HUSTON, CITY MANAGER DESTRUCTION OF CERTAIN RECORDS IN THE CITY HANAGER'S OFFICE RECOIqMENDATION It is recommended that the City Council adopt Resolution No. 141 authorizing the destruction of certain records, correspondence and miscellaneious memoranda and papers of the City Manager's office. BACKGROUND & DISCUSSION Section 34090 et. seq. of the Government Code of the State of California authorizes the destruction of certain records which have been retained for a minimum of two years. The records to be destroyed are specifically outlined in Resolution No. 141. All other records of the City Manager's office will, at this time, be retained. City Manager WAH :ih Attachments: Resolution No. 141 Consent of City Attorney L '1 2 5 6 7 8 9 10 11 12 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 86- 141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESTRUCTION OF CERTAIN RECORDS. WHEREAS, except for'records affecting title to real property or liens thereon, court records, records required to be kept by statute, records less than two years old and the minutes, ordinances, or resolutions of the City Council and other City boards or commissions, Government Code Section 34090 authorizes the head of a city department to destroy any city record, document, instrument, book or paper, under his charge, without making a copy thereof, after the same is no longer required, with the approval of the City Council by resolution and the written consent of the City Attorney; and WHEREAS, the Council upon request of the City Manager, desires to approve immediate destruction of certain records, towit, correspondence and miscellaneous memoranda and papers of the City Manager's Office, each of which is not less than two (2) years old; and WHEREAS, the City Attorney of the City of Tustin has filed his written consent with the Clerk of the Council of the City of Tustin; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Tustin: Pursuant to Section 34090 et seq. of the Government Code of the State of California, approval is hereby granted for the immediate destruction of the items listed below which, as of November 4, 1986 have been retained for a minimum of two (2) years. Correspondence and miscellaneous memoranda and papers of the City Manager's Office. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin, California, held on the __ day of , 1986. ROURKE, City Attorney of the City of Tustin, California, do hereby consent to the destruction of the'materials described in the attached Re- solution. City Attorney -2-
