Open public hearing scheduled for 7:00 P.M., April 18, 1988. 2. Receive public testimony concerning only the format for the method of funding private property service conversions. 3. Close public hearing. 4. Determination of funding source for private property service conversions at the pleasure of the City Council. .ACKGROUND: On March 21, 1988, the Tustin City Council adopted Resolution No. 88-34 setting the time and ~lace for a public hearing on Underground Utility District No. 10 at 7.00 .P.M., Apri~ ~8~ 1988 at the Tustin City Council Chambers at 300 Centennial Way, Tustin. The need for a second public hearing on this District No. 10 was necessitated by the City Council's desire to fund the private property service conversions by means other than the originally proposed Redevelopment Agency funding. A copy of the Revised City Engineer's Report is attached for information. DISCUSSION: This District contains three private properties which require the overhead electrical and/or telephone services to be converted to underground services. The Staff's original proposal suggested these conversion costs be borne by the Redevelopment Agency (South-Central Project Area). This funding format was not acceptable to the City Council and the following funding vehicles are suggested. Private property owners fund conversion costs at the time said work is performed by their contractor. City forms an Assessment District for said work and assesses each property owner on an annual basis for a period of ten years and a current rate of interest. This would be similar to the E1 Camino Real Underground Assessment District. Bob Ledendecker Director of Public Works/City Engineer REVISED CITY ENGINEER'S REPORT NEWPORT/MCFADDEN AVENUE UNDERGROUND UTILITY DISTRICT NO. 10 March 9, 1988 At their meeting of December 7, 1987, the City Council of the City of Tustin, California passed and adopted Resolution No. 87-148 calling for a public hearing at 7:00 P.M. on January 18, 1988, to consider the merits of establishing an underground utility district along Newport Avenue between Walnut Avenue and the Santa Aha Freeway, and along McFadden Avenue between Newport Avenue and Walnut Avenue, and more particularly described and shown on Exhibit "A" attached hereto. Meetings have been held with both the Southern California Edison Company and Pacific Bell to determine costs involved. American Cable Systems has some overhead facilities within the district, but per te~ms of the City's Franchise Agreement with American Cable, they will be required to underground these facilities at no cost to the district. Funding will be provided by the Edison Company with Rule 20A funds for their company owned facilities. The City of Tustin or the Tustin Community Redevelopment Agency will provide funding for approximately eight additional street lights and 200' + of supplementary conduit which are not eligible for Rule 20A funds. The estimated cost of the proposed underground work within the public right-of-way is as follows: Edison Company costs for conduit, structure, and cable (Rule 20A) City/RDA costs for additional street lights, and conduit $333,800.00 12,000.00 Three property owners will require conversion of their overhead services to underground facilities and are deemed responsible for said costs. The estimated costs for the on-site service conversions are as follows: 17341 McFadden Avenue (A.P. 402-331-16) Residence (1-telephone service) -$ 900.00 14081 Newport Avenue (A.P. 402-371-04) Alta-Dena Dairy (1-telephone & 2-electrical) $ 1,950.00 14391 Newport Avenue (A.P. 402-152-04) Gas Station (1-telephone & 1-electrical) $ 1,400.00 NEWPORT/MCFADDEN AVENUE MARCH 9, 1988 PAGE 2 This district will provide for the undergrounding of all overhead Edison distribution facilities (12 kV circuit) and related services within the boundaries of the district as described in Exhibit "A". In conjunction with the undergrounding of these distribution facilities, the Edison Company will also be rerouting their high voltage (66kV) transmission lines. This rerouting will entail the removal of all existing transmission lines, poles, and associated structures along Newport Avenue north of Walnut Avenue and along McFadden Avenue east of Walnut Avenue to Newport Avenue. The new routing for the 66kV transmission line will be along McFadden Avenue west of Walnut, then along Walnut Avenue from McFadden to across Newport Avenue to connect with existing transmission facilities on Walnut Avenue east of Newport. To support these lines, four new tubular steel transmission poles will be installed and located as follows: one pole on the south side of McFadden just west of Walnut, two poles on the northerly side of Walnut Avenue between McFadden and Newport, and one pole on the northerly side of Walnut Avenue, just east of Newport. In summary, this district will provide for the removal of all poles with overhead wires within its boundaries with the exception of the four new tubular steel transmission poles and lines mentioned above. A total of 28 wood utility poles (distribution ;and transmission) will be removed, including four poles with existing street lights. There will be 12 new marblelite street light poles installed with underground wiring and 16,000 lumens high pressure sodium vapor lamps. No. 43197 1 2 4 5 6 7 8 9 10 11 13 14 15 16 17 18 19 2O 22 23 24 97 28 RESOLUTION NO. 88-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN DECLARING ITS INTENTION TO ORDER THE FORMATION OF UNDERGROUND DISTRICT NO. 10 ON NEWPORT AVENUE BETWEEN WALNUT AVENUE AND THE SANTA ANA FREEWAY, AND ON MCFADDEN AVENUE BETWEEN NEWPORT AND WALNUT AVENUES AND SETTING A PUBLIC HEARING THEREFOR WHEREAS, Article 7, Chapter 5, of the Tustin City Code authorizes the City Council from time to time to call public hearings to ascertain whether the public necessity, health, safety or welfare require the removal of poles, overhead wires and associated overhead structures within certain designated areas of the City and to consider the underground installation of the aforementioned appurtenances for supplying electric, communication, or similar associated services to the residents of the City of Tustin; and WHEREAS, by the aforementioned Article 7, Chapter 5of the Tustin City Code, the City Clerk is required to notify all affected property owners, if any, as shown on the last equalized assessment roll and also'to notify all concerned utilities by mail of the time and place of hearings to determine whether to fo~m an Underground Utility District and of the availability of the City Engineer's report of the details of the District in the office of the City Clerk; and WHEREAS, said notice is required to be given to the aforementioned property owners and concerned utilities at least ten (10) days prior to the date of the public hearing; and WHEREAS, the City Engineer has advised that his revised report will be on file in the office of the City Clerk at least ten (10) days prior to the date of the public hearing; and WHEREAS, the City Council has determined that a second public hearing should be set on April 18, 1988, at the hour of 7:00 P.M. in the City Council Chambers at 300 Centennial Way in the City of Tustin to discuss the cost responsibility of the private property utility service conversions. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said Council hereby sets Monday, April 18, 1988, at 7:00 P.M. in the City Council Chambers at 300 Centennial Way in the City of Tustin, California, as the time and place for a public hearing to ascertain the cost responsibility of the private property utility service conversions which are generally located on Newport Avenue 1 2 $ 5 $ ? 8 10 11 12 15 16 1'1 18 19 20 21 22 2~ 25 26 between Walnut Avenue and the Santa Ana Freeway and on McFadden Avenue between Newport Avenue and Walnut Avenue, more particularly described in Exhibit "A" attached hereto and on that certain map on file in the office of the City Clerk and the City Engineer of the city of Tustin. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized to notify all affected property owners, if any, as shown on the last equalized assessment roll and to also notify all utilities affected by this proposal by a notice through the United States mail of the time and place of said hearing, and of the availability of the City Engineer's report of the details of the District in the office of City Clerk prior to said hearing, ten (10) days prior to the date thereof.
