Chair Pro Tem Wetl opened the public hearing at 7:45 p.m. Ted Fessler, Larwin Square
Management, encouraged acceptance of this variance. Only three other tenants have
10,000 square feet so doesn't see problem with requests for addittonnal signing
developing with other tenants.
John Ziskin, Big 5, explained the importance to Big 5 to have the larger sign due to
setback and trees in the center.
Seeing no one further wishing to speak, Comissioner Well closed the hearing at 7:52
p.m.
Commissioner Well moved, Baker second to approve Variance 86-6 by the adoption of
Resolution 2355. Notion carried 4-0.

COl~4ISSION CONCERNS
Commissioner Ponttous requested assistance from staff on the sign code. She doesn't
like dealing with so many sign variances and requested adjustments be made .to avoid
so many variances and possibly change the sign code.
Commissioner LeJeufle expressed his annoyance with so many temporary banners around
town, especially on the weekends.
Commissioner Nell requested the new Commissioners receive copies of the East Tustin
documents.

Commission discussion ensued with questions of staff and Suzanne Atkins regarding
signage, proximity to R-! and R-3 residential zones, and limits imposed by Ordinance
No. 960.
Chairman Puckett explained his opposition to this Use Permit is due to the proximity
to residential areas and wants to adhere to the limits imposed by Ordinance No. 960.
Chairman Puckett moved denial of Use Permit 86-19. The motion died for lack of a
second.
Commissioner Le Jeune moved, Baker second to approve Use Permit 86-19 by the adoption
of Resolution 2351. Motion carried 3-1, Puckett opposed.

9. STATUS OF AINSLIE DEVELOPMENT PROPOSAL.
Staff recommended the Commission amend the zoning regulation for certain properties
fronting on Sixth Street between B and Pacific.
Commissioner Ponttous moved, LeJeune second to authorize staff to advertise for a
public hearing to amend the zoning regulation for certain properties fronting on
Sixth Street between B and Pacific. Motion carried 3-1, Baker opposed.
CI~INI.~IO# CONCERNS
Commissioner Le Jeune expressed concern with temporary banners around town and
requested staff forward a copy of the city's policy to him.
Commtssionner Baker questioned the status of the deveiopment agreement on East Tustin
and requested staff forward a copy to the Commission for review prior to
consideration.
Commissioner Baker questioned the status on acquisition of the car wash property.
Commissioner Pontious requested staff guidelines on neon signage. Commissioner
LeJeune would like the guidelines to contain use inside of windows and whether they
blink.
Commissioner Baker expressed concern if our ordinance regulating palm reading is
adequate.

July of 1974. In August of 1979 Tract 10815 was recorded which created a one
(1) lot subdivision for condominium purposes for these parcels.
ANALYSIS:
The owner is now requesting authorization to create three (3) lots from the
previous one (1) lot. The total area of the proposed map is 3.029 acres and
will be split into three (3) lots with each lot having an existing building and
parking spaces provided as follows:

On July 14, 1986, the Planning Commission recommended approval of this tentative
parcel map by the adoption of Resolution No. 2346. Part of that recommendation
was that the condition requiring the installation of sidewalk remain, but that
the Council consider a narrower sidewalk as requested by the developer.
On July 21, 1986, the City Council approved the tentative map by the adoption of
Resolution 86-88, which specified that the sidewalk shall be a minimum of 5.0
feet in width.
The final map is in substantial compliance with the tentative map.
The proposed map is in conformance with the Tustin Area General Plan and the
Planned Community Guidelines for the Tusttn/Irvine Industrial Park.
All conditions of approval have been net.

The Planning Commission of the City of Tustin does hereby resolve as
follows:
I. The Planning Commission finds and determines as follows:
That Final Parcel Map No. 86-201 was submitted to the Planning
Commission pursuant to Ordinance No. 847 by J. P. Kapp &
Associates on behalf of Signal Development Co. for the purpose

The City Counctl of the City of Tusttn does hereby resolve as follows:

The City Council finds and determines as follows:
That Tentative Parcel Map No. 86-201 was submitted to the

BACKGROUND:
12855 to the City Council by the
Specific Plan No. 6 was adopted by the City Council in 1981. This specific plan
was adopted to ensure orderly development for the area easterly of Holt Avenue
between Warren Avenue on the north and the flood control channel on the south.
On August 11, 1986, the Planning Commission approved Use Permit 86-24 which
authorized the development of nineteen townhomes for the properties at
14572-14592 Holt Avenue.
AMALYSIS:
The developer is now requesting authorization to subdivide 3 lots of 1.4 acres
into 19 numbered and 3 lettered lots to accommodate the proposed townhouse
project. The 19 numbered lots will each have a townhome placed on them. Lot A
is for private street purposes. Lot B is the common area for recreation
purposes which includes a spa and barbeque. Lot C is the common area for
landscaping purposes.

One item of concern to staff is note No. 3 on the tentative map which states ALL
TREE~ TO BE RE~OYED. A condition of approval has been added to Resolution No.
2353 which states that the landscape plan shall address the issue of the
retention of the mature specimen trees.
The proposed map is in conformance with the Tusttn Area General Plan and the
Zoning Ordinance.
The conditions of approval are listed in Resolution No. 2353.

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN RECOMMENDING TO THE CITY
COUNCIL APPROVAL OF TENTATIVE TRACT NO. 12855.
The Planning Commission of the City of Tusttn does hereby resolve as
follows:
I. The Planning Commission finds and determines as follows:
That Tentative Tract Map No. 12855 was submitted to the Planning
Commission on behalf of Frank Wu to subdivide (3) three lots
into (19) nineteen numbered and (3) three lettered lots for a
residential subdivision for townhomes for a portion of Lot 10 of
the Vanderltp and Rowan Tract, in the City of Tusttn, County of
Orange, as per map recorded in Book 5, page 160 of miscellaneous
records of Los Angeles County, California.
B. That a Negative Declaration was previously approved for the
project.
That the proposed subdivision is in conformance with the Tustin

The Planning Commission hereby recommends to the City Council

The property owner will be required to annex this parcel to
the Tustfn 1972 Lighting and Landscape District. The City
of Tusttn Engineering Division will require from the
property owner a letter stating that he will not protest
said annexation. The annexation of this parcel will take
place in July, 1987.
The property owner will be required to pay the installation
charge for any required street light(s) to the Edison
Comapny and pay to the City of Tusttn the advanced energy
charge to cover the operating/maintenance costs for a
period of 12 months. Any excess advanced energy charge

On July 30, 1986 an application was filed by Mr. Ted Fessler of Larwtn Square
Management which requested the approval for a g8.6 square foot sign to be used
for a new major tenant in the center. This new tenant is Big 5 Sporting Goods
which has locations throughout Southern California.
In consideration of variance applications, staff must consider the justification
of a hardship and consider if privileges would be granted to the applicant that
are not available to other businesses located in the area. Staff has found that
a hardship exists due to the poor visibility of the store from the public street
which is over 300 feet away. There also exists a precedent for approval based
on previous approvals in similar circumstances.

BACKGROUND & AIIALYSZS:
Staff has reviewed variances which have been granted for other businesses with
similar circumstances to this request. These applications include the approval
for signs for the Wherehouse, Royale Stationers, and other future tenants of the
Carver Development project on the corner of Newport and Main Street. Other
users which currently enjoy the privileges of increased signage square footage
include Drug [n~orium on Redhtll, Marshal's on E1 Camino Real; Miller's Outpost
on 17th Street, and Schick Movers in the industrial complex located just north
of Walnut Avenue in the southeastern portion of the city. In all cases these
businesses were allowed to install signs which exceed the sign area allowance of
15~ of the store front area.
In the case of Big 5 the applicant is requesting that a g8.6 square foot sign be
installed on the facia portion of the store front. As with all signs in the
center, a channeled letter sign will be installed which is internally
illuminated. In all respects, this particular sign request is in conformance
with the Master Sign Plan for the property with the exception of letter height.
(32 inches versus 18 inches allowed)
This application involves the request for a sign of 98.6 square feet. A
square foot sign would be allowed if the 15~ store front area was used.
However, the Sign Code requires that no commercial sign in a shopping center
shall exceed 75 square feet. This request is slightly less than the sign
variances previously mentioned.
The building where Big 5 is located is setback more than 300 feet from the
street and is visually blocked by the Sptre's restaurant building, Security
Pacific Bank and the mature landscaping elements contained within the center.
The current sign code for the City of Tustln requires that two basic elements be
met prior to the issuance of a variance. The first requirement is that, because
of exceptional circumstances applicable to the property, the strict application
of the Code deprives the property of privileges enjoyed by other properties.
Secondly, that granting of a variance will not constitute a grant of special
privileges inconsistent with other businesses in the area.

CONCLUSIONS:
This request meets the criteria for variance approval as contained In the Sign
Code. In all respects, the sign shall conform to all provlslons of the code
except for size. This sign, as conditioned in the proposed resolution of
approval, shall be used by a major tenant of 10,000 square feet or more and
shall not exceed 98.6 square feet in size.
Should the Planning Commission find that the request for ln~reased signage is
justified in this case, staff recommends approval by the adoption of Resolution
No. 2365.

That because of special circumstances applicable to the subject
property, relative to size, shape, topography, location or
surroundings, a strict application of the Sign Code is

constitute a grant of special privilege inconsistent with the
limitations upon other properties in the vicinity and district
in which the subject property is situated.

BACKGROUND AND D~SCUSSZON:
Wtth the adoptton of Ordinance No. 938, Planned community Regulations and
Guidelines for the area known as East Tustln Phase ! were established. The
project now before the Commission (Tentative Tract Hap No. !2732/Sycamore Glen)
ts proposed for the portton of Phase ! Indicated as Area 2 .on the attached
Exhibit A.
Development for residential purposes wtthtn Area 2 permtts stngle famtly
dwellings (detached or attached) at a maximum denstty of thtrteen ([3) units per
acre. A total of 273 untts ts permitted tn Area 2.
Pursuant to applicable zontng and subdivision regulations and prior to
development of any project, the Planntng Commission must conduct a publtc
hearing and make recommendations to Ctty Counctl concerning proposed subdivision
maps; tn this case, Tentative Tract Hap No. [2732. Additionally, as outlined tn
Planned Community Regulations for Phase !, the Planntng Commission must approve
conceptual development plans prior to submittal of such plans to the Butldlng
Department for permtt Issuance. Conceptual development plans refer to stte
layout, architectural elevations of butlding exteriors, common area landscape
plahs and recreational facility plans. The destgn revtew process does not
require a public hearing.
In reviewing the subject project it should be remembered that the entire Phase I
area was in essence created by Final Tract 12345. This is important to note
that certain conditions imposed upon Tract 12345 are applicable to and must be
incorporated within subsequent projects in the area.
PROgECT PROPOSAL:
The Bren Company has submitted a comprehensive development package for a
residential condominium project to be called Sycamore Glen. The submittal
tncludes a stte plan, butldtng elevations, landscape and recreation area plans
and the requtred subdivision maP. Specifically, the project conststs of a
maximum of 248 condominium units.
There are two separate actions the Commission must take in relation to this
project, so each will be addressed individually.
Tentative Tract Map 12732
Discussion on Tentative Tract Map No. 12732 is fairly limited. Basically, the
map, if approved, would authorize the development of 248 .condominium units.
Subsequent to site and condominium plan approval, lettered lots delineating
common and private areas will be incorporated onto the map. Essentially,
approval of this tentative map simply permits development of residential
condomtums.

However, as is the case with all tentative maps, certain standard conditions of
approval are recommended for Tentative Tract Map 12732. These conditions are
listed in attached draft Resolution No. 2356.
Design Review
Items that the Commission should consider as a portion of its design review
authority includes the site plan, building elevations and common areas.
Site Plan
The Sycamore Glen condominiums wi. ll be built utilizing a "front-loaded" concept
providing for direct access to units from an internal street system. Each home
will have a two car garage attached to the unit. By using this development
concept, long rows of carports or garages common to projects in this density
range have been avoided.
In connection with the front-loaded concept, the use of an interior traffic
circulation system of private streets has been included in the site plan. The
main loop street through the project ranges from 28 to 32 feet in width.
On-street parking is available on streets in excess of 28 feet wide, and
additional bays for guest parring have been provided. Altogether, the project
has been parked at a ratio of 2.64 spaces for each dwelling unit while P.C.
regulations require 2.5 spaces/unit.
A second general aspect of the proposed site plan revolves around pedestrian
orientation of the project. To accommodate access to on-site recreation areas,
a public park site immediately to the south, and as a connection to exterior
walkways, an interior sidewalk system has been proposed. Utilization of these
walkways eliminate the necessity to drive to other points in the complex and
provides a separation between vehicular and pedestrian traffic.
Finally, two recreation areas have been proposed for the project. The location
of these areas are such that they lend a positive appearance at the entry points
of the site. Further, these area are readily accessible to the majority of
residents and will be equipped with swimming pools and spas.
Architectural Elevations
Within Sycamore Glen, the Tustln Ranch theme is ~mphastzed architecturally by
extensive use of wood siding, pitched roofs, and wood simulated concrete roof
tiles. To make this treatment a little more contemporary and to provide visual
relief to two story units, multiple roof planes, extruUing window areas and
other embellishments have been proposed.
Finally, special consideration and emphasis has been given to elevations that
may be viewed from perimeter public streets.

individual untts have been clustered into 2, 3, or 4 unit buildings.
Additionally, the project contains 34 one-story untts. Twenty-three of the one
story plans are Included tn the four plex buildings. This concept also assists
In the reduction of butldlng mass. Lastly, to maxtmtze openness along the main
trafftc loop in the project, the majority of units adjacent to the drive have
been set back approximately [9 feet.
Untt Transfer
Although not a particular concern at this point, the Issue of untt transfer does
have implications that should be noted. As stated in this report, the maximum
unit count permitted for Area 2 is 273 while only 248 units are proposed.
Pursuant to Section 2.[ of the East Tustin Spectflc Plan, the 25 units that
could be built in Area 2 can be transferred into the Specific Plan area provided
all conditions of the plan are met. This transfer process is fully detailed in
the East Tusttn plan and from this point forward will be closely monitored by
staff.
COliCLUS[O#S:
Subject to conditions of approval contained in Resolutions No. 2356 and 2357,
staff has concluded that the proposed project meets or exceeds mintmum
requirements of applicable land use regulations. Further, staff is confident
thgt proposed building elevations and common recreation/landscape .areas satisfy
the Intent of Planned Community Regulations for Phase ! In that architectural
qualtty treatments have been included in the package submitted.
Accordingly, it is recommended that the Commtssionn recommend to City Council
approval of Tentative Tract Map 12719 and that the Commission approve Design
Review 86-12 by the adoption of Resolutions No. 2356 and 2~7~.

sidewalks along "B" Street and E1Camtno Real frontages.
Payment of all required Orange County Sanitation District No. 7
sewer connection fees that may be required as a result of the
interim connection to the District 7 facilities, will be
permitted within this area.
Payment of all required fees for the Major Thoroughfare and
Bridge Fee Program will be required at the time building permits
are issued.
Required New Development Tax shall be paid prior to recordation
of any Final Map filed in compliance with the Tentative Map.
A complete phasing and construction schedule must be submitted,

CC&R's must be prepared and submitted for review and approval

fire protection. The adequacy and reliability of water system
design, and the distribution of fire hydrants will be evaluated
in accordance with Insurance Service Office suggested standard.
Prior to the issuance of any building permits for combustible
construction, evidence that a water supply for fire protection
is available shall be submitted to and approved by the fire
chief.

That pursuant to Ordinance No. 938 adopting Planned Community
Regulations for East Tustin, Phase I, the Commission hereby
approves the site plan and architectural elevations as presented
to the Commission in conjunction with Tentative Tract No. 12732
on July 28, 1986 subject to the following conditions:
Interior garage dimensions shall be a minimum of 18' x 20'
clear.

Specific exterior color schemes and proposed -building
materials shall be submitted to the Planning Commission for
review and approval.
Architectural treatments and embellishments as shown shall
be constructed so as to give a sense of depth and
dimension.
Swimming pools and spas will be required in recreation
areas. A 6'0" high fence with self-closing and
self-latching devices on gates shall be installed around
pool and spa areas.
6. Elevations of pool equipment/restroom building in
recreation areas are required.

A complete landscape plan for recreation areas is required
with submittal package for structural plan check.
A final site design of required recreation area
specifically. Siting of pool, spa, pool equipment
building, and other recreational equipment shall be
required at the time of submittal for structural plan
check. Additionally, the pool equipment building shall be
constructed so as to accomodate plumbing and solar panels
in the event that the Sycamore Glen Homeowners Association
desires to utilize solar heating for water elements.

BACKGROUND & SL~tARY:
On August 11, 1986 the Planning Commission had ratsed concerns over the
enforcement of banner policy wtthtn the Ctty of Tusttn. Staff has prepared a
report whtch tncludes both the current poltcy and enforcement procedures which
are currently enforced by planntng staff personnel. Attached to thts report
ts a manual whtch 11sts the types of violations of the current zoning code, sign
code, publtc nutsance ordinance and other varlous ordinances whtch are enforced
by the Community Development Department. Also contained In this manual are
coptes of form letters whtch are sent to the violators as each particular
instance ts Incurred.
Exhibit "A" is the temporary use permit form which is used to issue permits for
banners for. real estate and retail users. This form is also used to authorize
outdoor sales events which may occur in shopping centers up to four times a
year. Exhibit "B" is a copy of the current policy for issuance of these
temporary use permits.
There are three types of permits which, may be issued: one is for a 30 day
period for retail or real estate users. This permit may be issued for 30 days
per calendar quarter. The second type is for 120 day permit for real estate
users only. This is a one time permit and may be issued one time per year. The
third type of permit which may be issued is for an outdoor sales event. This
application is used to authorize outdoor sales which are located in parking lots
of shopping centers and retail locations throughout the city.
Also attached to this report is Exhibit "C". This is a code enforcement
report. This report includes a complete list of current sign violations and
follow up. This list includes many types of violations to banner policy, sign
code policy, and other various public nuisance codes.

CONCLUSIONS:
Code enforcement is something that is routinely checked by the Community
Development Department. Code enforcement includes public nuisance abatement,
sign code abatement and zoning code abatement and requires constant supervision
of the city to maintain that the codes are being met. In most cases, on our
routine checks, many violators are found and are noticed based on the procedures
found in the attached Code Enforcement Manual. Staff will continue to make this
a routine part of the weekly work program. Should the Commisstonn wish to
consider further policy considerations, please direct staff to do so.

this permit is descretionary and the use applied for is not allowed by right and is
subject to revocation if all conditions of approval are not met. Should the display

TEMPORARY SIGNS AND OUTDOOR SALES:
1. One display per building or street frontage.
2. Banners must be fixed to the building, hung below the roof line.
3. Banners must be of a cloth material and professionally made.
Decorative flags, bunting, etc., shall only be permitted for original
grand openings for a period of 30 days.
Advertising for purposes other than grand openings is restricted to
periods of up to 30 days. Display of banners should be for special events
only, and not for each promotion a nattonal-~chise might wish to
publicize. All temporary use permits are issued subject to approval of
the Director of Community Development.
6. Any banner used for the sale, lease or rental of property may be issued
one (1) 120 day permit per year or as authorized above.
SPECIAL EVENTS AND OUTDOOR SALES:
7. Temporary outdoor sales are limited to one sale per calendar quarter for
each location.
8. Sales are limited for up to three days in duration, and only on weekends.
9. Temporary outdoor sales are allowed in all commercial zones (excluding
professional office zones).

Any deviation from the above guidelines requires approval of the Director
of Community Development. Should any permit be denied by the Director of
Community Development, all decisions can be appealed to the Planning
Commission.
