ZONING ORDINANCE AMENDMENT 87-4, CULTURAL RESOURCES DISTRICT The purpose of the Cultural Resource District is to provide a frame- work for recognizing, preserving and protecting culturally signifi- cant structures, natural features, sites and neighborhoods within the City of Tustin, but largely the area defined as "Old Town". RESOLUTION NO. 88-16 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE NEGATIVE DECLARATION AS ADEQUATE FOR ZONING ORDINANCE AMENDMENT 87-4 INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT ORDINANCE NO. 1001 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF · TUSTIN, CALIFORNIA, ADOPTING ZONING ORDINANCE AMENDMENT 87-4 AMENDING PART 5 AND 7 OF' CHAPTER 2, ARTICLE 9 OF THE TUSTIN MUNICIPAL CODE AS IT RELATES TO CULTURAL RESOURCES 1. Recommendation: It is recommended by the Community Development Department that the City Council take one of the following approaches: A. Should the City Council agree with the recommended Ordinance and its provisions: 1. Adopt Resolution No. 88-16 verifying the Negative Decla- ration for the proposed project as adequate. 2. M. ShoUld the City Council wish to modify the proposed ordi- nance and its provisions, it is recommended they refer the matter back to the Planning Commission for comments, and a report of any modifications requested by the Council II. It is recommended that the City Council independently: A. Instruct staff to solicit consultant proposals for prepara- tion of a Cultural Resources inventory of the City and to prepare voluntary Architectural Guidelines for residential and commercial uses in Old Town as authorized and budgeted in fiscal year 1987-88. B. Instruct staff to advertise for appointments .to Cultural Resources Committee. 4. PROPOSED LA COLINA/BEVERLY GLEN ANNEXATION NO. 142 TO THE CITY OF TUSTIN *Annexation No. 142 was initiated by the Tustin City Council on March 2, 1987, in resPonse to residents living in the area. The area is generally bounded by La Col ina on the south, the Tustin Ranch on the east, Beverly Glen Drive and lots fronting on Theta Road on the north, and a line drawn parallel with and approximately 500 ft. westerly of Browning Avenue on the west. The area is developed with 140 single family residences, approximately 351 registered voters with an estimated population of 532. Recommendation: It is recommended that the City COuncil: 1. Open public hearing. 2. Summarize the Determination made by LAFCO's resolution. 3. Receive and file written protests. 4. Accept public testimony. 5. Ask if anyone else wishes to submit a writ'ten protest or to withdraw a protest previously filed. 6. Close the public hearing (or continue the public hearing until the next meeting to preserve the possibility of additional protests, or withdrawal of protests, if the Council so desires). 7. Direct staff to certify the value of written protests and report back at the City Council's March 21, 1988, meeting or as soon thereafter as possible. 8. Direct staff to draft an appropriate resolution based on per- centage of protests certified. 5. ZONING ORDINANCE AMENDMENT 87-5 TO ALLOW CHURCH USES IN THE PLANNED INDUSTRIAL DISTRICT (PM) ORDINANCE NO. 1003 - AN ORDINANCE OF TilE CITY COUNCIL OF TIlE CITY OF TUSTIN, CALIFORNIA, ADOPTING ZONING ORDINANCE AMENDMENT SECTION 9241 (b.) OF PART 4 OF CHAPTER 2, ARTICLE 9, OF THE TUSTIN CITY CODE TO ALLOW CHURCHES IN THE PLANNED INDUSTRIAL (PM) DISTRICT SUBJECT TO A · CONDITIONAL USE PERMIT CITY COUNCIL AGENDA PAGE 2 3-7-88 At the Planning Commission meeting of February 8, 1988, the Commission recommended to the City Council the approval of subject Zoning Ordinance Amendment which' would allow church uses in the Planned Industrial District' (PM) subject to a Conditional Use Permit. This amendment was prepared in response to a request from Vineyard Christian Church to occupy a tenant space in an existing industrial complex located at the corner of Sixth and "B" Street. Recommendation' M. O. - That Ordinance No. 1003 have first reading by title only. M. O. - That Ordinance No. 1003 be introduced. B. Should the City Council wish to modify the proposed ordinance and its provisions, it is recommended they refer the matter back to the Planning Commission for comments, and a report on any modifications requested by the Council. 6. ESTABLISHMENT OF A ~BUILDING PERMIT FEE PROGRAM TO FUND CERTAIN IMPROVEMENTS TO SERVE THE EAST TUSTIN SPECIFIC PLAN AREA The City, in conjunction with the Irvine Company, has considered methods available to finance the expansion of the Civic Center facility, a fire facility to serve East Tustin and widening of Irvine Blvd. and has determined that the most equitable means of financing these improvements would be through a fee program, payable upon issuance of building permits. RESOLUTION NO. 88-12 -- A RESOLUTION OF THE CITY COUNCIL OF TI4E CITY OF TUSTIN ESTABLISHING A FEE PROGRAM TO FUND CERTAIN IMPROVEMENTS TO SERVE THE EAST'TUSTIN SPECIFIC PLAN AREA Recommendation- Adoption of Resolution No. 88-12, establishing a fee program to fund certain improvements in East Tustin. PUBLIC INPUT (At this time members of the public may address the City Council regard- ing any items within the subject matter jurisdiction of the City Council provided that NO action may be taken on off-agenda items unless autho- ri zed by law.) PROPOSED CONTRACT WITH COUNTY OF ORANGE FOR PROVISION OF PUBLIC FACILITIES AND IMPROVEMENTS - 13Tfl YEAR HOUSING AND COI~UNITY DEVELOPMENT PROGRAH Approve subject contract as recommended by the Community Development Department. 5. PROPOSED CONTRACT WITH COUNTY OF ORANGE FOR PROVISION OF RHABILI- TATION OF PRIVATE PROPERTIES - 13TH YEAR HOUSING AND CO~4UNITY DEVELOPMENT PROGRAH Approve subject contract as recommended by the Community Development Department. 6. PLANNING ~ISSION REQUEST FOR 7:00 P.M. MEETING TIME Direct staff to prepare an Ordinance to modify the regular Planning Commission meeting time from 7:30 p.m. to 7:00 p.m. as recommended by the Community Development Department. 7. HOLD HARMLESS AGREEMENT FOR USE OF ANAHEIM STADIUM PARKING LOT Approve execution of the proposed Hold Harmless Agreement with the City of Anaheim for use of Anaheim Stadium parking lot in connection with driver training for police motorcycles as recommended by the Police Department. 8. EASTERN TRANSPORTATION CORRIDOR ANALYSIS Authorize a supplemental budget appropriation in the amount of $10,150.00 from general fund monies for the completion of the Eastern Transportation Corridor Analysis currently being performed by the Cities of Tustin, Irvine and Orange, and the I rv i ne Company as recommended by the Publ i c Works Department/Engineering Division. 9. PROFESSIONAL SERVICES AGREEMENT FOR DESIGN OF STORM DRAINS IN PROSPECT AVENUE AND IN EDINGER AVENUE Approve subject professional services agreement with GPS Consulting Civil Engineers and authorize execution by Mayor and City Clerk as recommended by the Public Works Department/ Engineering Division. 10. RESOLUTION NO. 88-27 - A'RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION (SLURRY SEAL PROJECT, 1987-88 FISCAL YEAR) Adopt Resolution No. 88-27 as recommended by the Public Works Department/Engineering Division. 15. JOHN WAYNE AIRPORT NOESE MONITORING PROGRAM - STATUS REPORT An ongoing status report on the John ~ayne Airport Noise Monitoring Program. REQUEST FRON TUSTIN HISTORICAL SOCIETY FOR USE OF VACANT WATER DEPARTMENT BUILDING AT 245 ,MAIN STREET The Tustin Historical Society on January 18 requested that the City explore the feasibility of donating the currently vacant Water Department building at 245 Main Street to permit relocation of the Historical Society's museum. Recommendation: Receive and file. 3. NEWPORT/McFADDEN AVENUE UNDERGROUND UTILITY DISTRICT NO. 10 On January 18, 1988, the Council held a Public Hearing on this item and adopted Resolution No. 88-6 establishing Underground Utility District No. 10. Council raised a concern about the property owners in the previous E1 Camino Real Underground Utility District No. 5 being required to fund the cost of the conversions. ecommenda~t]on,' Pleasure of the City Council.j IX. NEW BUSINESS ' ...... _ , City staff was approached in early January:by Mr. Cliff~Pohlson of the Boy's and Girl's Club of Tustin and Mr. James Kinder, President of the Championship Kart Racing Association requesting that the City host a mini-Grand Prix Kart Race to be held over the 4th of July weekend on a City street course of approximately 1/2 mile. Staff does not currently, feel that it is feasible from the City's perspec- tive to hold a Kart Racing event on the 4th of July weekend. Recommendatioh: Receive and file. 2. AWARD OF CONTRACT FOR WATER PLAIN IMPROVENENTS ON HYRTLE AVENUE, "C" STREET, KENNETH DRIVE AND KEITH PLACE Recommendation: Award the contract for subject project to R.L.T. Construction, Inc. of Santa Ana, California, in the amount of $160,797.50. X. REPORTS "~ COI~ISSION ACTION AGENDA- FEBRUARY 22, 1988 All actions of the Planning Commission become final unless appealed by the City Council or member of the .public. SYCAMORE AVENUE TRAFFIC ENGINEERING STUDY Recommendation: Pleasure of City Council~ 6. REPORT ON REQUEST FOR SPECIAL SIGNING AT AJ_L SIGNALIZED INTERSEC- TIONS WITHOUT PROTECTED LEFT-TURN PHASES Recommendation: Special signal signs with the message "Left Turn Yield on Green Ball" should not be installed at all signalized intersections within the City. The signs should be installed only at intersections where a Permissi ve/Protected or a Protected/Permissive type of signal phasing exists. Since the City is-phasing out its Permissive/Protective type of signals, the special signs would be installed as an interim measure only at the locations where protected left-turn phases are warranted. They would be removed after exclusive left-turn arrows are installed as recommended by th6 Public Works Department/ Engineering Division. 7.
