Resolution approving the Engineer's Report; and 2. Resolution of intention to levy annual assessments, annex additional territory, and to set the protest hearing for June 6,1988. aACKGROUND: The Engineer's Report prepared by BSI Consultants, Inc., has been filed with the City Clerk. A total of 18 parcels are proposed for annexation to the District, most of which are in Tustin Ranch, north of Irvine Boulevard. Commercial frontage and local street landscaping are maintained privately by associations, either business owners or home owners. The total amount to be assessed is about five percent (5%) less than the current fiscal year. This is primarily due to bids for landscaping maintenance coming in lower than last year's estimate. NOW, THEREFORE, the City Council of the City of Tustin does hereby resolve as follows: SECTION ~. The report prepared by the Engineer including description of the improvement, estimated costs and diagram, as filed with the City Clerk is hereby approved. SECTION ~. Mayor ATTEST: 28 City Clerk RESOLUTION NO. 88-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, ORANGE COUNTY, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE ANNEXATION OF ADDITIONAL TERRITORY TO AN EXISTING DISTRICT AND TO PROVIDE FOR AN ANNUAL LEVY OF ASSESSMENT FOR THE IMPROVEMENT, MAINTENANCE AND SERVICING OF PUBLIC LANDSCAPING AND LIGHTING FACILITIES WITHIN THE BOUNDARIES OF THE TERRITORY INCLUDED IN THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT AND TO LEVY AND COLLECT ASSESSMENTS PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND GIVING NOTICE THEREOF $ WHEREAS, the City Council by Resolution No. 88-49 initiated 9 proceedings for the annual levy of assessments and annexation of additional territory to an existing district for the Tustin ~0 Landscape and Lighting District pursuant to the provisions of the Landscaping and Lighting Act of 1972 (Part 2, Division 15 of the ~] California Streets and Highways Code); and WHEREAS, by said Resolution No. 88-49, the City Council ordered the City Engineer to prepare a report pursuant to Section 22565 of said Code; and WHEREAS, the City Engineer did prepare and file such a report and the same was approved by the City Council on the 16th day of May, 1988, Resolution No. 88-5.5 l? That the public interest and convenience ~8 require and it is the intention of the City Council of the City of Tustin to order the annexation of additional territory to an ~9 existing district and to order the annual levy of assessments and to levy and collect said assessments pursuant to the provision of 20 said Landscaping and lighting Act of 1972, (Part 2 of Division 15 of said Streets and Highways Code). 9.] SECTION ~. That the improvements to be undertaken consist of the installation, maintenance, servicing and operations of those certain public landscaping and lighting facilities located within the Tustin Landscape and Lighting District. The assessment district designated as Tustin Landscape and Lighting 24 District generally encompasses that portion of the City known as East Tustin, being north of I-5 Freeway and east of Browning 25 Avenue except the areas of all public streets, avenues, lanes, alleys, rights of way, parks and all publicly owned property 26 being used for public purposes, provided, however notwithstanding, property owned by railroad and public utility 27 companies not used for public purposes shall be included in the district and not be excluded pursuant to the aforesaid 28 exceptions. SECTION ~: That said proposed maintenance, servicing and operation of landscaping and lighting, in the opinion of the City Council of the City of Tustin will be to the benefit of the property lying within the described boundaries of the Assessment District, as said Assessment District is described and defined in said Engineer's Report. SECTION ~: Notice is hereby given that Monday, June 6, 1988, at the hour of 7:00 p.m. in the city Council Chambers, 300 Centennial Way, Tustin, California, 92680 are herebY fixed as the time and place where all interested persons may appear before the city Council and be heard concerning the annexation of additional territory to the existing district and the annual levy of assess- ments of the District, the extent of the District, the services to be perfo£med and the proposed assessment and all other matters relating thereto. Protests must be in writing and must be filed with the City Clerk prior to the conclusion of the hearing. Any such protest shall state all grounds of the objection and, if filed by the property owner, shall contain a description sufficient to identify the property. SECTION ~: The City Clerk shall cause notice of the hearing to be given by causing the Resolution of Intention to be posted and published in the manner required by Part 2 of Division 15 of the Streets and Highways Code. ATTEST: Mayor City Clerk 28 ENGINEER'S REPORT FOR TUSTIN LANDSCAPE AND LIGHTING DISTRICT FOR THE 1988-89 FISCAL YEAR BSI CONSULTANTS, INC. 1415 E. 17th Street Santa Ana, California 92701 May 1988 ENGINEER'S REPORT FOR TUSTIN LANDSCAPE AND LIGHTING DISTRICT FOR THE 1988-89 FISCAL YEAR PURPOSE The purpose of this report is to set forth findings and the engineering analysis for the Tustin Landscape and Lighting District for the 1988-89 fiscal year. This district, utilizing direct benefit assessments, will finance the cost of providing maintenance and operation of street and highway landscaping and street lighting in selected areas within the Tustin City limits. II. FINDINGS The City Council of Tustin adopted Resolution No. 85-75 on July 15, 1985 which formed the Tustin Landscape and Lighting District and confirmed assessments for the first fiscal year, 1985-86. This report covers the levy of annual assessments for the 1988-89 fiscal year. It is proposed to annex eighteen (18) parcels to the District. A list of parcels proposed for annexation is included in the appendix as Exhibit "A". The street lighting system in the district consists of 387 lights. A summary by type and size follows: NO. The 1988-89 street and highway landscaping includes parkway landscaping in the Tustin Ranch area, specifically the south side of Bryan Avenue between Browning Avenue and Tustin Ranch Road, the east side of Browning Avenue between Bryan Avenue and E1 Camino Real and the west side of Tustin Ranch Road south of Bryan Avenue. The total landscaped area is 6.89 acres. Part 2 of Division 15 of the Streets and Highways Code, the Landscaping and Lighting Act of 1972, permits the establishment of Assessment Districts by cities for the purpose of providing certain public improvements which include maintenance and operation of street lights and landscaping. The 1972 Act requires that maintenance assessments be levied according to benefit rather than according to assessed value. Section 22573 provides that: "The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements." The Act also permits the designation of zones of benefit within any individual assessment district if "by reasons of variations in the nature, location, and extent of the improvements, the various areas will receive different degrees of benefit from the improvement" (Sec. 22547). Thus, the 1972 Act requires the levy of a true "assessment" rather than a "special tax." III. FINANCIAL ANALYSIS The 1972 Act provides that the total cost can be recovered in the assessment spread including incidental expenses. The latter can include engineering fees, legal fees, printing, mailing, postage, publishing, and all other costs identified with the district proceedings. The estimated expenditures for street lighting in proposed district for the fiscal year are as follows: Street Lighting $39,000 Incidental Expenses 4,700 Total $43,700 the The estimated revenues for the district are as follows: Assessments $43,700 The assessment spread will be based upon $43,700. The estimated expenditures for landscaping maintenance in the proposed district for the fiscal year are as follows: Landscaping Maintenance Incidental Expenses $35,000 4,700 Total $39,700 The estimated revenues for the district are as follows: Assessments $39,700 The assessment spread will be based upon $39,700. IV. ENGINEERING ANALYSIS A. Name The district is entitled "Tustin Landscape and Lighting District." B. Boundary The boundaries of the assessment district are as shown on the Assessment Diagram. All parcels within said boundaries and identified in the latest Orange County Assessor's Parcel Maps are included in the district excepting from the assessment for said costs and expenses within the area described, the area of all public streets, public avenues, public lanes, public Ce De roads, public drives, public courts, public alleys, all easements and rights-of-way, all public parks, greenbelts and parkways, and all public property being used for public purposes. Facilities The facilities or improvements are defined as street lights, street and highway landscaping, their appurten- ances, energy and maintenance costs to operate them. Benefit Analysis All parcels in the district will derive benefit from street lighting and some from landscaping. The intent of this report is to establish a methodology that fairly distributes the cost of the district in relation to the benefits received. Lands and rights-of-way owned by railroads and public utilities are included in this proposed assessment district as permitted by Section 22595 of the Streets and Highways Code. There are 1,034 parcels of property in the district (including annexed, temporary and exempt parcels), all zoned for residential or commercial use. will be broken down for assessment follows: The District purposes, as Zone RI: Zone CI: Zone Ri: Zone R2: Zone CI: Zone L: Residential - without lights, assessed only for lighting incidental expenses. There are 4 parcels in this zone. Commercial, industrial, churches, and undeveloped parcels - without lights, assessed only for lighting incidental expenses. There are 25 parcels in this zone with 699.70 acres. Single family detached residential - with lights, assessed for lighting incidental expenses and lighting costs. There are 443 parcels within this zone. Condominiums, townhouses, and apartments - with lights, assessed for lighting incidental expenses and lighting costs. There are 515 parcels within this zone. Commercial, industrial, churches etc. - with lights, assessed for lighting incidental expenses and lighting costs. There are 39 parcels in this zone with 168.40 acres. Any of the above mentioned areas with City maintained landscaping, assessed for incidentals and landscaping maintenance costs. There are 220 parcels in this zone. Zone E: Exempt property. There are 8 parcels in this zone. This includes publicly owned property. Assessments - Li~htin~ Incidental Expenses Ail parcels in the district will be assessed for the lighting incidental expenses associated with the district (except exempted properties). The method for spreading the incidental cost is on an assessment unit (AU) basis regardless of land use type. The assessment ratio will be one (1) assessment unit (AU) for each single family detached residential unit, 0.75 assessment units for condominiums and apartments and six (6) assessment units for each acre of commercial, industrial, etc. The calculation is as follows: Incidental Expenses = $4,700 Street Lightinq Incidental Expenses RI = 4.00 units x 1 = R1 = 569.00 units x 1 = R2 = 1,764.00 units x 0.75 = CI = 699.70 Acres x 6 = C1 = 168.45 Acres x 6 = 4.00 AU 569.00 AU 1,323.00 AU 4,198.20 AU 1,010.70 AU 7,104.90 AU $4,700 ~ 7,103.90 AU = $0.66 per A.U. Therefore, all parcels in Zones RI, Ri, R2, and C1 will receive an assessment of $0.66 per parcel in Zone RI and R1, $0.49 per unit in Zone R2, and $3.96 per acre in Zone CI and Cl. Assessments - Lightinq Costs Parcels in Zones Ri, R2 and C1 will be assessed for lighting incidental expenses at a rate of $0.66 per assessment unit (AU) plus an assessment for the cost of operating and maintaining the lights in the district. The assessment ratio will be one (1) assessment unit (AU) for each single family detached residential unit, 0.75 assessment units for condominiums and apartments and six (6) assessment units for each acre of commercial, industrial, etc. The calculation is as follows: Lighting Costs = $39,000. Street Lightinq Zone Ri: 569.00 units x 1 = 569.00 AU Zone R2: 1,764.00 units x 0.75 = 1,323.00 AU Zone Ci: 168.45 acres X 6 = 1.010.70 AU 2,902.70 AU $39,000 ~ 2,902.70 AU = $13.44 Per AU Ge Assessments for parcels with local benefit of street lights in Zones Ri, R2, and C1 will be: $13.44 per parcel in Zone Ri, $10.08 per unit in Zone R2, and $80.64 per acre in Zone Cl. However, the complete lighting assessment for these zones will include these amounts plus the lighting incidental costs previously mentioned. Assessments - Landscape Maintenance Costs Parcels in Zone L will be assessed for incidental expenses plus an assessment for the cost of maintaining landscaping in the district. The assessment ratio will be one (1) assessment unit (AU) for each single family detached residential parcel (or unit) and 0.75 assessment units for apartments and condominiums (for this fiscal year, there are no commercial areas included). The calculation is as follows: LandscaDinq Costs Plus Incidental ExDenses = Zone L: 202 parcels (or units) x 1 = 592 Units x 0.75 = $39,700 202 A.U. 444 A.U. 646 A.U. $39,700 ~ 646 A.U. = $61.46 per A.U. Assessments in Zone L would be $61.46 per single family detached residential parcel and $46.09 for each apartment and condominium unit.
