HUSTON, CITY MANAGER NEWPORT AVENUE CROSSING RECOMMENDATION: That the City Council adopt the attached resolution which finds that additional environmental studies are not required in order for the City to apply to the State Public Utilities Commission (PUC) for a grade crossing on Newport Avenue. BACKGROUND: In 1983 the City Council certified an EIR and submitted an application to the PUC for a grade crossing at Newport Avenue. The application was withdrawn by the City as a result of its decision to evaluate the feasibility of a grade- separated crossing. The evaluation demonstrated that a grade-separated crossing is not feasible. The City Council then directed staff to again make application to the PUC for authorization to re-establish a grade crossing on Newport Avenue. Staff has prepared the application and is ready to file it subject to a determination by the City Council that the EIR certified in 1983 is adequate for the current application. As indicated in the resolution, no subsequent changes are proposed in the project which would require additional environmental studies. William A. Huston City Manager WAH:jh Attachment: Resolution No. 86-98 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 271 28 RESOLUTION NO. 86-98 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT NO CHANGES HAVE OCCURRED WITH RESPECT TO THE PROPOSED NEWPORT AVENUE GRADE CROSSING WHEREAS, by application dated April ~ , 1984, the City of Tustin applied to the California Public Utilities Commission to construct a grade crossing across the Right-of-Way of the Atchison, Topeka and Santa Fe Railway Company on Newport Avenue; and WHEREAS, that application was withdrawn by letter dated September 2, 1985, in order that the City might evaluate a grade separation at said site; and WHEREAS, the City later determined that a grade separation was not feasible and that it wished to reapply for permission to establish a grade crossing; and WHEREAS, by Resolution No. 83-68, passed and adopted by the City Council on October 5, 1983, the City Council certified Final EIR 83-1 on said project; and WHEREAS, the City Council has reviewed said EIR in order to determine whether any additional' EIR need be prepared. NOW, THEREFORE, the City Council of the City of Tustin, California, does hereby RESOLVE as follows: ~ 1: No subsequent changes are proposed in the project which will require important revisions of the previous EIR due to the involvement of new significant environmental impacts not considered previously. Section 2: No substantial changes have occurred with respect to the circumstances under which the project is undertaken, which would require important revisions in the EIR due to the involvement of new significant environmental impacts not covered in the EIR.
