HomeMy WebLinkAboutCC 9 UNDERGD DIST. 8 07-21-86- , NO 9 DATE: dULY 14, 1986 TO: WILLIA~I HUSTON, CITY HANAGER FROM: PUBLIC WORKS DEPARTFIENT/ENGINEERING DIVISION SUBJECT: HOLT AVENUE/IRV[NE BOULEVARD UTILITY UNDERGROUND DISTRICT NO. 8 RECOMMENDATION: For the City Council meeting of July 21, 1986. Approve the Southern California Edison Company agreement for replacement of overhead with underground distribution facilities pursuant to Section B of the Utility's Rule No. 20 and authorize the Mayor to execute said agreement. Additionally, authorize the payment of funds in the estimated amount of $35,603.00 to th~ Southern California Edison Company. BACKGROUND: Recently the City Council formed Utility Underground District No. 8 for the purpose of undergrounding all overhead utilities along Holt Avenue between Newport Avenue and Irvi. ne Boulevard and along Irvine Boulevard between Holt Avenue to Newport Avenue. Redevelopment Agency funding in the amount of $55,000 has been budgeted for this undergrounding project. This project is also a joint effort between the Agency/City and a developer, Burnett-Ehline. The developer was required, as a condition of approval of the development at the southeasterly corner of Holt Avenue and Irvine Boulevard, to participate in the utility undergrounding project. The preliminary participation percentages have been identified as the Agency as 32% and the developer as 68%. DISCUSSION: The attached agreement is a Southern California Edison Co. agreement which provides for the Agency/City participation in the project under Section B of the Utility's Rule No. 20. This particular rule provides for the following: 1. Local agency is responsible for the cost of furnishing and installiog the underground structures and substructures (conduits and vaults). Local agency is responsible for the cost of completing the Underground system over building a new equivalent overhead system exclusive of transformers, meters and services. The estimated Agency/City cost per Rule 20B for this project is $35,603.00. This amount will be shared with the developer, Burnett-Ehline, as follows: City/Agency (32%) .............................. $11,393.00 Developer (68%) ................................ $24,210.00 JULY 14, 1986 PAGE TWO This agreement is a standard format document which has been utilized previously on other Rule 20B projects within the City. These previous documents have all been reviewed and approved by the City Attorney's office. It is requested that all five copies be executed by the Major in behalf of the City/Agency. A separate request will be presented to the Redevelopment Agency for the Agency's action to authorize the Tustin City'Council to act in their behalf. Bob Ledendecker Director of Public Works/City Engineer BL:jm Attachment AGREEMENT FOR REPLACEMENT OF OVERHEAD WITH UNDERGROUND DISTRIBUTION FACILITIES (Installation by Utility) THIS AGREEMENT. made this day of. , 19 between SOUTHERN CALIFORNIA EDISON COMPANY, a corporation, hereinafter called "Utility', and the party or parties whose names are subscribed hereunder as 'Applicants', WITNESSETH: WHEREAS. Applicants lmve requested Utility, pursuant to Section B. of Utility's Rule No. 20, Replacement of Overhead with Underground Distribution Facilities, to replace U!ility's existing overhead with undergrotmd distribution facilities at the location or locations in the County of~ Or~n~ State of California, substantially described as follows: Holt Avenue (Between Irvine and Newport) and as shown on the map attached bereto and made a part hereof; and WHEREAS. a. It is necessary for all property owners served from Utility's ovedtead facilities to be removed to a~ree in writing to perform the wiring changes on owners' premises so that service may be furnished from Utility's undergrouud distribution system in accordance with Utility's rules and that Utility may dmcontinue Utility's overhead service upon completion of Utility's underground facilities, or b. Suitable legislation is in effect requiring such property owners to make such necessary wiring changes and authorizing Utility to discontinue Utility's oveHlead service; and WHEREAS. Applicants have requested Utility to fnrnish and install the pads and ~;aults for trunsfont~e~s ,,nd associated equipment, conduits, ducts, boxes, and electrolie~' bases and to perform other work related to structures and substructures including breaking of pavement, trenching, backfilling, and repaying required in connection with installation of the underground system; and WHERE.AS. Underground_service connections to each applicant from Utility's underground distribution system will be installed and maintained as provided in Utility's rules applicable thereto; NOW, THEREFORE, in consideration of the premises, and of the mutual promises and covenants of the parties hereto, hereinafter contained, it is mutually agreed by and between the parties hereto as follows, viz.: 1. Applicants will pay to Utility concurrently with tile execution of this agreement the nonrefundable amount of S 35;~0~, , which is the sum of Sl/4.868. , tile estimated cost of furnishing and installing the underground structures and substructures, including breaking of pavement, trenching, backfilling, and paving required in connection witb installation of the underground system, and of S~, the excess, if any, of the estimated costs, exclusive of transformers, meters and services, of completing tile underground system over building a new equivalent overhead system. Tile amount contributed by each of said Applicants is shown hereinafter. 2. Utility will complete the unde,'grounding of said overhead distribution facilities, pro- vided, however, Utility has been granted rights of way therefor satisf'.actory to and without cost to Utility. 3. Said underground distribution facilities will be and Will remain the pl~operty of Utility. 4. Applicants each agree Applicants will perform necessary wiring changes on Applicants' premises so that service may be furnished from Utility's underground distribution system in accordance witl~ Urflity's rules, and Utility may discontinue Utility's overhead service upon completion of Utility's underground facilities. 5. This contract is subject to the Rules of Utility. 6.
