RECgI~ENDED ACTION:
Adoption of Resolution No. 86-99 confirming the application of the Master
Property Tax Transfer Agreement to the proposed Diamond Head/Garland Annexation
No. 137.
PROJECT ANALYSIS:
The City Council conducted an advertised public hearing on July 21, 1986 on its
intent to adopt a resolution of application for the island annexation known as
Diamond Head/Garland Annexation No. 137.
Section 99(d) of the Revenue and Taxation Code required the City and County to
approve the exchange of property tax revenue prior to consideration of the
application by the Local Agency Formation Commission.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORIA, CONFIRMING THE APPLICATION OF
THE MASTER PROPERTY TAX TRANSFER AGREEMENT TO THE
PROPOSED DIAMOND HEAD/GARLAND ANNEXATION NO. 137
WHEREAS, a MASTER PROPERTY TAX TRANSFER AGREEMENT BETWEEN THE COUNTY
OF ORANGE AND THE CITY OF TUSTIN TO PROVIDE FOR PROPERTY TAX EXCH&NGE IN
AREAS ANNEXED BY THE CITY dated October'28, 1980, has been executed by the
Board of Supervisors of Orange County and the City Council of the city of
Tustin providing for division of property taxes pursuant to Section 99(d)
of the Revenue and Taxation Code of the State of California; and
WHEREAS, the City Council of Tustin has proposed the annexation of
the inhabited and developed area known as Diamond Head/Garland Annexation
No. 137.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the city of
Tustin that the MASTER PROPERTY TAX TRANSFER AGREEMENT BETWEEN THE COUNTY
OF ORANGE AND THE CITY OF TUSTIN TO PROVIDE FOR PROPERTY TAX EXCHANGE IN
AREAS ANNEXED BY THE CITY providing for the allocation of property tax
revenues, as approved by the Board of Supervisors and the City Council and
entered into on Novembner 18, 1980, shall be applicable to the territory
within the proposed Diamond Head/Garland Annexation No. 137 to the city of
Tustin for the annexation of 26.936 acres as substantially .developed
property.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council
held on the day of , 1986.
