MYRTLE AND 14581 YORBA STREET ZONING: PUBLIC AND INSTITUTIONAL (P & i) AND PROFESSIONAL OFFICE (PR) ENV I RONNENTAL STATUS' CATEGORICALLY EXEMPT, CLASS 15 RECOMMENDATION It is recommended that the City Council approve Tentative Parcel-r4ap 87-412 by the adoption of Resolution No. 88-29, as submitted or revised. BACKGROUND The Planning Commission reviewed and recommended the the City council approval of Tentative map to the City Council at their meeting on February 22, 1988. The proposed map would consolidate two parcels currently owned by Continental Medical Systems into one 2.49 acre lot. One parcel located at 165 N. Myrtle contains a 17,140 square foot hospital facility with 57 beds. The second parcel contains a 3,740 square foot administrative office building and an accessory storage garage at 14581 Yorba Street. As shown on the attached map, both parcels are adjacent to one another. The office building was converted from residential use to 'office use by the hospital in August 1983. Both lots are currently owned by the applicant. MYRTLE AND 14851 YORBA STREET. The Planning Commission of the City of Tustin does hereby resolve as fol 1 ows- I. The Planning Commission finds and determines as follows' A® That Tentative Parcel Map No. 87-412 was submitted to the Planning Commission pursuant to Ordinance No. 847 by K. W. Lawler & Assoiciates, Inc. on behalf of Western Neuro Care Center and Continental Medical Systems, requesting authorization to consolidate two parcels into one for the properties located at 165 N. Myrtle and 14851 Yorba legally described as a portion of the south easterly 19 acres of the subdivision of Felipe Yorba Tract in the City of Tustin, County of Orange, State of California as shown on a map recorded in book 4, page 206 of Miscellaneous Records of Los Angeles County, California. B. That a public hearing, was duly called, noticed and held for said ma p. C. This project is Categorically Exempt, Class 15 from the requirements of the California Environmental Quality Act for the subject project area. D. That the proposed subdivision is .in conformance with the Tustin Area General Plan and Subdivision Map Act. E. That the design of the subdivis-ion not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat. F. That the design of the subdivision proposed 'will not conflict with. easements acquired by the public-at-large, for access through or use of the property within the proposed subdivision. I. PASSED AND ADOPTED_At a regul~¥r m,,eeting of the Tustin Planning Commission, held on the ~,~Xday of ~_~-J~/~. _ , 1988. -Penni Foley, ~J Secretary Chairman EXH ISIT A TO RESOLUTION ~10. 2469 CONDITIONS OF APPROVAL FOR TENTATIVE PARCEL MAP 87-412 PUBLIC/PRIVATE INFRASTRUCTURE IHPROVEHENTS 1.11 Any damage done to existing street improvements and utilities shall be repaired before acceptance of the tract and/or issuance of a Certificate of Occupancy for development on the parcel. 1.13 Prior to any work in the public right-of-way, an Excavation Permit must be obtained {and applicable fees paid) from the Public Works De par tmen t. GRAD I NG/DRA INAGE 2.1 All necessary information shall be provided to the State Building Official as required by the State of California. All necessary grading, demolition 'and construction perlnits shall be obtained prior to construction. 2.2 Presentation of a sedimentation and erosion control plan for all construction work related to the subject parcel including a method of control-to prevent dust and windblown earth problems. This plan shall be reviewed and approved prior to rough grading of the site. 2.3 A qualified paleontologist/archealogist, as appropriate shall be present during rough grading operations. If resources are found, work shall stop in the affected area and all resources shall be excavated or preserved as deemed appropriate -or as recommended by the paleontologist/archealologist subject to review and approval by the Department of Public Works and Community Development. All "finds" shall be reported immediately to the Department of Community Development.. The paleontologist/archealogist shall attend the pregrade construction meeting to ensure that this condition and necessary procedures in the event of a "find" are explained. 2.4 All earthwork shall be performed in accordance wi th the State of California, City of Tustin Municipal Codes and grading requirements. FIRE DEPARTMENT 3.1 The subdivider shall comply with all requirements of the State and Orange County Fire Marshal, including required fire flow, installation where required of fire hydrants subject to approval as to location by the Fire Deparl~nent, City of Tustin Public Works Department and Irvine Ranch Water District, and compliance with all requirements pertaining to construction. Resolution No. 2469 Exhi bi t A Page two NOISE FEES · 3.2 ¢.1 5.1 Prior to issuance of building permits for combustible construction, evidence that adequate water supply and operational fire hydrants are available for fire protection is available shall be submitted and approved by the State and Orange County Fire Marshal. The subdivider shall also submit water improvement plans for approval of the Fire Marshal. All construction operations including engine warm up shall be subject to the provisions of the City of Tustin Noise Ordinance and shall take place only during the hours of 7:00 a.m. until 6:00 p.m., Monday through Friday unless the Building Official determines that said activity will be in substantial conformance with the Noise Ordinance and the public health and safety will not be impaired subject to application being made at the time the .permit for the work is awarded or during progress of the work.. Prior to issuance of any building permits, payment shall be ,nade of all applicable, required fees including- A. Major thoroughfare and bridge fees to Tustin Public Works Department. B. Sanitary sewer connection fee to Orange County Sanitation District. C. Grading planchecks and permit fees to the State of California. D. All applicable Building plancheck and permit fees to the State of Cal.i fornia. E. New development fees to the Community Development Department. F. School facilities fee to the Tustin Unified School District. GENERAL 6..1. 6.2 Within twenty four mJnths from Tentative Parcel 14ap approval, the Subdivider shall file with appropriate agencies, a Final ~4ap prepared in accordance with subdivision requirements of the Tustin Municipal Code, the State Subdivision Map Act, and applicable conditions contained herein. Prior to Final Map approval, subdivider shall sub,nit a current title report. All requirements of the State Subdivision Map Act, the City's Subdivision Ordinance and Zoning Ordinance shall be satisfied. Subdivider shall submit a duplicate mylar of the Final Map, or 8 1/2 inch by 11 inch transparency of each map sheet prior to final map approval and "as built" grading, landscape and improvement plans prior to certificate of acceptance. All easements of record shall be shown on the Final Map. MYRTLE AND 14851 YORBA STREET. The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: A. That Tentative Parcel Map No. 87-412 was submitted to the Planning Commission pursuant to Ordinance No. 847 by K. W.
