RECOI~ENDATION:
It is recommended that the City Council approve Tentative Parcel Map 88-179 by
adoption of Resolution No. 88-59 as submitted or revised.
BACKGROUND:
On May 9, 1988 the Planning Commission approved Use Permit 88-8 and Design
Review 88-4 for a 62,000 square foot mixed use office and retail center. The
project contained four buildings on a site plan with two distinctive use areas.
This plan incorporated three retail buildings which face Seventeenth Street and
one office building along Vandenberg Lane.
The applicant is processing a Tentative Parcel Map to create two parcels from
the one existing lot. This lot configuration would facilitate separate property
ownership of the retail area by Colco Ltd. and the office portion by First
Fidelity who plans to occupy the majority of the office structure floor space.
The Planning Commission held a public hearing on. May 23, 1988 for the subject
map and adopted Resolution No. 2500 which recommended approval of this map to
the City Council.

Staff reviewed the subject project for conformance with the Tusttn General Plan,
the Zoning Code and the Subdivision Map Act. Specific areas of concern include
parcel accessibility, reciprocal access and parking. These items are discussed
in more detail below.
Parcel Accessibility -Each of the two proposed parcels can be accessed
from two s~parate driveways. Parcel One also includes a future reciprocal
access point with the Safeway Shopping Center'to the east. Additionally, a
reciprocal access drive with the property to the west (Fireman's Fund) has
been deleted from the development plan on Parcel One. This reciprocal
access agreement would be abandoned by the property owners prior to the
recordation'of the Final Map.
Reciprocal Access - The development plan approved by Use Permit 88-8 shows
unrestricted vehicular and pedestrian movement between the office and
retail portions of the center. For this reason, the properties must agree
to a reciprocal parking and access agreement. This agreement must be filed
on both parcels and be recorded with the Final Map.
Parking - The lot configuration, as proposed accommodates each use
separately, i.e., each of the proposed lots contains the required number of
parking spaces for the uses contained on each of the proposed lots.
Therefore, each parcel can stand independently from the other in terms of
parking and access as required by the Zoning Code.
CO#CLUSXO#
Staff has reviewed the proposed Tentative Map for conformance with the Tustin
General Plan, Zoning Code and Subdivision Map Act. The site is suitable for the
development previously approved and the lot configuration proposed on the map
attached hereto. Staff recommends that, with the findings and conditions of
approval contained in the attached Resolution adopted by the Planning
Commission, the City Council adopt Resolution No. 88-59 approving Tentative
Parcel Map 88-179.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY'
OF TUSTIN, RECOMMENDING APPROVAL OF TENTATIVE PARCEL
MAP 88-179 LOCATED ON THE SOUTH SIDE OF SEVENTEENTH
STREET, 370 FEET EAST OF ENDERLE CENTER WAY.
The Planning Commission of the C~ty of Tustln does hereby resolve as
follows:
I. The Planning Commission finds and determines as follows:
That Tentative Parcel Map No. 88-179 was submitted to the
Planning Commission pursuant to Ordinance No. 847 by K. W.
Lawler & Associates, Inc. on behalf of Colco Ltd. requesting
authorization to r,subdivide one parcel into two (2) parcels for
Parcel 2 as recorded in Book 150, Pages 44 and 45 in the Office
of the County Recorder of Orange County.
That a public hearing was duly called, noticed and held for said
map on May 23, 1988.
This project is Categorically Exert, Class 15 from the
requirements of the California Environmental Quality Act for the
subject project area.

That the proposed subdivision is in conformance with the Tustin
Area General Plan, Tustin Zoning Code and Subdivision Map Act,
That the site is physically suitable for the type of development
proposed.
That the site is physically suitable for the proposed density of
development.
That the design of the subdivision or the proposed improvements
are not likely to cause substantial environmental damage or
substantially and avoidably injure fish or wildlife in their
habitat.
That the design of the subdivision or the type of improvements
proposed will not conflict with easements acquired by the
public-at-large, for access through or use of the property
within the proposed subdivision.
I. That the design of the subdivision or the types of improvements
proposed are not likely to cause serious public health problems.

CONDITIONS OF APPROVAL FOR
TENTATIVE PARCEL MAP 88-179
PUBLIC/PR!X~TE INFRASTRUCTURE
(1) 1.! Any damage done to existing street improvements and utilities shall be
{6) repaired before acceptance of the tract and/or issuance of a Certificate of
Occupancy for development on any parcel within the subdivision.
(1) 1.2 Prior to any work in the public right-of-way, an Excavation Permit must be

(1) 1.3 All construction within a public right-of-way and or public easement must be

the Building Official conforming to the requirements of the Uniform
Building Code, City Grading Requirements, and all other applicable state

accuracy of elevations, slope gradients, etc. and may require
certification of any grading related matter.
3. Final street elevations at key locations.
Final pad/finished floor elevations and key elevations for all site
grading.
All flood hazards of record.
Preparation of a sedimentation and erosion control plan for all
construction work related to the subject Tract including a method of
control to prevent dust and windblown earth problems.
Submittal of a construction traffic routing plan to be reviewed and
approved by the Director of Public Works.
Written approval must be obtained from adjacent property owners for
rights-of-entry for construction activity across lot lines.
Preparation of a sedimentation and erosion control plan for all construction
work related to the subject Tract including a method of control to prevent
dust and windblown earth problems.
A precise grading permit shall be issued prior to issuance of any building
permits within the subject Teact.
All earthwork shall be performed in accordance with the City of Tustln
Municipal Codes and grading requirements.

FEES
All construction operations lncludfng engine war= up shall be subject :o the
provisions of the City of Tusttn Noise Ordinance and shall take place only
durtng the hours of 7:00 a.~t unttl $:00 p.m., Monday through Friday unless
the Building Offtcial de:ermines that said acttvtty will be in substantial
conformance with the Notse Ordinance and the publlc health and safety will not
be impaired subject to application being made at the time the permit for the
work ts awarded or during progress of the work.
5.! Prior to issuance of any butldtng permits, payment shall be made of all
required fees including:
A. Major thoroughfare and bridge fees to Tustin Public Norks Department.
B. Sanitary sewer connection fee to Orange County Sanitation District.
C. Grading planchecks and permit fees to the Community Development
Department.
D. All applicable Building plancheck and permit fees to the Community
Development Department.
New development fees to the Community Development Department.
GENERAL
(1) 6.1
School facilities fee to the Tusttn Unified School District subject to
any agreement reached and executed between the District and the Irvine
Company.
Within twenty four months from Tentative Parcel Map approval, the Subdivider
shall file with appropriate agencies, a Final Map prepared in accordance with
subdivision requirements of the Tustin Municipal Code, the State Subdivision
Map Act, and applicable conditions contained herein.
(2) 6.2 Prior to Final Map approval:
Subdivider shall submit a current title report.
Subdivider shall conform to all applicable provisions of the City Code.
All requirements of the State Subdivision Map Act, the City's Subdivision
Ordinance and Zoning Ordinance shall be satisfied.

Subdivider shall submit a duplicate mylar of the Final Map, or 8 1/2 inch
by I! inch transparency of each map sheet prior to final map approval and
"as built" grading, landscape and improvement plans prior to certificate
of acceptance.
Show on the Final Map all easements of record.
The subdivider shall file a reciprocal vehicular and pedestrian access,
an parking easement agreement on both parcels to be reviewed and approved
by the City Attorney and Department of Community Development for both
parcels created by Parcel Map 88-179 noted on the Final Map and recorded
concurrently with'recordation the Final Map.
Subdivider shall abandon the existing vehicular, parking, and pedestrian
access agreement shared with property immediately to the west.
