FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: AWARD OF CONTRACT FOR MAINTENANCE OF LANDSCAPING, 1988-92 RECOMMENDATION That the City Council: 1) find that Toyo Landscaping Company's bid cannot be considered because of insufficient bidder's bond; 2) award a contract for subject project to Landscape West, Inc., Los Angeles,' in the amount of $2,119.11 per month; and 3) approve a budget appropriation of $13,000 from revenues from the Tustin Landscape and Lighting District. BACKGROUND This job is for landscape maintenance along arterial streets in East Tustin and is funded through property owner assessments. This job was widely advertised and special notices were mailed to all contractors in Tustin. Eight contractors took out bidding documents but at the bid opening on December 1, 1987, only two bids were received as follows: Toyo Landscaping Co., Garden Grove Landscape West, Inc., Los Angeles $1,216.65 per month $2,119.11 per month Toyo's bid bond was for 10% of the amount bid, or $121.67; however, the bid documents required a bid bond of $10,000. Both Section A, Notice to Contractors, and Section B, Proposal Conditions, required a $10,000 bid bond and stated that no proposal shall be considered without the proper bond. Toyo's bid bond cannot be considered as their bid bond falls far short of the required $10,000. We have asked the City Attorney to review the matter and concur with our recommendation. The bid of Landscape West, Inc. at $2,119.11 per month is 38% under the engineer's estimate of $3,400 per month. This firm currently has contracts ' with the cities of Santa Ana and Huntington Beach totaling over $30,000 per month. The also do landscape maintenance for the cities of Manhattan Beach, E1 Segundo, and Pomona in Los Angeles County. Adequate. funding in the revenue accounts is available from property assessments, but an expenditure appropriation of $13,000 is needed for the balance of the 1987-88 fiscal year.
