ENVIRONHENTAL STATUS: ZONING: REQUEST: A NEGATIVE DECLARATION WAS PREVIOUSLY APPROVED FOR THIS PROJECT. HULTIPLE-FANILY RESIDENTIAL R-3-2,000 AUTHORIZATION TO SUBDIVIDE 3 LOTS INTO 19 NUMBERED LOTS AND 3 LETTERED LOTS RECO~ENDATION: Approve Tentative Tract No. 12855 by the adoption of Resolution No. 86-108. BACKGROUND: Specific Plan No. 6 was adopted by the City Council in 1981. This specific plan was adopted to ensure orderly development for the area easterly of Holt Avenue between Warren Avenue on the north and the flood control channel on the south. On August 11, 1986, the Planning Commission approved Use Permit 86-24 which authorized the development of nineteen townhomes for the properties at 14572-14592 Holt Avenue. ANALYSIS: The developer is now requesting authorization to subdivide 3 lots of 1.4 acres into 19 numbered and 3 lettered lots to accommodate the proposed townhouse project. The 19 numbered lots will each have a townhome placed on them. Lot A is for private street purposes. Lot B is the common area for recreation purposes which includes a spa and barbeque. Lot C is the common area for landscaping purposes. City Council Report page two September 2, 1986 On August 25, 1986 the Planning Commission adopted Resolution No. 2353 which recommended approval of Tentative Tract 12855 to the City Council. The proposed mai is in conformance with the Tustin Area General Plan and the Zoning Ordinance. The conditions of approval are listed in Resolution No. 86-108. The City Council of the City of Tusttn does hereby resolve as follows: I. The City Council finds and determines as follows: Ae That Tentative Tract Map No. 12855 was submitted to the City Council on behalf of Frank Wu to subdivide (3) three lots into (19) nineteen numbered and (3) three lettered lots for a residential subdivision for townhomes for a portion of Lot 10 of the Vanderlip and Rowan Tract, in the City of Tustin, County of Orange, as per map recorded in Book 5, page 160 of miscellaneous records of Los Angeles County, California. B. That a Negative Declaration was previously approved for the project. Ca That the proposed subdivision is in conformance with the Tustin Area General Plan and the Tustin Zoning Code. II. The City Council hereby approves Tentative Tract Map No. 12855 subject to the following conditions: 1. A grading plan will be required and should be based on the Orange County Bench Mark Datum.- All improvements within the public right of way of Holt Avenue must be shown on a separate street improvement plan. All construction items must be referenced to applicable City Standard Drawing Numbers. Construction items to be shown will include but not be limited to the follow(rig: a) Curb and gutter b) Full width sidewalk and treewells c) Street trees d) Street light(s) e) Sanitary sewer connections f) Domestic water services g) Fire service/hydrants (if required by Fire Marshal) the Orange County .3 5 6 7 9 10 11 12 13 15 16 17 18 19 21 23 2~ 26 27 Resolution 86-108 page t~o Ye 10. 11. 12. The property owner will be required to annex this parcel to the Tusttn 1972 Lighting and Landscape District. The City of Tusttn Engineering Division will require from the property owner a letter stating that he will not protest said annexation. The annexation of this parcel will take place in July, 1987. The property owner will be required to pay the installation charge for any required street light(s) to the Edison Company and pay to the City of Tustin the advanced energy charge to cover the operating/maintenance costs for a period of 12 months. Any excess advanced energy charge collected will be refunded to the property owner once the annexation is finalized. Payment of the Orange County Sanitation District No. 7 sewer connection fees will be required at the time a building permit is issued. Payment of East Orange County Water District fees will be required prior to the building permit being issued. Payment of the required fees for the Major Thoroughfare and Bridge Fee Program will be required at the time a building permit is issued. A permit issued by the Orange County Environmental Management Agency for connection to the E1 Modena-Irvine Channel will be required. Individual sanitary sewer and domestic water service to each dwelling unit will be required. Submission of C.C. & R.'s to the City Attorney for review and approval. All lettered lots shall be held in common and maintained by the Homeowners Association. Dedication of all access rights to Holt Avenue except at approved access point. Construction of a public water system within the private street with all necessary easements dedicated to the City of Tustin. This water main is to be connected to the existing main at the northerly tract boundary and also to the existing main in Holt Avenue at the southerly tract boundary. Private streets are to be posted "NO PARKING-FIRE LANE" and comply with the regulations of the uniform Fire Code (Section 10.207) and Vehicle Code. 14. The landscape plan shall address the issue of retaining the existing mature specimen trees. 15. ReciProcal easement for joint use of the private street with the townhome project to the north shall be placed on the final map.
