HomeMy WebLinkAboutCC 7 UNDERGD UTIL DIST 3-21-88..... .,.= ..; . ,-,-..- ,~ CONSENT CALEN OAR TO: WILLIAM HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SU 8d EOT: NEWPORT AVENUE/MCFADDEN AVENUE UNDERGROUND UTILITY DISTRICT NO. 10 RECOMMENDATION: That the Tustin City Council at their March 21, 1988 meeting pass and adopt the attached Resolution setting a hearing date and time for a public hearing regarding the Newport Avenue/McFadden Avenue Underground Utility District No. 10. BACKGROUND: On January 18, 1988, the Tustin City Council held a public hearing on the subject Underground Utility ~District and subsequently order the formation of said District" No. 10. As a part of the original public hea~ing and Engineer's Report it was recommended that the cost of the private property service conversions be borne by the Redevelopment Agency. As a result of this recommendation, it is possible that the property owners may not'have deemed it necessary to appear at the public hearing ~ue to no apparent financial impact to their property. It is the opinion of the City Attorney's office that if the property owners are required to be responsible for the cost of the service conversions that a new public hearing will be required so that they may provide their input/testimony on that basis. DISCUSSION: The attached Resolution sets a time and date for said required hearing as 7:00 P.M., April 18, 1988 at the City Council Chambers at 300 Centennial Way, Tustin. The notice of this hearing will be provided to the affected property owners by United States mail along with a copy of the Revised Engineer's Report .a minimum of ten days prior to the date of the hearing. dend~cker Director Public Works/City Engineer BL:bf Attachment 1 9_ 5 6 7 8 9 10 11 19. 13 14 15 16 17 18 19 20 21 25 9.6 27 28 RESOLUTION NO. 88-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN DECLARING ITS INTENTION TO ORDER THE FORMATION OF UNDERGROUND DISTRICT NO. 10 ON NEWPORT AVENUE BETWEEN WALNUT AVENUE AND THE SANTA ANA FREEWAY, AND ON McFADDEN AVENUE BETWEEN NEWPORT AND WALNUT AVENUES AND SETTING A PUBLIC HEARING THEREFOR WHEREAS, Article 7, Chapter 5, of the Tustin City Code authorizes the City Council from time to time to call public hearings to ascertain whether the public necessity, health, safety or welfare require the removal of poles, overhead wires and associated overhead structures within certain designated areas of the City and to consider the underground installation of the aforementioned appurtenances for supplying electric, communication, or similar associated services to the residents of the City of Tustin; and WHEREAS, by the aforementioned Article 7, Chapter 5 of the Tustin City Code, the City Clerk is required to notify all affected property owners, if any, as shown on the last equalized assessment roll and also to notify all concerned utilities by mail ~f the time and place of hearings to determine whether to form an Underground Utility District and of the availability of the City Engineer's report of the details of the District in the office of the City Clerk; and WHEREAS, said notice is required to be given to the aforementioned property owners and concerned utilities at least ten (10) days prior to the date of the public hearing; and WHEREAS, the City Engineer has advised that his revised report will be on file in the office of the City 'Clerk at least ten (10) days prior to the date of the public hearing; and WHEREAS, the City Council has determined that a second public hearing should be set on April 18, 1988, at the hour of 7:00 P.M. in the City Council Chambers at 300 Centennial Way in the City of Tustin to discuss the cost responsibility of the private property utility service conversions. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said Council hereby sets Monday, April 18, 1988, at 7:00 P.M. in the City Council Chambers at 300 Centennial Way in the City of Tustin, California, as the time and place for a public hearing to ascertain the cost responsibility of the private property utility service conversions which are generally located on Newport Avenue 1 2 5 6 ? 8 9 10 11 12 15 16 17 18 19 20 21 22 26 27 2~ between Walnut Avenue and the Santa Ana Freeway and on McFadden Avenue between Newport Avenue and' Walnut Avenue, more· particularly described in Exhibit "A" attached hereto and on that certain map on file in the office of the City Clerk and the City Engineer of the City of Tustin. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized to notify all affected property owners, if any, as shown on the last equalized assessment roll and to also notify all utilities affected by this proposal by a notice through the United States mail of the time and place of said hearing, and of the availability of the City Engineer's report of the details of the District in the office of City Clerk prior to said hearing, ten (10) days prior to the date thereof.
