SUBJECT: FIRST STREET UNDERGROUND UTILITY DISTRICT NO. 9
RECOMMENDATION:
That the Tustin City Council, at their meeting of September 8, 1987 pass and adopt
the attached Resolution which sets the time and place of a public hearing to
consider the designation and adoption of the First Street Underground Utility
District No. g.
BACKGROUND:
The proposed Underground Utility District No. 9 provides for the conversion of all
overhead utilities to underground facilities along First Street between Prospect
Avenue and Newport Avenue.
DISCUSSION:
City of Tustin Ordinance No. 411 authorizes the City Council from time to time to
call public hearings to ascertain whether the public necessity, health, safety or
welfare require the removal of poles, overhead wires, etc. within certain
designated areas of the City and, to consider the underground installation of the
abovementioned related facilities for supplying electric, communication or other
similar services.
Ordinance No. 411 also requires the Ci-ty to notify all affected property owners
and all concerned utilities by mail of the time and place of said hearings to
determine whether to form an Underground Utility District at least ten (10) days
prior to the date of said public hearing.
The attached Resolution sets the date of public hearing for Underground Utility
District No. 9 on Wednesday, October 7, 1987 at 7:00 p.m. in the City Council
Chambers, 300 Centennial Way.
Underground Utility District No. 9 is proposed to be administered by Edison
Company Rule 20A funding except for th~ installation of one additional street
light. A complete cost breakdown of this proposed project will be included within
the City Engineer's report for said District No. 9 which will be available at
least ten days prior to the public hearing date of October 7, 1987. The formation
of this Underground Utility District will not require the conversion of any
utility services for property owners.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
SEI-FING A TIME AND PLACE OF A PUBLIC HEARING TO CONSIDER
THE DESIGNATION AND ADOPTION OF AN UNDERGROUND UTILITY
DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES
AND ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE
CITY OF TUSTIN LOCATED ON FIRST STREET BEI~IEEN PROSPECT
AVENUE AND NEWPORT AVENUE WHICH AREA IS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A" ATTACHED HERETO AND ON THAT
CERTAIN MAP ON FILE IN THE OFFICE OF THE CITY CLERK AND
CITY ENGINEER OF THE CITY OF TUSTIN
WHEREAS, Ordinance No. 411 of the City of Tustin authorizes the City
Council from Lime to time to call public hearings to ascertain whether the
public necessity, health, safety or welfare require the removal of poles,
overhead wires and associated overhead structures within certaih designated
areas of the City and to consider the underground installation of the
aforementioned appurtenances for supplying electric, communication, or similar
associated services to the residents, of the City of Tustin, and
WHEREAS, by the aforementioned Ordinance No. 411, the City Clerk is
required to notify all affected prQperty owners, if any, as shown on the last
equalized assessment roll and also to notify all concerned utilities by mail of
the time and place of hearings to determine whether to form an Underground
Utility District and of the availability of the City Engineer's report of the
details of the District in the office of the City Clerk prior to said hearing,
and
WHEREAS, said notice is required to be giv6n to the aforementioned
property owners and concerned utilities at least ten (10) days prior to the
date of the public hearing, and
WHEREAS, the City Engineer has advised that this report is on file in
the office of the City Clerk, and
WHEREAS, the City Council has determined that a public hearing should
be set on October 7, 1987, at the hour of 7:00 P.M. in the City Council
Chambers at 300 Centennial Way in the City of Tustin.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said Council hereby sets Monday, October 7, 1987, at 7:00 P.M. in
the City Council Chambers at 300 Centennial Way in the City of Tustin,
California, as the time and place for a public hearing to ascertain whether the
public necessity, health, safety or welfare require the removal of poles,
overhead wires and associated overhead structures and the establishment of an
Underground Utility District within the area of the City of Tustin generally
located on First Street between Prospect Avenue and Newport Avenue, certain
maps on file in the office of the City Clerk and the City Engineer of the City
of Tustin.

BE IT FURTHER RESOLVED that the City Clerk is hereby authorized to
2 notify all affected property owners, if any, as shown on the last equalized
assessment roll and to also notify all utilities affected by this proposal by a
3 notice through the United States mail of the time and place of said hearing,
and of the availability of the City Engineer's report of the details of the
4 District in the office of the City Clerk prior to said hearing, ten (10) days
prior to the date thereof.

PASSED AND ADOPTED at a regular meeting of the City Council of the

Thence, easterly along said centerline of First Street a distance of 192.5 feet
