DEPARTMENT OF PUBLIC WORKS/ENGINEERING DIVISION SUBJECT: UTILITY AGREEMENT NO. 7UT-8945 WITH CALTRANS FOR WATER MAIN ~, RELOCATION AT McFADDEN STREET AND ROUTE 55 FREEWAY RECOMMENDATION That the City Council approve Utility Agreement No.7UT-$945 with the State Department of Transportation. BACKGROUND City water facilities are being relocated on McFadden Street to clear the widening of Route 55 Freeway. This work was initiated under a Notice to Relocate issued last year by Caltrans. The first phase of our work is completed, but the second phase cannot start until the new freeway bridge is under construction. It is hereby mutually agreed that: I. WORK TO BE DONE In accordance with Notice No. 7-8945 dated November 6, 1986, Owner shal 1: Abandon 8" water main and associated facilit'ies located in McFadden Street between H.E.S. 95+00 and 103+50. Install new 8" steel water main and associated facilities in McFadden Street overcrossing between H.E.S. 95+00 and 103+50. Abandon approximately 25 feet of 8" water main for adjoining apartment complex. Install approximately 165'feet of 8" PVC water main and associated facilities for adjoining apartment complex. Ail work shall be performed substantially in accordance with Owner's Plans copies of which are on file in the District Office of the Department of Transportation at 120 South Spring Street, Los Angeles, California 90012. Minor deviations from the above-described work may be made and incidental work performed by 'the Owner when mutually acceptable to both parties and upon approval by the State. LIABILITY FOR WORK The existing facilities, described are lawfully maintained in their present location and qualify' for relocation at 100% State expense under Section 703 of the Streets and Highways Code. III. PERFORMANCE OF WORK Owner agrees to perform the herein described work with its own forces and by a contract with the lowest qualified bidder, selected pursuant to a valid competitive bidding procedure; to furnish or cause to be furnished all necessary labor, material, tools and equipment required therefor, and to prosecute said work diligently to completion. IV. PAYMENTS FOR WORK ae The State shall pay its share of the actual cost of the herein-described work within 90 days' of an itemized bill in quintuplicate, signed by a responsible official of Owner's organization, compiled on the basis of the actual cost and expense. The Owner shall maintain records of the actual costs incurred and charged or allocated to the ~roject in accordance with recognized accounting principles. Be It is understood and agreed that the State will not pay for any betterment or increase in capacity of Owner's facilities and that Owner shall give credit to the State for all accrued depreciation on the replaced facilities and fOr the salvage value of any material or parts salvaged and retained or sold by Owner. At the election of the Owner, progress bills'may be submitted for costs incurred not exceeding Owner's recorded costs as of a specific date, less estimated credits applicable to completed work when the recorded costs are sufficient to warrant such billing. The final billing shall be in the form of an itemized statement of the total costs charged to the project, less the credits provided for in the Agreement, and less any amounts covered by progress billings. Detailed records from which the billing is compiled shall be retained by the Owner for a period of four years from the date of the final bill and will be available for verification by State and Federal auditors. 2 ors 7Ut-8945 V. GENERAL COND IT IONS ae Ail costs accrued bY Owner as a result of State's request of February 25, 1986 to review, study and/or'prepare relocation plans and estimates for the project associated with this Agreement may be billed pursuant to the terms and conditions of this Agreement. B · Owner shall submit a Notice of Completion to the District Utility Engineer within 30 days of the completion of the work described herein. Ce It is understood that said highway is a Federal Aid highway and accordingly, FHPM 6-6-3-1 is hereby incorporated into this Agree- ment by reference; provided, however, .that the provisions of any agreements entered into between the State and the Owner pursuant to State law for apportioning the obligations and costs to be borne by each, or the .use of accounting procedures prescribed by the applicable Federal or State regulatory body and approved by the Federal Highway Administration, 'shall govern in lieu of the requirements of said FHPM 6-6-3-1. 2A of 3 Utility Agreement No.7Ut-8945 · ' THE ESTIMATED COST TO STATE FOR ITS SHARE OF THE ABOVE DESCRIBED WORK IS $ 80,000.00 · IN WlT~g~i WHEI~EOF, the above parties have executed this agreement the day and year first above written.
