APPROVAL OF MINUTES - DECEMBER 15, 1986, REGULAR I~EETING It was moved by Kennedy, seconded by Hoesterey, to approve Minutes of the Decembe~ 15, 1986, Regular Meeting. Motion carried 5-0. 4. APPROVAL OF DEMANDS It was moved by Hoesterey, seconded by Saltarelli, to approve Demands for the month of November, 1986, in the amount of $51,720.34 as recommended by the Finance Department. Carried 5-0. 60 5. CONVERSION OF PERMISSIVE LEFT TURNS TO PROTECTED LEFT TURNS Continued from December 15, 1986. Conversion at intersections located within the Town Center Project area as follows: Irvine Boulevard at Pros- pect Avenue; Irvine Boulevard at Holt Avenue; Newport Avenue at Holt Avenue; Newport Avenue at Bryan Avenue; and Newport Avenue at Main Street. Staff recommends a supplemental FY 1986-87 budget appropriation in the amount of $11,000 for the conversion of subjec% traffic signals within the project area and that the City of Tustin Engineering Division be designated to design and perform contract administration for said work. (Reference Council Agenda, New Business Item No. 1.) In accordance with Council action on reference matter, it was moved by Hoesterey, seconded by Sattarelli, to continue subject item for further study. Motion carried 5-0. 94 SEI'FLEMENT OF llJSTIN COt4~UNITY REDEVELOPMENT AGENCY VS. MICHAEL KWOK, DBA TUSTIN FLOWER CASA AND EARL & DOREEN JACOBS DBA VIDEO CENTER Settlement of eminent domain proceedings with operators of businesses which were located at Newport Avenue and Irvine Boulevard, previously known as Newforth Center, approved for acquisition by the Redevelopment Agency. As recommended in the inter-com dated December 30. lg86, prepared by the City Attorney's office, it was moved by Hoesterey, seconded by Saltarelli, to approve, authorize and direct settlement of the claim of Michael Kwok, dba Tustin Flower Casa, for the total sum of $20,000.00; and the claim of Earl and Doreen Jacobs, dba Video Center, for the total sum of $78,000.00. AI~NDIqENTS TO CARVER OWNER PARTICIPATION AGREEMENT Proposed amendments to the Owner Participation Agreement approved by the Agency on December 16, 1985. The original scope of development obligated the developer to construct at least a 6,000 square-foot free-standing quality dinner house restaurant. The developer is requesting the Agency accept a 5,000 square-foot Spoon's Restaurant as meeting the Agency's intent, and also extend the time for required completion of the restaurant to June 1, 1987. Subsequently, the Agency shall withhold the final reimbursement payment to the developer ($71,274.49) until a Certificate of Completion is issued for the restaurant. Following consideration of the inter-com dated January 5, 1987, it was moved by Hoesterey, seconded by Saltarelli, to approve "Amendment No. 1 to Owner Participation Agreement by and.between Tustin Redevelopment Agency and Carver Development Partnership Four" dated January 5, 1987, as recom- mended by the Community Development Department. Carried 5-0. 45; 87-2 8. OTHER BUSINESS None. 9.
