUT AVENUES
AND SETTING A PUBLIC HEARING THEREFOR
WHEREAS, Article 7, Chapter 5, of the Tustin City Code
authorizes the City Council from time to time to call public
hearings to ascertain whether the public necessity, health,
safety or welfare require the removal of poles, overhead wires
and associated overhead structures within certain designated
areas of the City and to consider the - underground installation
of the aforementioned appurtenances for supplying electric,
communication, or similar associated services to the residents
of the .City of Tustin; and
WHEREAS, by the aforementioned Article 7, Chapter 5 of the
Tustin City Code, the City Clerk is required to notify all
affected property owners, if any, as shown on the last equalized
assessment roll and also to notify all concerned utilities by
mail of the time and place of hearings to determine whether to
form an Underground Utility District and of the availability of
the City Engineer's report of the details of the District in the
office of the City Clerk; and
WHEREAS, said notice is required to be given to the
aforementioned property owners and concerned utilities at least
ten (10) days prior to the date of the public hearing; and
WHEREAS, the city Engineer has advised that his report will
be on file in the office of the City Clerk at least ten (10)
days prior to the date of the public hearing; and
WHEREAS, the City Council has determined that a public
hearing should be set on January.18, 1988, at the hour of 7:00
P.M. in the City Council Chambers at 300 centennial Way in the
City of Tustin.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Tustin that said Council hereby sets Monday, January 18,
1988, at 7:00 P.M. in the City Council Chambers at 300
Centennial Way in the City of Tustin, California, as the time
and place for a public hearing to ascertain whether the public
necessity, health, safety or welfare require the removal of
poles, overhead wires and associated overhead structures and the
establishment of an Underground Utility District within the area
of the City of Tustin

generally located on Newport Avenue between Walnut Avenue and
the Santa Ana Freeway and on McFadden Avenue between Newport
Avenue and Walnut Avenue, more particularly described in Exhibit
"A" attache~ hereto and on that certain map on file in the
office of the City Clerk and the City Engineer of the City of
Tustin.
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized to notify all affected property owners, if any, as
shown on the last equalized assessment roll and to also notify
all utilities affected by this proposal by a notice through the
United States mail of the time and place of said hearing, and of
the availability of the City Engineer's report of the details of
the District in the office of City Clerk prior to said hearing,
ten (10) days prior to the date thereof.
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Tustin, California, on the 7th day of December,
1987.

Beginning at a point on the centerline of Newport Avenue, said point being 60 feet
southwesterly along the centerline of Newport Avenue from the point of intersection
of said centerline with the centerline of Walnut Avenue;
Thence, southeasterly, at right angles to said centerline of Newport Avenue, a
distance of 50 feet to the point of intersection with the southeasterly
ri ght-of-way line of Newport Avenue;
Thence, northeasterly, along said southeasterly right-of-way line and its
northeasterly prolongation, a distance of 2,035.8 feet, more or less, to the point
of intersection with the centerline of Nis~on Road;
