Approval and authorize the Mayor to execute the attached Freeway Agreement for Stage II work on the I-5/Rte. 55 Interchange Modification Project. BACKGROUND: Caltrans is planning the complete modification of the 1-5/Rte. 55 Freeway Interchange along with widening of both freeways within the immediate vicinity of the interchange. This proposed work is proposed to be completed in a three-stage program as follows: Stage I Construction - Late 1987 through late 1989 Stage II Construction - Late 1989 through late 1992 Stage III Construction - Late 1989 through late 1992 - {Subject to availability of funding) The attached agreement provides for both Stage schematic of proposed work shown on Exhibit A. consist of the following: II and Stage III work with a The proposed work will generally ° Construction of northbound Route 55 flyover to northbound I-5 ° Modification of southbound I-5 connector to southbound Route 55 ° Construction of southbound Route 55 flyover to southbound I-5 ° Modification of northbound I-5 connector to northbound Route 55 ° General widening of both freeways to accommodate the modified connection movements above ° Reconstruction of Newport Avenue overpass at I-5 and widening of Newport Avenue Reconstruction of both the First St. and Irvine Blvd. bridges over Route 55 JANUARY 14, 1987 PAGE TWO DISCUSSION: The attached Freeway Agreement provides for the following: Supersedes previously executed agreements relating to those sections of the~interchange modifications within Stage II and Stage III. City consents to all construction affecting City streets as delineated on Exhibit A. These areas include the closure of E1 Camino Way at the freeway on-ramp and Pasadena Avenue at First Street. ° State shall acquire all required right of way necessary for said construction. City will accept control and maintenance over each of the relocated or reconstructed City roads at completion of Stage II and III work. The City Attorney's office has reviewed these agreements and has approved them as to form for execution by the Mayor. Bob Ledendecker Director of Public Works/City Engineer BL:jm Attachment 7-ORA-5 29.6/30.7 From Newport Avenue to 0.1 Mi N/O Main St 7-ORA-55 R10.2/11.8 From 0.2 Mi N/O McFadden St to Seventeenth St FREEWAY AGREEMENT THIS AGREEMENT, made and entered into on this day of , 19 , by and between the STATE OF CALIFORNIA, acting by and through the Department of lransportation (herein referred to as "STATE"), and the CITY OF ~JSTIN (herein referred to as "CITY"), WITNESSETH: WHEREAS, the highways described above have been declared to be freeways by Resolutions of the California Transportation Commission on July 15, 1952 for Route 5 and on March 17, 1954 for Route 55; and WHEREA~, STATE and CITY have entered into: a Freeway Agreement dated May 7, 1957, relating to that portion of State Highway Route 55 from the south city limits at Main Street to the north CITY limits near Fourth Street and a Freeway Agreement dated January 15, 1962 relating to that portion of Interstate Highway Route 5 from the easterly CITY limit at Red Hill Avenue to the westerly CITY limit near Route 55; and WHEREAS, STATE and County of Orange have entered into Freeway Agreements relating to previous unincorporated areas that were subsequently annexed by CITY as follows: an Agreement dated September 22, 1958 relating to that portion of State Highway Route 55 from McFadden Street to State Highway Route 91; an Agreement dated January 2, 1962, relating to that portion of Interstate Highway Route 5 from the Tustin city limit at Newport Avenue to the Santa Ana CITY limit near First Street; and WHEREAS, a revised plan map for such freeways has been prepared showing the proposed plan of the STATE as it affects streets of the CITY; and W~EREAS, it is the mutual desire of the parties hereto to enter into a new Freeway Agreement in accordance with the revised plan of said freeways; NOW, THEREFORE, IT IS AGREED: 1. This Agreement supersedes in its entirety said Freeway Agreements dated May 7, 1957 and January 2, 1962. 2. This Agreement supersedes that portion of said Freeway' Agreement dated January 15, 1962 from Newport Avenue to just westerly of Route 55. -2- 3. This Agreement supersedes insofar as it applies to CITY that portion of said Freeway Agreement dated September 22, 1958 from 0.2 mile North of McFadden Street to Seventeenth Street'. 4. In connection with the construction of the freeways, CITY agrees and consents to the closing of CITY streets, relocation of CITY streets, construction of frontage roads and other local roads, and other construction affecting CITY streets, all as shown on said plan map attached hereto marked Exhibit A and made a part hereof by this reference. 5. STATE shall, in construction of the freeways and at STATE's expense, make such changes affecting CITY streets in accordance with the plan map attached hereto marked Exhibit A. 6. STATE agrees to acquire all necessary right of way as may be required for construction, reconstruction, or alteration of CITY streets, frontage roads, and other local roads, and CITY hereby authorizes STATE to acquire in its behalf all such necessary right of way. 7. It is understood between the parties that the right of way may be acquired in sections or units, and that both as to the acquisition of right of way and the construction of the freeway projects, the obligations of STATE hereunder shall be carried out at such time and for such unit or units of the project as funds are budgeted and made lawfully available for such expenditures. -3- 8. CITY will accept control and maintenance over each of the relocated or reconstructed CITY streets, and the frontage roads, and other STATE constructed local roads on receipt of written notice to CITY from STATE that the work thereon has been completed,' except for any portion which is adopted by STATE as a part of the freeways proper. CITY will accept title to the portions of such roads lying outside the freeway limits, upon relinquishment by STATE. 9. This Agreement may be modified at any time by the mutual written consent of the parties hereto, as may become necessary for the best accomplishment, through STATE and CITY cooperation, of the whole freeway projects for the benefit of the people of the STATE and of the CITY.
