(EAST TUSTIN SPECIFIC PLAN/SECTORS 10 AND 11)
RECOMMENDED ACTION:
It is recommended that the City Council approve Tentative Tract Map 12763 by the
adoption of Resolution No. 86-142. This map may be considered as a Consent
Calendar item.
SUMMARY:
On December 8, 1986, the Planning Commission conducted a public hearing
concerning Tentative Tract Map 12763 and has recommended City Council approval
of said map. A copy of the staff report to the Planning Commission outlining
issues related to the subject map and all recommended conditions of approval is'
attached for the Council's information. With the exception of the precise sizes
of school and park sites to be located in Sector 11, all aspects of the original
staff report to the Planning Commission reflect the map as submitted.
DISCUSSION:
As recommended by the Planning Commission, Tentative Tract No. 12763 differs
from the original submittal only with regards to the size of the neighborhood
park and elementary school proposed in Sector 11. Based upon an agreement with
The Irvine Company and Tustin Unified School District an elementary school site
of 9 acres will be provided. The subject map will also provide for an adjacent
3 acre neighborhood park.
Park land to be dedicated with approval of the subject tract meets all required
park land dedication requirements of the municipal code and is consistent with
requirements of the East Tustin Specific Plan. For a future neighborhood park ,
the subject tract will also provide a 16 acre community park adjacent to a 34
acre high school. Although the Tustin Unified School District has advised the
City that standard average for high schools and elementary schools are 40 acres
and 10 acres respectively, the District has agreed to accept a 34 acre high
school site and a 9 acre elementary school site providing that some form of
joint use concept incorporating adjacent park sites is approved.

The concept of joint use is supported by staff as indicated in the attached
transmittal and is consistent with the Recreation Element of the Tustin Area
General Plan. Condition II. 2.11 {pages 7 and 8) of Planning Commission
Resolution No. 2376 sets specific parameters for future discussions between the
City and the District concerning precise definition of joint use of facilities
including development of facilities, their use and maintenance. TUSD staff is
in concurrence with these conditions.
CONCLUSIONS:
Based upon staff analysis it has been determined that Tentative Tract Map 12763
meets all requirements of the East Tustin Specific Plan, the adopted Development
Agreement, EIR 85-2 (as supplemented) and all other applicable subdivision
regulations. Accordingly, the Planning Commission recommends City Council
approval of Tentative Tract Map 12763 by the adoption of Resolution No. 86-142.

RESOLUTION NO. 86-142
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING TENTATIVE TRACT MAP NO. 12763
Council of the City of Tustin does hereby resolve:
City Council finds and determines as follows:
That Tentative Tract Map 12763 was submitted to the Planning Commis-
sion on behalf of The Irvine Company for the purpose of creating a
43-1ot (15 numbered and 28 lettered} subdivision from a portion of
Blocks 43, 44, and 64 of Irvine's subdivision as shown on a maP
thereof filed in Book 1, page 88 of Miscellaneous Maps in the office
of the County Recorder of the County of Orange, State of California.
That a public hearing before the Planning Commission was duly called,
noticed and held considering said map.
That the Planning Commission did by the adoption of Resolution No.
2376 recommend to. the City Council approval of Tentative Tract Map'
No. 12763.
That Environmental Impact Report 85-2 (as supplemented) has been
certified by City Council concerning the subject project area and the
map submitted is in compliance with all required mitigation measures
contained therein.
The proposed subdivision is in conformance with applicable ordi-
nances, policies and standards of the City of Tustin, evidenced by
the following findings:
1. That the proposed map is consistent with the Tustin Area General
Plan in that:
a. Proposed densities and land uses are identified in accordance
with the Land Use Element.
b. Parkland has been identified and allocated in accordance with
the Recreation Element.
Provisions for affordable housing as outlined in EIR 85-2 and
the Housing Element will be considered with subsequent, proj-
ect level, subdivision map processing.
Necessary actions to mitigate noise impacts will be required
pursuant to the Noise Element, including an analysis of the
Browning Corridor.

2. That the proposed map is consistent with the East Tustin Specific
Plan in that:
a®
Provisions of Sector processing requirements concerning
circulation, grading, drainage, and median and parkway land-
scape plans relative to Sectors 10 and 11 have been met.
(Section 3.5)
The number of residential units proposed is within the estab-
lished limits stated in the East Tustin Specific Plan. (Sec-
tion 3.4.3)
That identified land uses upon the subject map are consistent
with permitted land uses outlined in the East Tustin Specific
Plan. (Section 3.4)
That the project as submitted is consistent with the adopted
Development Agreement between the City of Tustin and The Irvine
Company.
4. That the proposed map is in conformance with an agreement between
the Tustin Unified School District and The Irvine Company.
That approval and recordation of Tract 12763 is not the final
discretionary approval for development within the subdivision.
Subsequent subdivision maps will be required prior to development
of any residential lot created by Tentative Tract Map 12763.
That the site is physically suitable for the type of development pro-
posed.
That the site is physically suitable for the proposed density of
development.
That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife in their habitat.
That the design of the subdivision or the type of improvements pro-
posed will not conflict with easements acquired by the public-at-
large, for access through or use of the property within the proposed
subdivision.
That the design of the subdivision or the types of improvements pro-
posed are not likely to cause serious public health problems.

II.
The City Council hereby approves Tentative Tract Map No. 12763 subject to
all conditions contained in Planning Commission Resolution No. 2376
incorporated herein by reference.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
