RESOLUTION NO. 86-88 RECOMMENDATION: For the City Council meeting of July 21, 1986. Request that Item No. 11 be removed from the Consent Calendar and that Parcel Map No. 86-201 be approved, as presented, except for the sidewalk construction requirement. It is further recommended that sidwalks be required on both street frontages of Walnut Avenue and Chambers Road and that the width of sidewalk be reduced from 8.0 feet to 5.0 feet, except at locations where permanent objects exist such as street lights and fire hydrants, where the sidewalk would be widened to provide a minimum clear width of 5.0 feet. BACKGROUND: The Tustin Planning Commission, at their July 14, 1986 meeting, recommended approval of Tentative Parcel Map 86-201 located at 2472, 14451 and 14471 Chambers Road with the adoption of Planning Commission Resolution No. 2346. Condition IIA4 required the installation of sidewalks on both the Walnut Avenue and Chambers Road frontages of the development. DISCUSSION: The developer has requested that the sidewalk widths be reduced to a 5.0 foot width as measured from the curb face in lieu of the full 8.0 foot width per City standards. The development across the street on the southerly side of Walnut Avenue was permitted to install the reduced width sidewalk 5.0 feet in width; staff concurs with the developers request and recommends that the sidewalk width be reduced to a width of 5.0 feet as measured from the curb face, on both street frontages with the following exception: When the sidewalk extends through a permanent object such as a street light, fire hydrant, etc., the sidewalk should be widened to provide a clear width of sidewalk of 5.0 feet minimum. BACKGROUND: This proposed map was part of the original Tustin/Irvine industrial subdivision and was known as Lots 15 and 16 of Tract 8590. This subdivision was recorded in July of 1974. In August of 1979 Tract 10815 was recorded which created a one (1) lot subdivision for condominium purposes for these parcels. ANALYSIS: The owner is now requesting authorization to create three (3) lots from the previous one (1) lot. The total area of the proposed map is 3.029 acres and will be split into three {3) lots with each lot having an existing building and parking spaces provided as follows: Parcel No. Building Area Stalls i 10,930 sq. ft. 44 ea. 2 19,243 sq. ft. 77 ea. 3 10,930 sq. ft. 44 ea. City Council Report TPM 86-20! page ~o According to the city of Tustin Minimum Design Standards for Public Works, house laterals are required for each individual lot or parcel. Because these three (3) buildings were developed on one parcel, they.share a common sewer lateral. The owner wishes to deviate from this standard and his request is attached to this report. The applicant will record a covenant concurrently with the final map which will guarantee proper maintenance of the ~ervice and will provide mutual access rights for all parcels. - A condition placed on the map requires the installation of sidewalks along Chambers and Walnut Street. It has been the policy of both the Council and Commission to require that sidewalks be constructed in the Tustin Industrial Complex to meet the growing pedestrian demand. The applicant requested from the Commission that this condition be removed, but it is not within the purview of the Commission to wholly remove a condition that occurs in the public right of way. The condition requiring the installation of sidewalks remains, but the Commission did recommend that the Council consider a narrower sidewalk, subject to the approval of the City Engineer. The proposed map is in conformance with the Tustin Area General Plan and the Planned Community Guidelines for the Tustin/Irvine Industrial Park. On July 14, 1986 the Planning .Commission recommended approval of this tentative map by the adoption of Resolution No. 2346. The conditions of approval are listed in Resolution No. 86-88. The City Council finds and determines as follows: That Tentative Parcel Map No. 86-201 was submitted to the City Council pursuant to Ordinance No. 847 by J. P. Kapp & Associates on behalf of Signal Development Co. for the purpose of subdividing one (1) lot into three (3) lots of Tract 10815 of Miscellaneous Maps, Book 470, pages 16 and 17. That said map is in conformance with the Tustin 'Area General Plan. Ce That the proposed project is categorically exempt from the requirements of the California Environmental Quality Act; Class 15; Minor Land Div'tsion. II. One For each building and one For the outdoor sprinkler system. Tentative parcel map no. 86-201 plans to subdivide Lot I of Tract 10815 Into 3 separate parcels with one office building per parcel. The Installation of new sewer and water lines to service each parcel would require removal and repair of existing curbs, gutter, and parking areas, we Feel that this Is an unnecessary expense For an office building/professional development. Since the maintenance of the common areas will be coCered under certain conditions of approval we feel that the water and sewer lines could be handled In a similar manner.
