HomeMy WebLinkAboutConsent Calendar #8 6-01-87TO: WILLIAM HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: EL MODENA-IRVINE CHANNEL EASEMENTS AND DEEDS RECOMMENDATION: For the City Council meeting of June 1, 1987. Authorize the Mayor to execute the following E1 Modena-Irvine Channel documents on behalf of the City- a. City Quitclaim Deed to Irvine Company b. Escrow instruction letter c. Irvine Company easement to City of Tustin BACKGROUND. In mid-1986, The Irvine Company, County of Orange and the City of Tustin entered into an agreement covering the following actions pertaining to the E1 Modena-Irvine Channel between the Santa Ana Freeway and Browning Avenue. This agreement provided for the following. C.ity to construct the channel facility to the conditions and standards of the Orange County Environmental Management Agency. Irvine Company to dedicate all right of way required to accommodate the channel facility. ° County of Orange Environmental Management Agency after completion of the channel facilities to accept said facilities for maintenance and operation. DISCUSSION- All work has been completed on the subject facility and it is now ready for conveyance to County of Orange for on-going maintenance and operation. Three documents need to be executed by the City to initiate these proceedings of conveyance. These documents are- o Quitclaim Deed (1 original and 2 copies) This document quitclaims the construction easement back to The Irvine Company now that it is no longer required by the City. ° Escrow instruction letter provides for the opening of an escrow account so that all documents can be processed in an orderly manner with respect to stipulated order of execution/recordation. MAY 26, 1987 PAGE TWO Irvine Company easement to the City (1 original and 2 copies) This document provides the City a permanent blanket easement over the flood channel facility for the repair/maintenance of City inlets to the E1 Modena-Irvine Channel facility. The originals and copies of these documents have not been attached to this staff report due to the voluminous nature of the documents. The originals have been forwarded to the City Clerk's Office for execution by the Mayor. In 'the event any Council member is desirous of reviewing these documents, they can be sent out under separate cover. In addition to the above mentioned documents, The Irvine Company will be dedicating fee title right of way to the County of Orange for said facility and the County of Orange will quitclaim all unused prior easements of the original channel alignment to The Irvine Company.
