AB 2190 (CHACON) MANDATORY DISTRICT ELECTIONS
RECOMMENDATION:
That Council direct staff to continue active opposition to this
legislation.
BACKGROUND:
This measure apparently was created as a response to some cities'
ethnic representation problems. The issue arises out of feeling
that certain ethnic minorities were not being represented
adequately, hence districting was suggested~ The meas,.~re
reguires cities to elect .their governing bodies by or from a
district, whether or not ethnic representation has been an issue.
It might be important to note that the City does not oppose
districting as a local option, but we do oppose mandated district
elections. League staff reports that this measure has a lot of
support and will require strong opposition from City officials.
Procedures currently exist for elections by and from districts as
a local option; therefore, there is no good reason for any
uniform statewide . mandate. Local control has been impaired
enough; we can not allow further erosion.
AB 2190 has been approved by the Assembly Elections,
Reapportionment and Constitutional Amendments Committee, and has
been set for hearing in the Assembly Ways and Means Committee on
June 3. Assemblyman John Lewis is a member of this committee and
has been contacted by telephone. In addition, staff has
communicated with all members of the committee expressing
Tustin's opposition. We will keep close watch on this bill and
continue opposition as warranted.
