PUBLIC HEARING FOR EAST TUSTIN ASSESSMENT DISTRICT NO. 85-1
RECOMMENDATION:
That the designated public hearing be conducted on July 21, 1986 at 7:00 p.m., as
noticed by the Tustin City Council. After testimony from the public hearing has
been taken and the City Council determines that the Assessment District No. 85-1
should be confirmed/finalized they should proceed with the following actions:
Approval of the Bond Purchase Agreement
Confirmation of assessments
Certification of CEQA documents
Approval of Final Engineer's Report
Approval of collection period waiver (if required)
Approval of the paying agent
Approval of Utility Agreements (if required)
Approval of the official statement
Issue and sell bonds
Determine unpaid assessments
Approve Resolution of Foreclosure
BACKGROUND:
In April, 1985, The Irvine Company filed a petition for the formation of
Assessment District 85-1 (East Tustin) and the City Council, at their May 6th
meeting, accepted said petition and directed staff to initiate the required
Assessment District proceedings.
On June 16, 1986, the City Council adopted Resolution No. 86-81 and No. 86-83.
Resolution No. 86-81 declared the City of Tustin's intention to order the
formation of the East Tustin Special Assessment District No. 85-1 and the
construction of certain improvements therein. Resolution No. 86-83 approved the
Preliminary Engineer's Report and set the time, date and place of a public hearing
on said Assessment District as follows:

The time and place of this public hearing has been duly noticed as required by
Sections 10301-10309 of the Streets and Highways Code.

On July 14, 1986, the City Council adopted Resolution No. 86-90 approving the
deletion of a portion of a project and the addition of a project in the East
Tustin Assessment District which was requested by the landowner, The Irvine
Company. Additionally, on July 14th the amended Preliminary Engineer's Report
reflecting these changes was approved.
DISCUSSION:
After consideration of testimony at the public hearing, the City Council should
determine whether or not to proceed with the formation of the East Tustin
Assessment District No. 85-1. In order to finalize the said District, the City
Council will need to proceed with the actions as outlined above in the
recommendation section.
After the formation of the District and after the thirty-day comment p~riod on the
environmental document, it is anticipated that the bond closing date will be on or
about August 21, 1986.
The City's Consultant Assessment District Engineer, Willdan Associates, will be
available at the July 21, 1986 meeting to respond to any questions the Council or
public may have.
