HUSTON, CITY MANAGER F,O~: RONAL~N~ECTOR OF FINANCE RESOLUTION 87-93 APPROVING A REPORT ESTABLISHING THE SOLID SUBJ,=?: WAST, COLLECTION FEE FOR 1987-88 AND AUTHORIZING TH~ COUNTY TAX COLLECTOR TO PLACE SAME ON THE TAX ROLL. RECOMMENDATION: If,.' at the conclusion of the public hearing there has not been a fifty percent protest, adopt Resolution 87-93 approving the attached report establishing the 1987-88 Solid Waste Collection Assessment at $65.76 and authorizing this amount to be assessed against the current assessment roll. DISCUSSION: Attached for your review is a copy of the report describing the proposed.levy, and the method of discerning same, sent to the City Clerk on July 22, 1987 in accordance with Health and Safety Code Section 5473. Also attached is a report dated July 2, 1987 that fully describes the elements of the proposed increase and comparisions with other cities and the unincorporated areas of the County. Based on the weight of factors in our current Solid Waste Collection Agreement, a 3.34 percent increase was approved effective July 1, 1987. Great Western Reclamation has been billing their commercial customers at their new rate and we are obligated to compensate them for residential collection at the new rate of $5.48 per unit per month up to three u~its. This is an effective rate inc'rease of only 2.4 percent due to the total rate being a composit of cost collection, $3.94, up 3.34 percent and the County land fill, or disposal cost, $1~54, no increase. The proposed rate of $5.48 is five percent lower than the countywide average of $5.77 for incorporated areas and sixteen percent lower than the $6.47 cost for the unincorporated areas. This is based on a County GSA Survey dated June 9, 1987. As of this date there have been no inquiries into the new levy. RAN:ls RESOLUTION NO. 87-93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTED PURSUANT TO THE PROVISIONS OF SECTION 5473 ET SEQ. OF THE HEALTH AND SAFETY CODE OF THE STATE UF CALIFORNIA, FINALLY APPROVING AND ADOPTING A REPORT RELATIVE TO PARCELS OF REAL PROPERTY RECEIVING SOLID WASTE COLLECTION SERVICES, DETERMINING THE CHARGES ~OR SOLID WASTE COLLECTION TO BE ASSESSED AGAINST THE RESPECTIVE LOTS OR PARCELS OF LAND AS THEY APPEAR ON THE CURRENT ASSESSMENT ROLL. The City Council of the City of Tustin does hereby resolve as follows: 1. The City Council finds and determines as follows: A. That proceedings were duly instituted, conducted and completed pursuant to provisions of Section 5473 et seq. of the Health and Safety Code of the State of California. B. A written report dated July 27, 1987, containing a description of each parcel of real property receiving solid waste collection services and facilities and the amount of the charge proposed to be levied upon each parcel for the collection of solid waste for the fiscal year 1987-88, was prepared and filed with the City Clerk of the City of Tustin on July 27, 1987. C. That a public hearing to hear and consider all objections or protests, if any, to the aforesaid report and proposed charges was duly set for August 17, 1987 at 7:00 o'clock p.m. in the Council Chambers of the City of Tustin at 300 Centennial Way, Tustin, California. D. Said hearing was duly noticed as required by law, by publication once each week for two successive weeks on July 30, 1987 and August 6, 1987 in the Tustin News, a newspaper of general circulation printed and published in the City of Tustin. E. At the aforesaid time and place the duly noticed hearing was held and all persons who were present were heard and all comments, objections and protests to the aforesaid report 'and proposed charges were duly heard and considered by the City Council. F. The charges proposed in the aforesaid report are fair and reasonable, are commensurate with the services provided, and the charge therefore should properly be collected on the tax roll in the same manner, by the same persons and at the same time as, together with and not separately from, general taxe~. charges2. The City Council hereby elects to have the set forth in the aforesaid report collected on the tax roll in the-same manner, by the same persons, at the same time as, and together with and not separately from, its general taxes and hereby authorizes that such charges 7 be collected on the tax roll, as all prescribed to the provisions of Health and Safety Code Section 5473 et seq. 3. This resolution shall be effective following its adoption by a two-thirds vote of the members of the City Council and shall remain in force and effect and said ]0 charges shall be collected in the manner as aforesaid for the year 1987-88 and for each subsequent year as ]] authorized by the hereinabove referenced sections of the Health and Safety Code. 4. The City Clerk is authorized and directed to forthwith file a certified copy of this resolution with the Auditor of the County of Orange, together with a copy of the hereinabove-described report and a statement endorsed thereon over her signature that the said report has been finally adopted by the City Council of the City of Tustin.~ PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin, California, held on the day of , 1987. The attached Schedule's "A" and "C", reflect the authorized rates for sol'id waste collection that became effective July 1, 1987, and the method of adjusting these rates. The proposed amount for the year 1987-88 is $65.76 per unit, to a maximum of three units, per.year. The large listing is in parcel number order with the proposed assessment assigned to each parcel. I've prepared a letter for your signature that will authorize Great Western to begin charging the new rates effective July 1, 1987 per language in the agreement. You will need to inform the City Council of the increase at the next regular meeting. In regards to the residential rate and the tax rolls, we will need to have a public hearing on the proposed rate and then the Council will need to adopt the new.rates by resolution. I will schedule the hearing on the July 20 meeting. I've attached a copy of the County GSA Survey of Refuse Collection Rates as of June 9, 1987. The average residential rate for municipalities in the County is $5.77 per unit per month. Tustin's proposed new_rate will be $5.48 per unit per month, 5% less than the average. The new rate is also 16% lower than the County rate for the unincorporated areas. ~e are beginning the final year of a five year agreement. We need to give written notice of desire to continue the agreement for an additional five years by May 2, 1988. We should sit down with Bob and go over our options prior to the notice date.
