HomeMy WebLinkAboutPH 4 I-5 FWY WIDENING 03-21-88 PUBLIC HEARING DATE: ~C~ 11~ 1988 ~0~%~ I TO: WILLIAM HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: PUBLIC HEARING - SANTA ANA FREEWAY (I-5) FREEWAY WIDENING AGREEMENT RECOMMENDATION: That the Tustin City Council at their meeting of March 21, 1988 follow the procedures/recommendations listed below: 1. Open the public hearing on the widening of that portion of the Santa Ana I-5 Freeway between Jamboree Road and Newport Avenue. 2. Receive public input/testimony on said project. 3. Close 'public hearing. 4. Approve said freeway agreement between the State and the City of Tustin for the Santa Ana route 5 freeway widening, City street and ramp modifications along route 5 between Jamboree Road and Newport Avenue and authorize the Mayor to execute said Agreement, in accordance to the provisions of Section 100.22 of the Street and Highway Code. BACKGROUND: · The attached Freeway Agreement supersedes previous Freeway Agreements dated 6-29-54 and 1-13-59 which pertain to those portions of the Santa Ana Freeway within the Tustin City limits. Prior to the commencement of any freeway construction project within the limits of a local jurisdiction, Caltrans requires the execution of a Freeway Agreement such as the attached document. DISCUSSION: The attached agreement covers only that portion of State highway within the Tustin City limits between Jamboree Road and Newport Avenue. It provides for the City's consent for the relocation of City streets, construction of frontage roads and other construction affecting City streets. The cost of all changes to City streets will be borne by the State. - PUBLIC HEARING - SANTA ANA FREEWAY (I-5) FREEWAY WIDENING AGREEMENT March 11, 1988 Page 2 The subject agreement has been reviewed by both the Engineering Staff and the City Attorney's office and found to be acceptable for City Council approval and execution. Bob Ledende~ker Director Public Works/City Engineer BL:bf Attachment 12-ORA-5 27.6/29.6 In the City of Tustin between Jamboree Road and Newport Ave FREEWAY AGREEMENT THIS AGREEMENT, made and entered into on this i9~, by and between the State of California, day of acting by and through the Department of Transportation (herein referred to as "STATE"),. and the City of Tustin (herein referred to as "CITY"). WITNESSETH: WHEREAS, the highway described above has been declared to be a Freeway by Resolution of the California Transportation Commission on July 15, 1952; and WHEREAS, STATE and City of Tustin have entered into a Freeway Agreement Dated June 29, 1954, relating to that portion of State Highway Route 5 from First Street to E1 Toro Road (formerly Niguel Road); and WHEREAS, STATE and City of Tustin have entered into a Freeway Agreement dated January 13, 1959 relating to that portion of State Highway Route 5 from E1 Toro Road (formerly Niguel Road to the Santa Ana city limits near First Street; and WHEREAS, STATE and CITY have entered into a Freeway Agreement dated January 15, 1962 relating to that portion of State Highway Route 5 from the easterly city limit of Tustin at Red Hill Avenue to the westerly city limit of Tustin near Route 55; and WHEREAS, STATE and CITY have entered into a Freeway Agreement dated March 17, 1986 relating to .that portion of State [qighway Route 5 from Jamboree Road (formerly Myford Road) to 0.5 mile north.of Jamboree Road; and WHEREAS, a revised plan map for such freeway has been prepared showing the proposed plan of the STATE as it affects streets of the CITY; and WHEREAS, it is the mutual desire of the parties heret° to enter into a new Freeway Agreement in accordance with the revised plan of said freeway; -2- NOW THEREFORE, it is agreed: 1. This Agreement supersedes insofar as it applies to CITY that portion of said Freeway Agreements dated June 29, 1954 and January 13, 1959 from 0.5 mile north of Jamboree Road to Newport Avenue. 2. This Agreement supersedes that portion of said Freeway Agreement dated January 15, 1962 from Redhill Road to Newport Avenue and supersedes in its entirety said Freeway Agreement dated March 17, 1986. 3. CITY agrees and consents to the closing of City streets, relocation of CITY streets, construction of frontage roads and other local roads ahd other construction affecting CITY streets, all as shown on sai~ plan map attached hereto marked Exhibit A and made a part hereof by this reference. 4. STATE shall, in construction of the freeway and at STATE's expense make such changes affecting CITY streets in accordance with the plan map attached hereto marked Exhibit A. -3- 5. STATE agrees to acquire all necessary right-of-way as may be required for construction, reconstruction, or alteration of CITY streets, frontage roads, and other local streets, and CITY hereby authorizes STATE to acquire in its behalf all such necessary right-of-way. 6. It is understood between the parties that the right-of-way may be acquired in sections or units, and that both as to the acquisition of right-of-way and the construction of the freeway projects, the obligations of STATE hereunder shall be carried out at such time and for such unit or units of the project as funds are budgeted and made lawfully available for such expenditures. 7. CITY will accept control and maintenance over each of the relocated or reconstructed CITY streets, and the frontage roads, and other STATE constructed local streets on receipt of written notice to CITY from~ STATE that the work thereon has been completed, except for any portion which is adopted by STATE as a part of the freeway proper. CITY will accept title to the portions of such roads lying outside the freeway limits, upon relinquishment by STATE. S. This agreement may be modified at any time by the mutual consent of the parties hereto, as may become-necessary for the best accomplishment, through STATE and CITY cooperation, of the whole freeway project for the benefit of the people of the STATE and of the CITY. IN WITNESS WHEREOF, the parties-hereto have caused this Agreement to be executed by their respective duly authorized officers.
