SUBJECT: FEASIBILITY STUDY FOR VACATING A PORTION OF SAN JUAN STREET
RECOMMENDATION:
That the Tustin City Council at their meeting of March 21, 1988 approve
the amendment to Agreement No. 12-002 and authorize the Mayor to execute
said Agreement.
BACKGROUND:
On December 7, 1987, Caltrans and the City of Tustin entered into an
agreement which defined the terms and conditions under which a
feasibility study for vacating a portion of San Juan Street adjacent to
Tustin High School would be completed.
It has been determined that the feasibility study will not be completed
by the termination of said Agreement which is March 31, 1988.
DISCUSSION:
The attached document is an amendment to the previous Caltrans/City
Agreement which amends the termination date from March 31, 1988 to
September 30, 1988. This six month extension will more than adequately
dover the time required to complete the feasibility study.

THIS AMENDMENT TO AGREEMENT, ENTERED INTO ON , 19 ,
is between the STATE OF CALIFORNIA, acting by and through its
Department of Transportation, referred to herein as STATE, and
CITY OF TUSTIN
a body politic and a municipal
corporation of the State of
California, referred to herein
as "C ITY"
RECITALS
1. The parties hereto entered into Agreement No. 12-002
(Document No. 6276) on December 7, 1987, said Agreement defining the
terms and conditions under which a feasibility study for vacating a
portion of San Juan Street adjacent to Tustin High School is to be
conducted, referred to herein as PROJECT.
2. It has been determined that the PROJECT may not be
completed prior to the termination date of said Agreement.
IT IS THEREFORE MUTUALLY AGREED:
1. That Section III, Article 9 of the original Agreement is
amended to read "That this Agreement shall terminate upon acceptance
of the PROJECT by STATE and CITY or on September 30, 1988, whichever
is earlier in time.
2. The other terms and conditions of said Agreement shall
remain in full force and effect.

3. This Amendment to Agreement is hereby deemed to be part
of Agreement No. 12-002 (Document No. 6276).
