COUNTY INCREASE IN ANINAL CONTROL FEES
RECOMFIENDED ACTZON:
That the City Council adopt Resolution No. 86-92 as proposed by the Orange
County Department of Animal Control.
BACKGROUND:
The City of Tustin currently contracts with the Orange County Department of
Animal Control for administration of licensing, inspection, and maintenance
of animal shelter services. Since the County is directly responsible for
animal control services, it is the County who determines the necessary fees
to cover costs of maintenance and operation of the animal shelters. The
County last increased fees and requested the City to adopt this fee
schedule in 1984. As of July 1, 1986, the County Board of Supervisors has
approved fee increases and additional fee items to be effective July 1,
1986. It is now necessary for Tustin to adopt, by resolution, the new fees
and increases.
In summary, the proposed changes include two (2) new fee items and one
increase in fees for late charges on all licenses. The new items include a
$5.00 fee for animal relinquishment services and establishment of a $25.00
fee for quarantine services on private property. The fee increase for late
charges on licensing is from 25% of the license fee to a flat charge of
$10.00 per license. Attached to this transmittal is the County Animal
Shelter and Control Service fee schedule comparing present fees and
proposed increases and additions where applicable (Exhibit 1).

A good license can be sold only for the period
covered by a valid rabies vaccination
certificate acceptable to the California
Department of Health (CA. Admtn. Code. 2606.4).
The reduced fee for a neutered animal will be
allowed only upon presentation of a certificate
of spaying, castration, or of the dog's
inability to reproduce signed by a licensed
veterinarian.
Any person who fails to purchase or renew a
license within fifteen {15) days after it has
become due or expired shall be deemed
delinquent and may be required to pay a late
fee of five dollars ($5.00) in addition to the
prescribed fee.
Once purchased, there will be no refund of
license fees unless it is demonstrated that, at
the time the license became effective, the
animal was not subject to licensing.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TUSTIN, CALIFORNIA,
ESTABLISHING A FEE SCHEDULE FOR ANIMAL
SHELTER AND ANIMAL CONTROL SERVICES AS
PROVIDED BY THE COUNTY OF ORANGE
The City Council of the City of Tusttn does hereby resolve as follows:
Pursuant to Tustin Code Section 4217, the City Council hereby
establishes as the fee schedule for animal shelter and animal control
services the schedule set forth in Attachment "A", which is attached
hereto and incorporated herein as though fully set forth.

A. Definitions:

A large animal is any animal weighing 300 pounds or more.
A medium animal is any animal weighing greater than 50 pounds, but less than
300 pounds.
A dog or cat is any animal defined as such in Ordinance No. 2836.
An animal is as defined in Ordinance Ho. 2836.
A contract city is any municipality that has entered into a contract with the
County of Orange for enforcement of Animal Control and Animal Shelter
Services, or for either of such services.
Actual cost is the actual expense incurred by the County of Orange,
including, but not limited to, salaries, employee benefits, overhead
supplies, animal food, medication, contract services.
A kennel means any property where four (4) or more dogs, or four (4) or more
cats, over the age of four (4) months, are kept or maintained for any purpose
except veterinary clinics and hospitals, and except property for which an
animal permit has been issued pursuant to Section 4-1-76 of the Codified
Ordinances or the ~ounty of Orange.
A pet shop means any person or facility engaged in the sale or trade of live
animals on a commercial basis.
A 9roomin~ parlor means any premises where animals are groomed, brushed,
clipped or bathed on a commercial bases.
An animal rental establishment means a place or facility where animals other
than dogs, cats, or equines are kept or maintained for hire.
A permanent animal exhibition means any property where animals are exposed
for public viewing, for entertainment, instruction or advertisement,
including animal acts, on a regular basis, excluding activities conducted
primarily for the instruction or entertainment of persons for which no
charge, fee or donation is collected or solicited.
A commercial stable means any property where equines are sheltered or fed on
a commercial basis.

A circus means a carnival, tent show or show in the open air, or in a hall or
bui-~T~g not specifically constructed for theatrical purposes, wherein
animals are exposed for public viewing for entertainment, instruction or
advertisement.
A rodeo means any activity or show in which equines or bovines are exposed
for---~'~lic viewing for entertainment, instruction or advertisement, excluding
a permanent animal exhibition, excluding activities conducted primarily for
the instruction or entertainment of persons for which no charge, fee or
donation is collected or solicited.

15. Impounded means having been received into the custody of the Health Officer
of Orange County or his deputy.

A temporary animal exhibition means any activity or property used for the
public viewing of animals for entertainment, instruction or advertisement,
including animal acts of less than a regular basis, excluding'activities
conducted primarily for the instruction or entertainment of persons for which
no charge, fee or donation is collected or solicited.
