HomeMy WebLinkAboutConsent Calendar #7 8-3-87 N 8-3-87 Inter- Corn TO: WILLINq HUSTON, CITY MA#AGER FROM: CO~HUNITY DEVELOPHENT DEPARTHENT SUBJECT: EXEHPTION FROH #ILLIAI~SON ACT PROVISIONS - NORTlt/SOUTH ROAD RECOI~,IENDED ACTION: It is recommended that the City Counctl direct staff to advise the Director of Conservation of the intention to construct the North/South Road on lands currently within an agricultural preserve. BACKGROUND: Section 51291 of the California Government Code states in part: "Whenever it appears that land within a agricultural preserve may be required by a public agency for public use, the publtc agency shall advise the Director of Conservation of the intention to consider the location of publtc improvements within the preserve. As considered in recently certified Environmental Impact Report 87-1 the proposed alignment of the North/South Road does traverse lands within an agricultural preserve. Construction of the project is scheduled for October, 1987. However, a notice of non-renewal of preserve contracts have been filed and the existing agreement have a termination date of January, 1988. Within 30 days after receiving notice of the City's intent, the Director of Conservation must forward comments on the proposed action. These con~nents shall be considered by the Council in conjunction with subsequent actions such as approval of the final project (i.e. avoid any construction bids). DISCUSSION: To comply wtth Section 51291 of the Government Code, it is recommended that Council direct staff to advise the Director of Conservation of its intent to accept dedication of lands within the preserve area for a publtc roadway and the intent to construct the North/South Road.
