RECOMMENDATION:
That the City Council:
1. Receive the City Engineer's Report dated 1/6/88.
2. Conduct the public hearing.
3. Adopt resolution establishing Underground Utility
District No. 10 and order the conversion.
BACKGROUND:
On December 7, 1987, City Council adopted Resolution No. 87-148 which
declared its intention to form an underground 'utility district on
Newport Avenue between Walnut Avenue and'the Santa Ana Freeway, and
on McFadden Avenue between Newport and Walnut Avenues; and set a time
and date of public hearing for 7:00 P.M. Monday, January 18, 1988.
Ail affected utility companies and property owners have been notified
and sent a copy of this resolution. There are three property owners
within the district who will require conversion of their utility
services from overhead to underground.
DISCUSSION:
This district will provide for the undergrounding of all overhead
telephone, cable T.V. and Edison distribution facilities (12 kV
circuit) within its boundaries. In conjunction with the
undergrounding of these distribution facilities, the Edison Company
will also be rerouting their high voltage (66 kV) transmission lines
as detailed in the City Engineers report dated January 6, 1988.
This district is located within the South Central Redevelopment
Agency. City staff has recommended to the Tustin Community
Redevelopment Agency that a total of $16,250.00 in Redevelopment
Agency funds be budgeted to cover the costs of the additional street
lights, conduit, and the three property service conversions
associated with this district.

NEWPORT/MCFADDEN AVENUE
UNDERGROUND UTILITY DISTRICT NO. 10
January 6, 1988
At their meeting of DeCember 7, 1987, the City Council of the City
of Tustin, California passed and adopted Resolution No. 87-148
calling for a public hearing at 7:00 P.M. on January 18, 1988, to
consider the merits of establishing an underground utility district
along Newport Avenue between Walnut Avenue and the Santa Ana
Freeway, and along McFadden Avenue between Newport Avenue and Walnut
Avenue, and more particularly described and shown on Exhibit "A"
attached hereto.
Meetings have been held with both the Southern California Edison
Company and Pacific'Bell to determine costs involved. American
Cable Systems has some overhead facilities within the district, but
per terms of the City's franchise agreement with American Cable,
they will be required to underground these facilities at no cost to
the district. Funding will be provided by the Edison Company with
Rule 20A funds for their company owned facilities. The City of
Tustin or the Tustin Community Redevelopment Agency will provide
funding for approximately eight additional street lights and 200' ~
of supplementary conduit which are not eligible for Rule 20A funds.
The estimated cost of the proposed underground work within the
public right-of-way is as follows:
Edison Company costs for conduit, Structure, and
cable (Rule 20A) $333,800.00
City/RDA costs for additional street lights, and
conduit
12,000.00
Three property owners will require conversion of their overhead
services to underground facilities. Being as these parcels are
located within the South Central Redevelopment Agency, it is
recommended that redevelopment agency funds be utilized for the
conversions rather than inflicting these costs upon the property
owners. The estimated costs for the on-site service conversions are
as follows:

This. district will provide for the undergrounding of all overhead Edison
distribution facilities (12 kV circuit) and related services within the
boundaries of the district as described in Exhibit "A". In conjunction
with the undergrounding of these distribution facilities, the Edison
Company will also be rerouting their high voltage (66 kV) transmission
lines. This rerouting will entail the removal of all existing
transmission lines, poles, and associated structures along Newport
Avenue north of Walnut Avenue and along McFadden Avenue east of Walnut
Avenue to Newport Avenue.
The new routing for the 66kY transmission line will be along
McFadden Avenue west of Walnut, then along Walnut Avenue from
McFadden to across Newport Avenue to connect with ~existing
transmission facilities on Walnut Avenue east of Newport. -To
support these lines, four new tubular steel transmission poles will
be installed and located as follows: one pole on the south side of
· McFadden 'just west of Walnut, two poles on the northerly side of
Walnut Avenue between McFadden and Newport, and one pole on the
northerly side of Walnut Avenue, just east of Newport.

In summary, this district will provide for the removal of all poles
with overhead wires within its boundaries with the exception of the
four new tubular steel transmission poles and lines mentioned above.
A total of 28 wood utility poles (distribution and transmission)
will be removed, including four poles, with existing street lights.
There will be 12 new marblelite street light poles installed with
.underground wiring and .16,000 lumens high pressure sodium vapor
lamps.
Initial indications by the utility companies are that their work can
be'completed by May 1, 1989.

Beginning at a ppint on the centerline of Newport Avenue, said point being 60 feet
southwesterly along the centerline of Newport Avenue from the point of intersection
of said centerline with the centerline of Walnut Avenue;
Thence, southeasterly, at right angles to said centerlfne of Newport Avenue, a
distance of 50 feet to the point of intersection with the southeasterly
right-of-way line of Newport Avenue;

RESOLUTION NO. 88-6
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, ESTABLISHING UNDERGROUND
UTILITY DISTRICT NO. 10, NEWPORT/MCFADDEN AVENUE,
AND ORDERING THE CONVERSION.
WHEREAS, by Resolution No. 87-148 a public hearing was
called for January 18, 1988, at the hour of 7:00 P.M. in the
Council Chambers of the City of Tustin, California, to ascertain
whether the public necessity, health, safety, or welfare
requires the removal of poles, overhead wires and associated
structures and the underground installation of wires and
facilities for supplying electrical, communication, or similar
or associated service, within that certain area of the City of
Tustin more particularly described in the legal description and
shown on a map marked Exhibit "A" attached hereto.
WHEREAS, notice of such hearing has been given to all
affected property owners, if any, as such are shown on the last
equalized assessment roll and to'all utilities concerned in the
manner and time required by law; and
WHEREAS, such hearing has been duly and regularly held and
all persons interested have been given an opportunity to be
heard.
NOW, THEREFORE, the Council of the City of Tustin does
hereby resolve:
1. The Council hereby finds and determines that the public
necessity, health, safety and welfare require the removal of
poles, overhead wires and associated structures, 1) to eliminate
concentrations of overhead distribution facilities, 2) to clear
streets used extensively by the general public, which carry a
heavy volume of vehicular traffic, and to clear streets which
pass~'through a civic area, and the underground installation of
wires and facilities for supplying electric, communication or
similar or associated service in the underground district
described in Exhibit "A" attached hereto and made a part hereof
by this reference, and pursuant to the provisions of Article 7,
Chapter 5 of the Tustin City Code, such area is hereby
established as Underground Utility District No. 10, Newport
Avenue between Walnut Avenue and the Santa Ana Freeway, and
McFadden Avenue between Newport and Walnut Avenues.
2. The City Council hereby declares said designated area
to be an'Underground Utility District and orders all overhead
wires, poles and associated overhead structures to be removed
and facilities installed underground.

3. The Council does hereby fix May 1, 1989, as the date on
which affected property owners,'if any, must be ready to receive
underground service, and does hereby order the removal of all
poles, overhead wires and associated overhead structures and the
underground installation of wires and facilities for supplying
electric, communication or similar or associated service within
Underground Utility District No. 10, Newport/McFadden Avenue, on
or before May 1, 1989.
4. The City Clerk is hereby instructed to notify all
affected utilities and all persons owning real property, if any,
within Underground Utility District No. 10, Newport/McFadden
Avenues, of the adoption of this resolution within ten (10) days
after the date of such adoption. Said City Clerk shall further
notify said property owners, if any, of the necessity that, if
they or any person occupying such property desire to continue to
receive electric communication or other similar or associated
service, they or such occupant shall, by the date fixed in this.
ordinance, provide all necessary facility changes on their
premises so as to receive such service from the lines of the
supplying utility or utilities at a new location, subject to
applicable rules, regulations and tariffs of the respective
utility or utilities on file with the Public Utilities
Commission of the State of California. Such notification shall
be made by mailing a copy of this resolution together with a
copy of said Article 7, Chapter 5 of the Tustin City Code,
together with a statement that the City Engineer's Report
containing details of the district is available for inspection
by the public in the office of the City Clerk, to all affected
property owners as such are~ shown on the last equalized
assessment roll and to all utilities affected by this
Resolution.
PASSED AND ADOPTED at an adjourned regular meeting of the
City Council held on the day of , 1988.
